This underscores the political\u2062 divide and the critical need to confirm Biden&#8217;s nomination \u2064for the impending election.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p><a href=\"http:\/\/washingtonexaminer.com\/tag\/democrats\/\" target=\"_blank\" rel=\"noopener\" title>Democrats<\/a> aren\u2019t happy with warnings that the dates for their nominating convention aren\u2019t aligning with the calendars of two red states\u2019 top election officials.<\/p>\n<p>Republican secretaries of state in <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/ohio\/\" target=\"_blank\" rel=\"noopener\" title>Ohio<\/a> and<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/alabama\/\" target=\"_blank\" rel=\"noopener\" title> Alabama<\/a> warned Democrats that President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/joe-biden\/\" target=\"_blank\" rel=\"noopener\" title>Joe Biden<\/a> may not appear on the ballot in November because the Democratic National Convention is scheduled for after both states\u2019 deadlines. <\/p>\n<p>Now, Democrats are exploring four options to ensure Biden is certified for the ballots in November.<\/p>\n<h2>Letters for the president<\/h2>\n<p>The first route the Democratic National Committee can take is to send letters confirming Biden and Vice President Kamala Harris as its picks for president and vice president. This is the same move Republicans made in Alabama when the party\u2019s convention was past the state\u2019s deadline in 2020.<\/p>\n<p>However, Wes Allen, Alabama\u2019s secretary of state, said Democrats\u2019 choice to do a \u201cprovisional\u201d certification, which would notify states before the convention of their choice for Biden as the nominee, will be rebuffed. He said there would be \u201cno exceptions\u201d to the law setting the Aug. 15 deadline.<\/p>\n<h2>Force an in-state deadline change<\/h2>\n<p>Democrats are also looking to get the deadline changed through the state legislatures. A bill written by Alabama Democratic state Sen. Merika Coleman was introduced on Thursday and would move the state\u2019s deadline to Aug. 23. Coleman has received no indication that the bill won\u2019t pass.<\/p>\n<p>Alabama Democratic Party Chairman Randy Kelley accused Allen of \u201cpartisan gamesmanship,\u201d citing that in the past, the GOP was able to resolve problems with ballot certification. <\/p>\n<p>\u201cWhile this issue with convention dates has occurred many times in the past, notably with the Alabama GOP in 2004, 2012, and 2020, it appears to only be a problem this year now that the Democrats\u2019 convention is behind the deadline,\u201d Kelley said in a statement.<\/p>\n<h2>Legal action<\/h2>\n<p>Democrats are also considering <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/n-m-widower-sues-alburquerque-over-sanctuary-city-policy\/\" title=\"N.M. widower sues Alburquerque over sanctuary city policy\">taking legal action<\/a>, given Alabama has made exceptions for GOP candidates for provisional agreements in the past.<\/p>\n<p>Barry Ragsdale, an attorney representing the Biden campaign, said the court would interpret state laws to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/to-ensure-paxtons-impeachment-trial-is-fair-the-texas-senate-must-adopt-rules-that-stop-the-political-circus\/\" title=\"For a fair Paxton impeachment trial, Texas Senate needs fair rules to prevent political circus.\">ensure constitutional rights<\/a> are protected.<\/p>\n<p>\u201cHere, a court would have little difficulty finding that strict application of the eighty-two-day deadline imposes a severe restriction on President Biden and Vice President Harris\u2019s access to the ballot,\u201d Ragsdale <a href=\"https:\/\/alabamareflector.com\/2024\/04\/11\/joe-biden-campaign-hints-at-litigation-if-alabama-keeps-president-off-ballot\/\" target=\"_blank\" rel=\"noopener\" title>wrote<\/a>. \u201cIf strictly enforced, the deadline would prevent one of the two major party presidential candidates from appearing on the general election ballot \u2014 an unjust and unconstitutional result.\u201d<\/p>\n<h2>Virtual vote<\/h2>\n<p>Democrats could also hold a virtual vote ahead of the party\u2019s convention to nominate Biden and Harris.<\/p>\n<p>The Democratic National Convention in Chicago will happen four days after Alabama\u2019s Aug. 15 deadline and 12 days after Ohio\u2019s Aug. 7 deadline for parties to submit their nominees. In Ohio, legal counsel suggests the DNC would have to change its deadline for certification or pass a law changing its deadline by May 9. Ohio state laws require that ballot certification occur 90 days before the general election.<\/p>\n<p><a href=\"http:\/\/washingtonexaminer.com\/\" target=\"_blank\" rel=\"noopener\" title><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p>Josh Marcus-Blank, Biden\u2019s campaign manager, said he is expecting provisional agreements to be reached in Alabama and Ohio.<\/p>\n<p>\u201cJoe Biden will be on the ballot in all 50 states,\u201d Marcus-Blank said in a statement. \u201cState officials have the ability to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/how-a-dnc-scheduling-error-could-mean-biden-wont-be-on-alabamas-ballot-in-november\/\" title=\"A DNC scheduling mistake might lead to Biden missing from Alabama's November ballot\">grant provisional ballot access certification prior<\/a> to the conclusion of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/nevada-to-hold-first-presidential-primary-of-2024-election-cycle\/\" title=\"Nevada To Hold First Presidential Primary Of 2024 Election Cycle\">presidential nominating conventions<\/a>.
