Ilhan Omar\">amendment proposed<\/a> by Rep. Andy Biggs, R-Ariz., that would have altered Section 702 of the Foreign Intelligence Surveillance Act (FISA) to mandate that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/you-must-testify-under-oath-hawley-demands-answers-rips-merrick-garland-for-targeting-of-pro-life-activist\/\" title=\"\u2018You Must Testify, Under Oath\u2019: Hawley Demands Answers, Rips Merrick Garland For Targeting Of Pro-Life Activist\">federal authorities obtain<\/a> a warrant before surveilling American citizens. The bill must clear the Senate before it hits President Joe Biden\u2019s desk for signature. <\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\"><p>\u2014 Greg Price (@greg_price11) <a href=\"https:\/\/twitter.com\/greg_price11\/status\/1778827570240159772?ref_src=twsrc%5Etfw\">April 12, 2024<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<p>As my colleague Brianna Lyman previously <a href=\"https:\/\/thefederalist.com\/2024\/04\/10\/19-republicans-resist-deep-state-efforts-to-keep-spying-on-americans-without-a-warrant\/\" target=\"_blank\" rel=\"noreferrer noopener\">explained<\/a>, \u201cSection 702 has allowed the government to carry out warrantless surveillance of American citizens in violation of the Fourth Amendment and will expire on April 19 without further action from Congress.\u201d According to Punchbowl News\u2019 Jake Sherman and John Bresnahan, the White House\u2019s Jake Sullivan and U.S. Attorney General Merrick Garland \u201ccall[ed] members on the Hill\u201d this morning to pressure them into squashing Biggs\u2019 amendment. <\/p>\n<p>\u201c[White House] working hard to defeat,\u201d Sherman <a href=\"https:\/\/x.com\/JakeSherman\/status\/1778805755560247330\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a> on X. <\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<div lang=\"en\" dir=\"ltr\">\n<p>VERY intense W.H. lobbying effort on the warrant issue.<br \/>\u2013 Jake Sullivan\/Merrick Garland made calls<br \/>\u2013 NSC attorney Josh Geltzer and Deputy homeland security adviser Jen Daskal were right outside the floor with representatives from DOJ\/CIA to talk to members<\/p>\n<p>There was a secure\u2026<\/p>\n<\/div>\n<p>\u2014 Jake Sherman (@JakeSherman) <a href=\"https:\/\/twitter.com\/JakeSherman\/status\/1778844892132729207?ref_src=twsrc%5Etfw\">April 12, 2024<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<p>Speaking in support of his measure on the House floor, Biggs blasted the Biden administration\u2019s indefensible desire to continue spying on Americans without obtaining a warrant, a clear constitutional violation, and the absurd arguments employed by Section 702\u2019s staunchest defenders. <\/p>\n<p>\u201cThe administration cites multiple examples where using Section 702 [has been used] to monitor foreign targets and provide critical intelligence,\u201d Biggs <a href=\"https:\/\/x.com\/RepAndyBiggsAZ\/status\/1778811175720849672\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> during a House floor speech. \u201cBut when it comes to warrantless searches for Americans, they can\u2019t provide any examples of where \u2026 that\u2019s provided any useful information, and yet they want to continue to look at U.S. persons\u2019 information without a warrant.\u201d<\/p>\n<p>During the 2016 election cycle, the FBI infamously abused FISA to spy on Donald Trump\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/why-this-average-american-is-voting-for-donald-trump\/\" title=\"Why This Average American Is Voting for Donald Trump\">presidential campaign<\/a>, leading to massively influential false claims Trump was a Russian asset and that Russia stole the election for Trump. As The Federalist previously <a href=\"https:\/\/thefederalist.com\/2024\/03\/11\/russia-hoaxer-adam-schiff-says-he-hopes-intel-community-will-hide-info-from-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, \u201cthe FBI obtained a surveillance warrant against former Trump campaign staffer Carter Page through a secret FISA court and did not alert the court that Christopher Steele, the man behind the discredited \u2018Steele Dossier,\u2019 was a spy.\u201d <\/p>\n<p>The feds have also used FISA to surveil hundreds of thousands of Americans. According to the left-wing Brennan Center for Justice, agencies such as the FBI and CIA have cited the statute to carry out <a href=\"https:\/\/www.brennancenter.org\/our-work\/analysis-opinion\/why-congress-must-reform-fisa-section-702-and-how-it-can\" target=\"_blank\" rel=\"noreferrer noopener\">more than 200,000 warrantless searches<\/a> every year to snoop through Americans\u2019 private communications.<\/p>\n<hr>\n<p>      Shawn Fleetwood is a staff writer for The Federalist and a graduate of the University of Mary Washington.
