Attorney General Bob Ferguson \u2062sued a gun store in 2023 for violating the ban.\u2063 The law prohibited the sale, import, manufacture, and distribution of magazines holding more \u200bthan 10 rounds. The\u200d ruling was based\u2062 on a United States Supreme Court decision changing how lower courts assess gun laws. The decision reflected a \u200cUS Supreme Court ruling \u200daltering how gun laws are evaluated in lower courts.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>A judge in <a href=\"http:\/\/Washingtonexaminer.com\/tag\/washington\/\" target=\"_blank\" rel=\"noopener\" title>Washington<\/a> ruled that the state\u2019s ban on high-capacity <a href=\"http:\/\/washingtonexaminer.com\/tag\/second-amendment\/\" target=\"_blank\" rel=\"noopener\" title>magazines<\/a> was <a href=\"https:\/\/www.king5.com\/article\/news\/politics\/state-politics\/washington-high-capacity-magazine-ban-unconstitutional-cowlitz-county-judge\/281-a6f257e4-8e37-47fe-971b-e775728b1e55\" target=\"_blank\" rel=\"noopener\" title>unconstitutional<\/a>.<\/p>\n<p>In 2023, Washington Attorney General Bob Ferguson filed a lawsuit against a <a href=\"https:\/\/www.king5.com\/article\/news\/local\/federal-way-gun-store-to-pay-3-million-illegally-selling-high-capacity-magazines\/281-d929f972-2dc7-4d9c-8da3-4ef9df65dcb7\" target=\"_blank\" rel=\"noopener\" title>gun store <\/a>for selling the magazines despite the ban. The law banned the sale, import, manufacturing, and distribution of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/one-of-the-nations-strictest-gun-control-laws-faces-new-legal-challenge\/\" title=\"One of the Nation's Strictest Gun Control Laws Faces New Legal Challenge\">ammunition magazines capable<\/a> of holding more than 10 rounds.<\/p>\n<p>Judge Gary Bashor said his ruling was \u201cconsistent with the Nation\u2019s historical tradition of firearm regulation,\u201d referring to a 2022 United States Supreme Court ruling. That ruling changed how lower courts ruled on gun laws, stating they can no longer consider if laws serve the public interest for things such as public safety.<\/p>\n<p>\u201cThere was no appetite to limit gun rights by the Founders. Though the specific technology available today may not have been envisioned, the Founders expected technological advancements,\u201d Bashor wrote. \u201cThe result is few, if any, historical analogue laws by which a state can justify a modern firearms regulation.\u201d<\/p>\n<p>Ferguson disagreed with Bashor\u2019s ruling. <\/p>\n<p>\u201cEvery court in Washington and across the country to consider challenges to a ban on the sale of high-capacity magazines under the U.S. or Washington Constitution has either rejected that challenge or been overruled,\u201d Ferguson wrote.<\/p>\n<p>However, the law still <a href=\"https:\/\/www.seattletimes.com\/seattle-news\/politics\/was-ban-on-high-capacity-gun-magazines-ruled-unconstitutional\/\" target=\"_blank\" rel=\"noopener\" title>stands<\/a>, as the Washington State Attorney General\u2019s Office filed an emergency stay, which was approved by the Washington Supreme Court. Purchasing high-capacity magazines will still be illegal statewide.<\/p>\n<p>\u201cThe debatable nature of the factual and legal issues raised in this case, and the public safety issues concerning the proliferation of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/colorado-judge-strikes-down-boulders-ar-15-ban\/\" title=\"Colorado Judge Strikes Down Boulder\u2019s AR-15 Ban\u00a0\">large capacity magazines<\/a>,\u201d\u00a0said Michael Johnston, the Washington Supreme Court commissioner. <\/p>\n<p><a href=\"http:\/\/washingtonexaminer.com\/\" target=\"_blank\" rel=\"noopener\" title><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p>In the ruling, Bashor referenced the 2007 Virginia Tech shooting, which left 32 people dead.
