Cowlitz \u200dCounty\u200d Superior Court Judge\u200d Gary Bashor\u2062 sided \u200dwith a gun shop challenging \u200cthe ban, citing that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/colorado-judge-strikes-down-boulders-ar-15-ban\/\" title=\"Colorado Judge Strikes Down Boulder\u2019s AR-15 Ban\u00a0\">large capacity magazines<\/a> are arms protected by the state&#8217;s constitution. The ban remains in effect temporarily due to a state Supreme Court emergency appeal. In Washington, Judge Gary Bashor \u2062declared the state&#8217;s prohibition on high-capacity \u200bgun magazines unconstitutional. He supported a gun shop&#8217;s opposition to the ban, stating that such magazines are protected\u200d under the state constitution. However, the ban is still in place temporarily following an emergency appeal to the state Supreme Court.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p><span style=\"font-weight: 400\">A judge in <a href=\"https:\/\/www.dailywire.com\/topic\/washington\" target=\"_blank\" rel=\"noopener\">Washington<\/a> ruled that the state\u2019s ban on magazines that hold more than 10 rounds is unconstitutional, but the state Supreme Court granted an emergency appeal to pause the judge\u2019s decision, meaning the restriction stays in effect for now.<\/span><\/p>\n<p><span style=\"font-weight: 400\">On Monday, Cowlitz County Superior Court Judge Gary Bashor <a href=\"https:\/\/www.documentcloud.org\/documents\/24536660-state-of-washington-v-gators-custom-guns-inc-ruling-and-orders-23-2-00897-08\" target=\"_blank\" rel=\"noopener\">ruled<\/a> in favor of a Washington gun shop that sued the state after lawmakers banned magazines holding more than 10 rounds in 2022. Bashor rejected the state\u2019s arguments that the magazines were not suitable for self-defense and that the legislation was common sense. <\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cThis Court must find there exists no set of facts where the Court can find such a generalized ban or restriction on an am (or an instrument that facilitates self-defense) as constitutional under the Washington Constitution,\u201d Bashor <\/span><a href=\"https:\/\/www.documentcloud.org\/documents\/24536660-state-of-washington-v-gators-custom-guns-inc-ruling-and-orders-23-2-00897-08\"><span style=\"font-weight: 400\">wrote<\/span><\/a><span style=\"font-weight: 400\">  in his 55-page decision. \u201cThe United States Constitution and the Bill of Rights exist to define the outer limits of what Legislatures and Courts are allowed to do. Amending the Constitution and Bill of Rights cannot be done simply by enacting a law, or by a pronouncement from a Court.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">Bashor added that he found that large capacity magazines (LCMS) are classified as arms under the State Constitution and that members of the public commonly owned them for lawful purposes. <\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cThe State has not provided evidence that LCMs are NOT commonly and lawfully owned or possessed by civilians for lawful purposes, including self-defense. The State: instead chose to provide expert opinions concluding only that LCMs are not commonly \u2018fired for self-defense purposes\u2019, or are not the best choice for self-defense, neither of which are relevant metrics,\u201d he wrote. <\/span><\/p>\n<p><span style=\"font-weight: 400\">Bashor, who has been a judge in the rural county since 2011, also pointed to the Founding Fathers in his decision. <\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cThere was no appetite to limit gun rights by the Founders. Though the specific technology available today may not have been envisioned, the Founders expected technological advancements,\u201d Bashor wrote. \u201cThe result is few, if any, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/high-capacity-magazine-ban-found-unconstitutional-in-washington-state\/\" title=\"Washington state's ban on high-capacity magazines deemed unconstitutional\">historical analogue laws<\/a> by which a state can justify a modern firearms regulation.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">After Bashor\u2019s ruling, Washington State Attorney General Bob Ferguson, a Democrat, <a href=\"https:\/\/www.seattletimes.com\/seattle-news\/politics\/was-ban-on-high-capacity-gun-magazines-ruled-unconstitutional\/\" target=\"_blank\" rel=\"noopener\">filed<\/a> an emergency appeal before the state\u2019s high court, arguing magazine capacity limits are constitutional. <\/span><\/p>\n<p><b><a href=\"https:\/\/onelink.to\/dwapp\" target=\"_blank\" rel=\"noopener noreferrer\" aria-describedby=\"sk-tooltip-9096\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/onelink.to\/dwapp&#038;source=gmail&#038;ust=1700760801843000&#038;usg=AOvVaw2PQrVSrJfhxNb4LcARqniG\">CLICK HERE TO GET THE DAILYWIRE+ APP<\/a><\/b><\/p>\n<p><span style=\"font-weight: 400\">\u201cEvery court in Washington and across the country to consider challenges to a ban on the sale of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-gun-policies-concern-second-amendment-advocates\/\" title=\"Biden gun policies concern Second Amendment advocates\">high-capacity magazines<\/a> under the U.S. or Washington Constitution has either rejected that challenge or been overruled. This law is constitutional,\u201d Ferguson said. <\/span><\/p>\n<p><span style=\"font-weight: 400\">Washington State Supreme Court Commissioner Michael Johnston sided with Ferguson, keeping the law in effect while the appeal continued. <\/span><\/p>\n<p><span style=\"font-weight: 400\">The magazine restriction was one of the many gun control policies adopted in recent years by Washington\u2019s Democratic-controlled legislature and Democratic Governor Jay Inslee, including a ban on the sale of AR-15s and similar rifles. <\/span><\/p>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A Washington judge deemed the state\u2019s ban on high-capacity gun magazines unconstitutional.
