Here are recent instances where Smith\u2019s legal actions addressed the court and the \u2062public.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Special counsel <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/jack-smith\/\" target=\"_blank\" rel=\"noopener\" title=\"Jack Smith\">Jack Smith<\/a> is prosecuting former President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\" target=\"_blank\" rel=\"noopener\" title=\"Jack Smith\">Donald Trump<\/a> on various charges in two cases before <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/justice\" target=\"_blank\" rel=\"noopener\" title>federal courts,<\/a> but several times, he has made his case to the public rather than just the court.<\/p>\n<p>Smith is leading cases against Trump on the alleged mishandling of classified documents (in a Florida federal court) and on alleged attempts to overturn the 2020 election (in a Washington, D.C., federal court). As the two cases continue to press forward in tandem with the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wall-st-kicks-off-2024-on-a-dull-note-as-yields-rise-apple-dips\/\" title=\"Wall Street starts 2024 on a lackluster note with rising yields and Apple's decline\">looming presidential election<\/a>, here are four recent times Smith\u2019s filings have been a message to the court and the public.<\/p>\n<h2>April 8, 2024: \u2018Framers never endorsed criminal immunity\u2019<\/h2>\n<p>Smith\u2019s Monday <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2958739\/jack-smith-tells-supreme-court-keep-trump-charges-framers-never-endorsed-criminal-immunity\/\" target=\"_blank\" rel=\"noopener\" title=\"filing\">filing<\/a> to the Supreme Court, for the case in which Trump is claiming that he has presidential immunity against Smith\u2019s 2020 election subversion case, invoked the framers of the Constitution to make his case for why he should be allowed to prosecute Trump.<\/p>\n<p>\u201cThe Framers never endorsed criminal immunity for a former President, and all Presidents from the Founding to the modern era have known that after leaving office they <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/jack-smith-tells-supreme-court-to-keep-trump-charges-framers-never-endorsed-criminal-immunity\/\" title=\"Jack Smith urges Supreme Court to proceed with Trump charges, emphasizing that the Founding Fathers never supported criminal immunity\">faced potential criminal liability<\/a> for official acts,\u201d Smith told the Supreme Court in a lengthy filing.<\/p>\n<p>He railed at Trump\u2019s claims, which will have oral arguments before the court later this month, calling them a \u201cradical suggestion.\u201d<\/p>\n<p>\u201cThat radical suggestion, which would free the President from virtually all criminal law \u2014 even crimes such as bribery, murder, treason, and sedition \u2014 is unfounded,\u201d Smith wrote in the filing.<\/p>\n<h2>April 2, 2024: Rebukes judge\u2019s questions based on \u2018fundamentally flawed legal premise\u2019<\/h2>\n<p>Trump has been criticized for taking shots at the district court judge in the 2020 election subversion case, but Smith\u2019s filing in the classified documents case last week was a fiery rebuke to Judge Aileen Cannon\u2019s directives for hypothetical jury instructions.<\/p>\n<p>Cannon had given both sides two scenarios with which to craft their proposed jury instructions, but Smith\u2019s <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/2951019\/trump-prosecutor-signals-appeal-in-classified-documents-case\/\" target=\"_blank\" rel=\"noopener\" title=\"filing\">filing<\/a> argued the scenarios were \u201cfundamentally flawed\u201d and said a jury getting instructions based on the scenarios \u201cwould distort the trial.\u201d<\/p>\n<p>\u201cBoth scenarios rest on an unstated and fundamentally flawed legal premise \u2014 namely, that the Presidential Records Act and in particular its distinction between \u2018personal\u2019 and \u2018Presidential\u2019 records, determines whether a former President is \u2018authorized,\u2019 under the Espionage Act, to possess highly classified documents and store them in an unsecure facility,\u201d the special counsel\u2019s team wrote in the filing.<\/p>\n<p>He also argued that they \u201cmust be provided with an opportunity to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-prosecutor-signals-appeal-in-classified-documents-case-rebukes-judge\/\" title=\"Prosecutor in Trump case plans to appeal regarding classified documents, criticizes judge\">seek prompt appellate review<\/a>,\u201d indicating he intends to appeal Cannon\u2019s order.<\/p>\n<h2>March 7, 2024: Argues Trump\u2019s \u2018frivolous claim\u2019 of immunity is nothing more than a stall tactic<\/h2>\n<p>In a series of <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2909142\/jack-smith-files-responses-against-trump-dismiss-documents-case\/\" target=\"_blank\" rel=\"noopener\" title=\"filings\">filings<\/a> ahead of a hearing in the classified documents case, Smith addressed various claims made by Trump, including an argument that Smith didn\u2019t have the legal authority or funding to prosecute the former president. <\/p>\n<p>Besides addressing Trump\u2019s accusations, Smith also tore into the former president\u2019s attempts to claim presidential immunity, a \u201cfrivolous claim,\u201d according to the special counsel. <\/p>\n<p>\u201cThat frivolous claim is offered for one transparent purpose \u2014 to delay the trial \u2014 and it fails for two independent reasons,\u201d prosecutors <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.flsd.648652\/gov.uscourts.flsd.648652.376.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a> in a 27-page filing.<\/p>\n<p>\u201cTrump\u2019s immunity claim here is so wholly without merit that it is difficult to understand it except as part of a strategic effort for delay,\u201d they wrote, adding that \u201ca groundless appeal should not be permitted to have that effect\u201d of delay.<\/p>\n<h2>Feb. 26, 2024: Trump and Biden classified document cases are not \u2018remotely similar\u2019<\/h2>\n<p>After special counsel Robert Hur declined to prosecute President Joe Biden on the alleged mishandling of classified documents, citing Biden\u2019s purportedly poor memory in the lengthy report, Trump\u2019s lawyers attempted to make connections between Biden\u2019s classified documents case and Trump\u2019s case.<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/a><\/strong><\/p>\n<p>Smith\u2019s team, in a <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2888383\/jack-smith-rips-comparisons-between-trump-biden-classified-documents-scandals\/\" target=\"_blank\" rel=\"noopener\" title=\"filing\">filing<\/a>, rejected these claims, arguing that the two are not even \u201cremotely similar.\u201d<\/p>\n<p>\u201cMost notably, Trump, unlike Biden, is alleged to have engaged in extensive and repeated efforts to obstruct justice and thwart the return of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/justice-department-releases-redacted-trump-mar-a-lago-warrant\/\" title=\"Justice Department Releases Redacted Trump Mar-a-Lago Warrant\">documents bearing classification markings<\/a>,\u201d Smith wrote. \u201cAnd the evidence concerning the two men\u2019s intent \u2014 whether they knowingly possessed and willfully retained
