This initiative continues a practice where presidents use executive orders to enhance protections on public lands, despite some legal controversies and challenges.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><\/p>\n<div class=\"article-content\">\n<p>The New York Times <a href=\"https:\/\/www.nytimes.com\/2024\/04\/11\/climate\/biden-california-national-monuments.html?smtyp=cur&#038;smid=tw-nytimes\" target=\"_blank\" rel=\"noreferrer noopener\">reported <\/a>Thursday that President Joe Biden is planning to expand a pair of national monuments in California by roughly 130,000 acres, citing two people familiar with the plans. <\/p>\n<p>\u201cThe San Gabriel Mountains National Monument and the Berryessa Snow Mountain National Monument will each get new boundaries designed to protect land of cultural significance to Native American tribes,\u201d the Times revealed. <\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-117832554\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-b39f7fbb1d909d21fe26caceceaa5321 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-b39f7fbb1d909d21fe26caceceaa5321\"><\/div>\n<p>The two monuments were established by President Barack Obama using the 1906 Antiquities Act. The century-plus-old law allows the commander-in-chief to unilaterally place additional public lands under enhanced federal protections by executive order. <\/p>\n<p>While a <a href=\"https:\/\/www.doi.gov\/blog\/americas-public-lands-explained\" target=\"_blank\" rel=\"noreferrer noopener\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/white-house-releases-list-of-president-trumps-accomplishments-and-it-is-historic\/\" title=\"White House Releases List of President Trump\u2019s Accomplishments \u2013  And It Is Historic!\">national park<\/a><\/a> is a large swath of land protected by an act of Congress, land with a \u201c<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/regime-fears-the-people-thousands-of-national-guard-asked-to-remain-in-dc-until-mid-march\/\" title=\"Regime Fears the People: Thousands of National Guard Asked to Remain in DC Until Mid-March\">national monument<\/a>\u201d designation protects a \u201cspecific natural, cultural or historic feature.\u201d The 1906 law, however, <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/54\/320301\" target=\"_blank\" rel=\"noreferrer noopener\">requires<\/a> that the area preserved must be \u201cthe smallest area compatible with the proper care and management of the objects to be protected.\u201d <\/p>\n<p>President Obama had a habit of violating the law\u2019s mandates to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bidens-designation-of-million-acre-monument-is-blatant-abuse-of-presidential-power\/\" title=\"Biden's Monument Designation: Clear Presidential Power Abuse\">establish quasi-national parks<\/a> without congressional approval. President Biden is carrying on the tradition. <\/p>\n<p>The San Gabriel monument, established east of Los Angeles in 2014, already covers more than 340,000 acres of the Angeles National Forest and more than 4,000 acres of the adjacent San Bernardino National Forest. If the monument were one of the 63 national parks, it would already <a href=\"https:\/\/parksexpert.com\/national-parks-by-size\/\" target=\"_blank\" rel=\"noreferrer noopener\">rank<\/a> 23rd in size, even larger than Grand Teton National Park in Wyoming. Biden, according to The New York Times, wants to expand the monument by another 110,000 acres.<\/p>\n<div class=\"fdrlst__b89e9-6bf2e9fe1c056e9288cbe236dafa3449 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-6bf2e9fe1c056e9288cbe236dafa3449\"><\/div>\n<p>The Berryessa Snow Mountain National Monument, created in 2015, protects nearly 331,000 acres, already an area roughly the same size as Hawaii\u2019s Volcanoes National Park. Biden plans to expand the monument by nearly 14,000 acres.<\/p>\n<p>Together, the roughly 130,000-acre expansion would restrict more land than eight of the nation\u2019s smallest national parks combined. The <a href=\"https:\/\/home.nps.gov\/deto\/learn\/historyculture\/upload\/first%2050%20years.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">first monument<\/a> established under the Antiquities Act was Devil\u2019s Tower in Wyoming, which encompasses about 1,300 acres. <\/p>\n<p>President Biden also abused the Antiquities Act in the first year of his presidency to <a href=\"https:\/\/thefederalist.com\/2021\/10\/13\/why-joe-bidens-expansion-of-bears-ears-national-monument-is-an-aggressive-land-grab\/\" target=\"_blank\" rel=\"noreferrer noopener\">restore <\/a>the Obama-era boundaries of Bears Ears National Monument and Grand Staircase-Escalante National Monument in Utah. The two monuments collectively preserve more than 3 million acres, an area larger than the national park at Yellowstone.  <\/p>\n<p>The monuments\u2019 expansions illustrate why the Supreme Court must step in to reevaluate presidential abuse of the Antiquities Act. In March, however, the high bench <a href=\"https:\/\/www.eenews.net\/articles\/supreme-court-refuses-timber-industry-antiquities-act-fight\/\" target=\"_blank\" rel=\"noreferrer noopener\">refused <\/a>a pair of cases that held potential for justices to re-evaluate the president\u2019s authority to circumvent Congress when designating hundreds of thousands of acres with monument status. <\/p>\n<div class=\"fdrlst__b89e9-28d1b8866bdefd7fde3e2b5a0a9984d5 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-28d1b8866bdefd7fde3e2b5a0a9984d5\"><\/div>\n<p>President Biden promptly <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/presidential-actions\/2021\/01\/27\/executive-order-on-tackling-the-climate-crisis-at-home-and-abroad\/\">declared <\/a>locking off 30 percent of the nation\u2019s lands and waterways by 2030 a top priority in the first week of his administration. The initiative, known as \u201c<a href=\"https:\/\/www.vox.com\/2021\/5\/7\/22423139\/biden-30-by-30-conservation-initiative-historic\" target=\"_blank\" rel=\"noreferrer noopener\">30 by 30<\/a>,\u201d has prominently featured a new public lands regime for \u201c<a href=\"https:\/\/thefederalist.com\/2023\/05\/19\/new-blm-rules-on-conservation-leases-will-fundamentally-transform-public-land-management\/\" target=\"_blank\" rel=\"noreferrer noopener\">conservation leases<\/a>\u201d and <a href=\"https:\/\/thefederalist.com\/2023\/09\/07\/biden-cancels-all-remaining-leases-congress-issued-in-arctic-refuge-further-gutting-american-energy\/\" target=\"_blank\" rel=\"noreferrer noopener\">prohibitions <\/a>on oil and gas development in resource-rich areas of the country, in addition to the radical expansion of national monuments. <\/p>\n<p>Designating public lands under monument status <a href=\"https:\/\/www.nationalforests.org\/blog\/what-are-the-differences-between-national-parks-and-national-forests\" target=\"_blank\" rel=\"noreferrer noopener\">strips <\/a>the multiple-use mandate that allows residents to capitalize and more freely recreate on public property. Most national forests, for example, allow timber harvesting and hold less regulations for recreation. <\/p>\n<p>On Colorado\u2019s western slope, residents are anxious over potential plans to designate a new national monument over the Dolores River. The new monument would encompass roughly <a href=\"https:\/\/coloradosun.com\/2024\/03\/04\/dolores-river-national-monument-opposition\/\" target=\"_blank\" rel=\"noreferrer noopener\">400,000 <\/a>acres, an area almost twice the size of Rocky Mountain National Park. <\/p>\n<p>\u201cIt absolutely, positively could be a threat,\u201d said Sean Pond, a local resident, told The Colorado Sun last month. \u201cIf you look at the history of monument designations over time, more and more restrictions are put in place as more people start coming. We could start losing access. These are public lands me and my family and our neighbors have enjoyed for decades.
