The settlement awaits approval \u200cfrom the U.S. District\u200b Court for the Northern District of Ohio. It aims to address personal injury\u200b and \u2063property damage claims within a specific \u200bradius of the incident. Norfolk \u200cSouthern has \u2063agreed to a $600 million \u200dsettlement in a class action\u200d lawsuit\u200c related \u2063to a toxic train derailment near East Palestine, Ohio. The settlement, which involves \u200cseveral toxic \u2063chemicals, is awaiting approval \u2064from \u200dthe U.S.\u2062 District \u200dCourt for the Northern District of Ohio. Its primary objective is to\u2062 handle personal injury and property damage\u2062 claims \u2064within a \u2064defined area surrounding \u200bthe accident.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Norfolk Southern announced on Tuesday that it reached a $600 million <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/settlements\" target=\"_blank\" rel=\"noopener\" title=\"settlement\">settlement<\/a> in a class action lawsuit over the toxic train <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2843271\/cause-east-palestine-train-derailment-released-june-hearing\/\" target=\"_blank\" rel=\"noopener\" title=\"settlement\">derailment<\/a> near East Palestine, <a href=\"https:\/\/washingtonexaminer.com\/tag\/ohio\/\" target=\"_blank\" rel=\"noopener\" title=\"Ohio\">Ohio<\/a>, last year.<\/p>\n<p>The company announced the settlement had been agreed to in principle and still required approval from the U.S. District Court for the Northern District of Ohio. The lawsuit in district court was stayed pending approval of the settlement, according to a court order on Tuesday.<\/p>\n<p>The February 2023 derailment involved a train that was carrying 20 cars with <a href=\"https:\/\/www.washingtonexaminer.com\/policy\/energy-environment\/what-to-know-five-toxic-chemicals-ohio-train-derailment\" target=\"_blank\" rel=\"noreferrer noopener\">at least five toxic chemicals<\/a>, including vinyl chloride, which has been linked to liver damage and a rare form of liver cancer. Eleven of those cars derailed. Norfolk Southern said the agreement would resolve class action claims within a 20-mile radius of the derailment and personal injury claims of those within a 10-mile radius of the derailment for those who participate in the settlement.<\/p>\n<p>\u201cThe agreement is designed to provide finality and flexibility for settlement class members.\u00a0Individuals and businesses will be able to use compensation from the settlement in any manner they see fit to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/norfolk-southern-announces-600-million-settlement-with-east-palestine-residents-over-train-derailment\/\" title=\"Norfolk Southern reaches 0 million settlement with East Palestine residents for train derailment\">address potential adverse impacts<\/a> from the derailment. This could include healthcare needs and medical monitoring, property restoration and diminution, and compensation for any net business loss,\u201d the company said in a press release.<\/p>\n<p>\u201cIn addition, individuals within 10 miles of the derailment may, at their discretion, choose to receive additional compensation for any past, current, or future personal injury from the derailment,\u201d the release continued.<\/p>\n<p>The company also said the settlement \u201cdoes not include or constitute any admission of liability, wrongdoing, or fault.\u201d <\/p>\n<p>The case, which was originally filed in February 2023, was allowed to proceed last month despite Norfolk Southern\u2019s bid to have it dismissed, arguing it was protected under federal law.<\/p>\n<p>The aftermath of the derailment, including its impact on the small village of East Palestine, made national headlines. Cleanup of the derailment is expected to be completed later this year, and the National Transportation Safety Board said earlier this year it plans to announce the cause of the derailment during a hearing in June.<\/p>\n<p>The East Palestine derailment sparked a renewed push for federal action on freight safety measures and prompted Ohio\u2019s congressional delegation to introduce new <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/manchin-unloads-on-democrats-in-highlighting-problems-with-america-under-bidens-leadership\/\" title=\"Manchin Unloads On Democrats In Highlighting Problems With America Under Biden\u2019s Leadership\">bipartisan rail safety legislation<\/a>.<\/p>\n<p>Last week, the Transportation Department finalized a new rule requiring all major freight railroads to maintain a minimum crew of two people per train, a measure long pushed for by rail unions and one that Transportation Secretary Pete Buttigieg described as \u201clong overdue.\u201d<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/a><\/strong><\/p>\n<p>Sen.
