This situation underscores possible oversights by the \u200cDemocrats, juxtaposed with efforts to prevent Trump from appearing on 2024 ballots.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<div>\n<figure>                         <\/figure>\n<\/p><\/div>\n<p>President Joe Biden is at risk of losing ballot access in Alabama and Ohio due to a scheduling error by the Democratic National Committee (DNC), according to the states\u2019 leading election officials.<\/p>\n<p>On Tuesday, Alabama Secretary of State Wes Allen <a href=\"https:\/\/www.sos.alabama.gov\/newsroom\/secretary-state-wes-allen-notifies-democratic-party-names-submitted-past-certification\" target=\"_blank\" rel=\"noreferrer noopener\">informed<\/a> the state Democrat Party and DNC that the party\u2019s national nominating convention is scheduled to take place after the deadline by which presidential and vice presidential candidates are required to be certified by state law. According to the statute Allen cited, political parties must provide a certificate of nomination for these candidates \u201cno later than the 82nd day preceding the day fixed for the election,\u201d or Aug. 15, 2024. <\/p>\n<p>The Democratic National Convention is currently slated to start Aug. 19. <\/p>\n<p>\u201cThe certificate of nomination must be signed by the presiding officer and secretary of the convention and by the chair of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/south-carolina-gop-censures-rep-tom-rice-over-trump-impeachment-vote\/\" title=\"South Carolina GOP Censures Rep. Tom Rice Over Trump Impeachment Vote\">state executive committee<\/a> of the political party making the nomination,\u201d Allen wrote in a <a href=\"https:\/\/www.sos.alabama.gov\/sites\/default\/files\/press\/Letter%20to%20AL%20Democratic%20Party%204.9.24.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">letter<\/a>. \u201cIf this Office has not received a valid certificate of nomination from the Democratic Party following its convention by the statutory deadline, I will be unable to certify the names of the Democratic Party\u2019s candidates for President and Vice President for ballot preparation for the 2024 general election.\u201d<\/p>\n<p>Allen sent his letter days after legal counsel for Ohio Secretary of State Frank LaRose <a href=\"https:\/\/abcnews.go.com\/Politics\/biden-face-challenges-ohio-general-ballot\/story?id=108912620\">iss<\/a><a href=\"https:\/\/abcnews.go.com\/Politics\/biden-face-challenges-ohio-general-ballot\/story?id=108912620\" target=\"_blank\" rel=\"noreferrer noopener\">ued<\/a> a similar communique notifying Ohio Democrat Party Chair Liz Walters that the Democratic National Convention\u2019s current date is more than a week after the date by which presidential candidates must be certified in Ohio. This year, that date is Aug. 7, according to ABC News.<\/p>\n<p>\u201cI am left to conclude that the Democratic National Committee must either move up its nominating convention or the Ohio General Assembly must act by May 9, 2024 (90 days prior to a new law\u2019s effective date) to create an exception to this statutory requirement,\u201d legal counsel Paul Disantis wrote. <\/p>\n<p>A similar problem occurred in 2020, when both major political parties\u2019 nominating conventions were scheduled to take place after Ohio\u2019s certification deadline. In that case, the Ohio General Assembly \u201capproved changing the cutoff to 60 days \u2014 but only for that election,\u201d according to <a href=\"https:\/\/www.daytondailynews.com\/nation-world\/biden-could-miss-the-deadline-for-the-november-ballot-in-ohio-the-states-election-office-says\/P7W3GR3TIZA7TI3QMLAB5EK4UU\/\" target=\"_blank\" rel=\"noreferrer noopener\">Dayton Daily News<\/a>. <\/p>\n<p>When pressed by the outlet on this year\u2019s scheduling conflict, the Biden campaign dismissed concerns about the president possibly not making it onto Ohio\u2019s ballot, saying: \u201cWe\u2019re monitoring the situation in Ohio, and we\u2019re confident that Joe Biden will be on the ballot in all 50 states.\u201d<\/p>\n<p>The possibility of Democrat incompetence \u2014 or their hubris in assuming states would accommodate their convention schedule \u2014 costing Biden ballot access is ironic, given the left\u2019s authoritarian attempts to remove former President Donald Trump from 2024 ballots. <\/p>\n<p>In December, the Democrat-controlled Colorado Supreme Court ruled that Trump could not appear on the state\u2019s 2024 ballot, claiming the former president engaged in an \u201cinsurrection\u201d because of the speech he gave in Washington D.C. on Jan. 6, 2021. The court\u2019s majority rationalized its decision by employing a <a href=\"https:\/\/thefederalist.com\/2023\/08\/25\/why-twisting-the-14th-amendment-clause-to-get-trump-wont-hold-up-in-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">twisted legal theory<\/a> regarding Section 3 of the 14th Amendment, which deals with the \u201ctreatment of former state and federal officials, and their allies, who had taken sides with the Confederacy\u201d during the Civil War.<\/p>\n<p>It wasn\u2019t long after the Colorado ruling that Maine Secretary of State Shenna Bellows, a Democrat, <a href=\"https:\/\/thefederalist.com\/2024\/01\/03\/trump-appeals-ruling-to-keep-him-off-maine-ballot-by-dem-who-was-disappointed-he-wasnt-impeached\/\" target=\"_blank\" rel=\"noreferrer noopener\">issued<\/a> an arbitrary decision barring Trump from the Pine Tree State\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/attorney-general-carefully-reviewing-argument-to-keep-trump-off-the-ballot\/\" title=\"AG reviewing argument to exclude Trump from ballot.\">presidential primary ballot<\/a>. An Illinois judge \u2014 whose judicial specialty is addressing traffic violations \u2014 also <a href=\"https:\/\/thefederalist.com\/2024\/02\/29\/illinois-judge-kicks-trump-off-the-ballot-says-any-votes-for-him-must-be-suppressed\/\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> in February that Trump could not appear on the state\u2019s 2024 primary ballot.<\/p>\n<p>The U.S. Supreme Court nullified those decisions in a <a href=\"https:\/\/thefederalist.com\/2024\/03\/04\/unanimous-scotus-smacks-down-colorado-lawfare-states-have-no-power-to-kick-trump-off-ballot\/\" target=\"_blank\" rel=\"noreferrer noopener\">9-0 ruling<\/a> last month, arguing the U.S. Constitution \u201cmakes Congress, rather than the States, responsible for enforcing Section 3 against federal officeholders and candidates.\u201d<\/p>\n<p>\u201cStates have no power under the Constitution to enforce Section 3 with respect to federal offices, especially the Presidency,\u201d the court ruled. <\/p>\n<hr>\n<p>      Shawn Fleetwood is a staff writer for The Federalist and a graduate of the University of Mary Washington.
