Enacted in\u2062 1864, the \u200dlaw essentially bans \u2063abortion from conception. This \u200bdecision reaffirms the state\u2019s position on \u200babortion legislation, supporting the protection of unborn \u200blives in Arizona. \u2063The \u200drecent decision by the \u200bArizona Supreme Court\u200b upholding a law\u200b that penalizes \u200dabortion\u200d providers with up to five years of imprisonment, except in cases to protect the mother&#8217;s\u200b life, reinforces Arizona\u2019s strong stance on \u2064abortion restrictions enacted\u200b since 1864. This position\u2064 reflects the state&#8217;s commitment to safeguarding \u2063the lives \u200cof the unborn.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<div>\n<figure>\n<p>         <span>Image Credit<\/span>FDRLST\/Canva       <\/p>\n<\/figure><\/div>\n<p>The Arizona Supreme Court upheld <a href=\"https:\/\/www.azleg.gov\/ars\/13\/03603.htm\">a law<\/a> on Tuesday that imposes imprisonment of up to five years on anyone who executes a surgical or chemical abortion in the state, except to save the life of the child\u2019s mother.<\/p>\n<p>The law, first enacted in 1864, effectively outlaws abortion beginning at conception except to save the mother. It was put on hold after the Supreme Court\u2019s 1973 <em>Roe v. Wade<\/em> ruling but became the center of attention again shortly after <em>Dobbs v. Jackson<\/em>.<\/p>\n<p>The same year the Supreme Court issued its landmark decision tossing<em> Roe<\/em>, the Arizona legislature and then-Gov. Doug Ducey worked together to pass a law <a href=\"https:\/\/casetext.com\/statute\/arizona-revised-statutes\/title-36-public-health-and-safety\/chapter-23-protection-of-fetus-or-embryo\/article-3-gestational-limit-on-abortion\/section-36-2322-gestational-limit-on-abortion-medical-emergency-exception-physician-reports-confidentiality\" target=\"_blank\" rel=\"noreferrer noopener\">allowing abortions up to 15 weeks gestation<\/a> but noted it <a href=\"https:\/\/www.abc15.com\/news\/state\/arizona-supreme-court-rules-to-ban-nearly-all-abortions-reverting-back-to-penal-code\" target=\"_blank\" rel=\"noreferrer noopener\">would not supersede the previous law. <\/a><\/p>\n<p>The Arizona Court of Appeals claimed in a ruling later that year that, despite both laws\u2019 strict limits on abortion, a <a href=\"https:\/\/www.cnn.com\/2024\/04\/08\/us\/arizona-supreme-court-abortion-access-tuesday\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">\u201charmonized\u201d<\/a> version allowed for abortion through 15 weeks \u201cwhen provided by licensed physicians in compliance with the state\u2019s other laws and regulations.\u201d<\/p>\n<p>The Arizona Supreme Court, however, found on Tuesday that \u201cthe legislature has demonstrated its consistent design to restrict <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/becerra-tells-congress-this-individual-never-sued-any-nuns-despite-californias-small-sisters-of-the-indegent-lawsuit\/\" title=\"Becerra Tells Congress This individual \u2018Never Sued Any Nuns\u2019 Despite California\u2019s Small Sisters Of THE INDEGENT Lawsuit\">elective abortion<\/a> to the degree permitted by the Supremacy Clause and an unwavering intent since 1864 to proscribe elective abortions absent a federal constitutional right\u2014precisely what it intended and accomplished.\u201d<\/p>\n<p>\u201cTo date, our legislature has never affirmatively created a right to, or independently authorized, elective abortion. We defer, as we are constitutionally obligated to do, to the legislature\u2019s judgment, which is accountable to, and thus reflects, the mutable will of our citizens,\u201d the <a href=\"https:\/\/adfmedialegalfiles.blob.core.windows.net\/files\/MayesAZSupremeCourtOpinion.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">court\u2019s opinion<\/a> states. <\/p>\n<p>Alliance Defending Freedom, which represented Dr. Eric Hazelrigg, the obstetrician and medical director of Choices Pregnancy Center in Arizona who petitioned the Supreme Court over the law, celebrated the ruling as a win for the \u201clives of countless, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/planned-parenthood-melts-down-over-slew-of-pro-life-wins-across-the-country\/\" title=\"Planned Parenthood Melts Down over Slew of Pro-Life Wins Across the Country\">innocent unborn children<\/a>.\u201d<\/p>\n<p>\u201cLife is a human right, and today\u2019s decision allows the state to respect that right and fully protect life again\u2014just as the legislature intended,\u201d ADF Senior Counsel Jake Warner said in a statement. \u201cLife begins at conception. At just six weeks, unborn babies\u2019 hearts begin to beat. At eight weeks, they have fingers and toes. And at 10 weeks, their unique fingerprints begin to form. Arizona\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/scotus-to-hear-appeal-over-ky-abortion-law\/\" title=\"SCOTUS to hear appeal over Ky. abortion law\">pro-life law<\/a> has protected unborn children for over 100 years, and the people of Arizona, through their elected representatives, have repeatedly affirmed that law, including as recently as 2022.\u201d<\/p>\n<p>Arizona Attorney General Kris Mayes claimed she would refuse to enforce it on any \u201cwoman or doctor,\u201d but Warner said county prosecutors could. Tuesday\u2019s decision is a decisive victory for the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/covid-has-killed-her-hundreds-of-thousands-but-abortion-has-killed-her-tens-of-millions\/\" title=\"COVID Has Killed Her Hundreds of Thousands, But Abortion Has Killed Her Tens of Millions\">pro-life movement<\/a>, but the fight over abortion in Arizona isn\u2019t over. <\/p>\n<p>Not only do abortion giants in the Grand Canyon State have 14 days until the ruling becomes enforceable to sue over the law, but abortion activists are leading a ballot initiative that, if passed November 5, would effectively enshrine unlimited abortion through all nine months of pregnancy in the state constitution. Already, Arizona for Abortion Access <a href=\"https:\/\/arizonaforabortionaccess.org\/arizona-abortion-rights-amendment-backers-says-theyve-gathered-signatures-needed-for-2024-ballot\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> it received at least 100,000 ballot signatures more than the verified 383,923 required by the July 2024 deadline. <\/p>\n<p>The proposed amendment, which will likely be on the ballot in the next election, uses vague language and undefined terms that allow for on-demand abortions for anyone subjectively deemed at risk by a medical professional. It would also bar the state from punishing abortionists, like the recently upheld law requires, and <a href=\"https:\/\/www.itgoestoofar.com\/_files\/ugd\/e4035e_a3a148f78f9e43a5a52fbc2509aece16.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">\u201copens the door to taxpayer funding of abortion.\u201d<\/a><\/p>\n<p>\u201cWe\u2019re hopeful that this decision encourages voters to affirm life,\u201d Warner when asked about the ballot initiative during a Tuesday press conference.<\/p>\n<hr>\n<p>      Jordan Boyd is a staff writer at The Federalist and co-producer of The Federalist Radio Hour.
