The ruling impacts the 2024 election landscape, prompting strong reactions from both sides\u200b of the abortion debate.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Former President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\" target=\"_blank\" rel=\"noreferrer noopener\">Donald Trump<\/a>\u2018s attempt to handle the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/abortion\/\" target=\"_blank\" rel=\"noreferrer noopener\">abortion<\/a> problem plaguing the GOP delicately backfired in the wake of an <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/arizona\/\" target=\"_blank\" rel=\"noreferrer noopener\">Arizona <\/a>Supreme Court ruling that upheld a Civil War-era law banning the majority of abortions\u00a0in the state.<\/p>\n<p>Trump stated that in the wake of the <em>Dobbs v. Jackson Women\u2019s Health Organization<\/em> decision striking down <em>Roe v. Wade<\/em>, states had the responsibility to determine when to restrict or allow abortion access. <\/p>\n<p>But the Arizona ruling on Tuesday allowing an 1864 law that has no exceptions for rape or incest and punishes abortion providers with a prison sentence to be enforced complicates not just Trump\u2019s opinion on abortion, but how the 2024 race will be decided. <\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/election-2024\/?utm_source=homepage&#038;utm_medium=banner&#038;utm_campaign=iowa_caucus&#038;utm_id=election2024\" target=\"_blank\" rel=\"noreferrer noopener\">ELECTION 2024: FOLLOW LATEST COVERAGE<\/a><\/strong><\/p>\n<p>Trump said he <a href=\"https:\/\/www.washingtonexaminer.com\/news\/campaigns\/2960970\/trump-arizona-supreme-court-too-far-abortion-ruling\/\" target=\"_blank\" rel=\"noopener\" title>would not sign<\/a> a national abortion ban and claimed the Arizona ruling went too far during a surprise press conference on Wednesday before an Atlanta, Georgia, fundraiser. <\/p>\n<p>\u201cIt\u2019s all about state\u2019s rights. (AP Photo\/Jason Allen)<\/figcaption><\/figure>\n<p>The Trump campaign previously evaded questioning from the <em>Washington Examiner<\/em> and other media outlets on what Trump would do regarding abortion if elected for a second term. \u201cPresident Trump could not have been more clear.\u00a0These are decisions for people of each state to make,\u201d said Karoline Leavitt, Trump\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ian-sams-former-kamala-aide-and-grillary-clinton-apron-model-lands-new-gig-as-bidens-covid-spox\/\" title=\"Ian Sams, Former Kamala Aide and \u2018Grillary Clinton\u2019 Apron Model, Lands New Gig as Biden\u2019s COVID Spox\">national press secretary<\/a>. <\/p>\n<p>However, Trump\u2019s comments later Wednesday were his most forthright stance on abortion since he released a video statement on the issue via Truth Social. Throughout the GOP primary season, the former president vacillated between embracing his status as an anti-abortion leader and disavowing six-week abortion bans in states such as Florida. <\/p>\n<p>The Biden campaign first taunted Trump over the refusal to answer follow-up questions on his abortion stance Wednesday morning, before denouncing Trump\u2019s comments while in Atlanta.<\/p>\n<p>\u201cDonald Trump owns the suffering and chaos happening right now, including in Arizona, because he proudly overturned <em>Roe<\/em> \u2014 something he called \u2018an incredible thing\u2019 and \u2018pretty amazing\u2019 just today,\u201d Biden communications director Michael Tyler said in a statement. <\/p>\n<p>Rachel O\u2019Leary Carmona, executive director of Women\u2019s March, told the <em>Washington Examiner<\/em> that Trump\u2019s stances on abortion are not credible because he is a \u201cliar.\u201d <\/p>\n<p>\u201cHe is very clear that he gutted <em>Roe<\/em> and he has become less clear about his vision on this, as the Republicans have wrapped up loss after loss, unmitigated and unbroken since the Dobbs decision,\u201d Carmona said. <\/p>\n<p>\u201cWhat an individual Arizona voter thinks, I think is one thing, but what I do know is that when Americans go to the polls, abortion access wins, reproductive freedom wins,\u201d Carmona continued. \u201cAnd there\u2019s a reason why all of these bans and all of these decisions are happening through packed courts, and it\u2019s because these bans cannot stand on merit.\u201d<\/p>\n<p>Anger over abortion restrictions hampered GOP candidates nationwide since the 2022 midterm elections, the first major elections held after <em>Roe<\/em> was overturned. It hasn\u2019t helped Republicans that Trump has repeatedly bragged about appointing the three conservative Supreme Court justices that helped take down <em>Roe<\/em>. <\/p>\n<p>Democrats have successfully wielded attacks against Republicans as limiting women\u2019s freedom, which Trump hoped to get ahead of when he released his statement on abortion Monday morning. <\/p>\n<p>But President Joe Biden could win Arizona, a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/huge-sidney-powell-witness-whom-ny-times-described-as-always-the-smartest-person-in-the-room-concludes-hundreds-of-thousands-of-votes-transferred-from-trump-to-biden-in-all-battleground-states\/\" title=\"HUGE! Sidney Powell Witness Whom NY Times Described as \"Always the Smartest Person in the Room\" Concludes Hundreds of Thousands of Votes Transferred from Trump to Biden IN ALL BATTLEGROUND STATES\">key battleground state<\/a>, and its 11 electoral votes for a second time if he can galvanize voters upset over the abortion ruling to vote for him. Biden narrowly won the state in 2020 against Trump by less than 11,000 votes. <\/p>\n<p>It could also boost Rep. Ruben Gallego (D-AZ) who is running for the open Senate seat, which could help Democrats keep control of the upper chamber, after Sen. Kyrsten Sinema (I-AZ) declined to run for reelection. <\/p>\n<p>Abortion-rights organizers are working to get an amendment that would enshrine abortion into the state constitution on the November ballot. The coalition group Arizona for Abortion Access previously announced it already has more than the needed signatures for the abortion ballot measure. <\/p>\n<p>A Florida Supreme Court ruling allowed a ballot measure on abortion to appear on the ballot in November, giving Democrats some hope they can flip the Sunshine State. <\/p>\n<p>\u201cAbortion was already going to be a top issue going into November because of the strong likelihood of the ballot measure,\u201d said Lorna Romero Ferguson, a Republican political strategist based in Arizona. \u201cBut this Arizona Supreme Court ruling just pretty much put more gasoline on the fire and has really made it not only a top issue of the state at the moment but national headlines, international headlines about this ruling.\u201d <\/p>\n<p>\u201cThis occurring in Arizona \u2014 which, of course, is one of the key battleground states on which the presidential election will hinge \u2014 for the Republicans, that\u2019s a very unfortunate occurrence,\u201d said Richard Arenberg, senior fellow in international and public affairs and visiting political science professor at Brown University. \u201cThat this court decision should come down now, it kind of creates almost the worst possible issue for them in almost the worst possible place.\u201d<\/p>\n<p>Both Biden and Vice President Kamala Harris quickly released statements blaming Trump and the GOP for the Arizona abortion ban.<\/p>\n<p>However, some prominent Arizona Republicans have <a href=\"https:\/\/www.washingtonexaminer.com\/news\/house\/2959726\/arizona-supreme-court-abortion-decision-state-republicans-ruling-disaster\/\" target=\"_blank\" rel=\"noopener\" title>distanced themselves<\/a> from the ruling, including senatorial candidate Kari Lake.<\/p>\n<p>\u201cI wholeheartedly agree with President Trump \u2014 this is a very personal issue that should be determined by each individual state and her people,\u201d Lake, an anti-abortion advocate, said in a <a href=\"https:\/\/twitter.com\/KariLake\/status\/1777763769890071022\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a> on Tuesday. \u201cI oppose today\u2019s ruling, and I am calling on Katie Hobbs and the State Legislature to come up with an immediate common sense solution that Arizonans can support.\u201d<\/p>\n<p>\u201cToday\u2019s ruling is a disaster for women and providers,\u201d Rep. Juan Ciscomani (R-AZ) said in a <a href=\"https:\/\/twitter.com\/repciscomani\/status\/1777757519504380389?s=46&#038;t=Gepuixs8AegS3Gcy3aXO2g\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a> on Tuesday. \u201cIn Arizona, our <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/arizona-supreme-court-abortion-decision-slammed-by-state-republicans-todays-ruling-is-a-disaster\/\" title=\"State Republicans strongly criticize the Arizona Supreme Court's abortion decision, calling it a \"disaster.\">15 week law protected<\/a> the rights of women and new life. It respected women and the difficult decision of ending a pregnancy \u2014 one I will never personally experience and won\u2019t pretend to understand.\u201d<\/p>\n<p>Gov. Katie Hobbs (D-AZ), who defeated Lake in 2022, called the state Supreme Court ruling \u201ccallous\u201d and a \u201cdark day\u201d in a video statement. State Attorney General Kris Mayes said<em> <\/em>\u201cno woman or doctor will be prosecuted under this draconian law in this state\u201d in a <a href=\"https:\/\/www.azag.gov\/press-release\/attorney-general-mayes-statement-planned-parenthood-az-v-mayes\" target=\"_blank\" rel=\"noopener\" title>statement<\/a> Tuesday. <\/p>\n<figure><\/figure>\n<p>A <em>Wall Street Journal<\/em> poll released last week showed Trump beating Biden in Arizona, 39% to 34%. But with abortion center stage, it could hurt Trump. <\/p>\n<p>In 2022, 61% of Arizona voters said abortion should be legal in most or all cases, while 6% said it should be illegal in all cases, according to AP VoteCast. In February 2023, a poll from the Public Religion Research Institute showed that 62% of Arizonans said abortion should be legal in most or all cases. <\/p>\n<p>\u201cThis is going to be super damaging to be quite frank for Republicans in Arizona,\u201d said Ariel Hill-Davis, a Republican strategist and founder of Republican Women for Progress. \u201cAnd I think the responses in terms of Donald Trump\u2019s statements about they\u2019re going too far, I think Kari Lake\u2019s statements about it, kind of demonstrate that this is going to be a pain point for Republicans on the ballot in Arizona.\u201d <\/p>\n<p>Political experts told the <em>Washington Examiner<\/em> the best scenario for Trump is for abortion to not be the top issue in the battle for Arizona.
