His attorneys, Andrew Baldwin and Bradley Rozzi, asked Special Judge Fran Gull on Thursday to suppress statements Allen made in prison allegedly confessing to the crimes, WTHR <a href=\"https:\/\/www.wthr.com\/article\/news\/crime\/delphi-girls-murdered\/richard-allen-attorneys-say-jury-should-not-hear-his-alleged-confessions-during-delphi-murders-trial\/531-686dd233-2c17-4458-a4c0-371392963bc6\" target=\"_blank\" rel=\"noopener\">reported<\/a>.<\/p>\n<p>The attorneys alleged that Allen did not make the comments voluntarily and was mentally ill at the time. Rozzi said in a motion to suppress statements filed Thursday that prison officials put inmates at Allen\u2019s cell door and had them keep logs of everything Allen said and did. Rozzi said that some of those inmates actively questioned Allen, which Rozzi said amounts to a \u201csustained form of interrogation; one that lasted more than five months before he was finally broken.\u201d<\/p>\n<p>Rozzi argued in another filing that allowing those statements to be used in Allen\u2019s trial would violate his constitutional rights, since he didn\u2019t have an attorney present when he made the comments.<\/p>\n<p>Further, Rozzi said Allen \u201cslipped into a state of psychosis plagued with grossly disorganized, delusional, paranoid and highly dysfunctional behavior,\u201d while he was in prison. This behavior included \u201cperiods of not sleeping for days, paranoia, stripping off his clothes, drinking toilet water, covering himself with and eating his own feces, and many other socially unacceptable behaviors.\u201d<\/p>\n<p>The defense attorneys also argued that Allen\u2019s alleged confessions don\u2019t even align with the evidence from the crime scene, meaning they can\u2019t be accurate.<\/p>\n<p>The prosecution in the case first mentioned the alleged confessions in June 2023, saying that Allen \u201cconfessed five or six times\u201d while in prison.<\/p>\n<p>Prosecutor Nick McLeland stated in court at the time that Allen \u201cmade multiple confessions to multiple people,\u201d Fox 59 <a href=\"https:\/\/fox59.com\/news\/indycrime\/delphi-murder-suspect-richard-allen-due-in-court\/\" target=\"_blank\" rel=\"noopener\">reported<\/a>.<\/p>\n<p><b><a href=\"https:\/\/onelink.to\/dwapp\" target=\"_blank\" rel=\"noopener noreferrer\" aria-describedby=\"sk-tooltip-9096\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/onelink.to\/dwapp&#038;source=gmail&#038;ust=1712932862202000&#038;usg=AOvVaw0plT8RRdMy9XUpIhocnjQS\">CLICK HERE TO GET THE DAILYWIRE+ APP<\/a><\/b><\/p>\n<p>Rozzi acknowledged that Allen had made \u201cincriminating statements,\u201d but said those statements couldn\u2019t be trusted due to his client\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/massachusetts-schools-commissioner-will-try-to-force-schools-to-reopen-over-teachers-union-objections\/\" title=\"Massachusetts Schools Commissioner Will Try To Force Schools To Reopen Over Teachers Union Objections\">deteriorating mental health<\/a>.<\/p>\n<p>Allen\u2019s trial is set to begin on May 13, following Judge Gull\u2019s refusal to dismiss the charges based on allegations from the defense team that police recorded over interviews with key witnesses.<\/p>\n<p>McLeland <a href=\"https:\/\/www.dailywire.com\/news\/delphi-prosecutor-says-deleted-interviews-with-witnesses-were-not-useful-evidence-in-murders-of-teenage-girls\" target=\"_blank\" rel=\"noopener\">pushed back<\/a> against the defense\u2019s claims, arguing that the interviews were \u201cnot evidence at all related to this case.\u201d<\/p>\n<p>He acknowledged that the interviews, which were conducted just days after the bodies of Williams and German were found, had been inadvertently recorded over, but \u201cwere not destroyed by the state purposefully or in bad faith.\u201d Prosecutors <a href=\"https:\/\/www.dailywire.com\/news\/police-recorded-over-interviews-with-key-witnesses-in-delphi-murders-defense-attorneys-say\" target=\"_blank\" rel=\"noopener\">said<\/a> the interviews had been \u201crecorded over\u201d because of \u201ca DVR program error.\u201d<\/p>\n<p>Judge Fran Gull agreed with McLeland that charges against Allen shouldn\u2019t be dismissed based on the missing interviews, saying Baldwin and Rozzi didn\u2019t prove that the recordings were destroyed \u201cnegligently, intentionally, or in bad faith,\u201d according to Fox 59.<\/p>\n<p>\u201cThe recordings of interviews between February 14 -17, 2017, were lost due to human error or were <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/delphi-judge-wont-dismiss-charges-against-richard-allen-after-police-recorded-over-interviews\/\" title=\"Delphi Judge Refuses to Drop Charges Against Richard Allen Despite Police Recording Mishap\">spontaneously lost due<\/a> to equipment resetting,\u201d Gull wrote in her ruling, <a href=\"https:\/\/fox59.com\/news\/judge-wont-throw-out-delphi-murder-charges-over-deleted-interviews\/\">according<\/a> to the outlet.<\/p>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Defense counsel representing the suspect linked to the 2017 murder of two Delphi, Indiana, teenagers aims to exclude the suspect&#8217;s jailhouse confessions from the trial.
