The appeals court will soon \u200cdecide on the appeal.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Fulton County District Attorney <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/fani-willis\" target=\"_blank\" rel=\"noreferrer noopener\">Fani Willis<\/a> on Monday called for an appeals court to refuse to consider former President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">Donald Trump<\/a>\u2018s appeal of his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/unanimous-supreme-court-backs-catholic-adoption-agency-in-dispute-over-gay-foster-parents\/\" title=\"Unanimous Supreme Court Backs Catholic Adoption Agency in Dispute Over Gay Foster Parents\">trial judge\u2019<\/a>s decision not to disqualify her from the case, according to filing Monday afternoon.<\/p>\n<p>Willis, who is prosecuting Trump and 13 remaining co-defendants in a sweeping <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/georgia\" target=\"_blank\" rel=\"noreferrer noopener\">Georgia<\/a> racketeering case alleging they conspired to overturn the 2020 election, argued in a court filing that there is no further review needed after Superior Court Judge Scott McAfee did not remove her from the case.<\/p>\n<figure><figcaption>Fulton County District Attorney Fani Willis looks on during a hearing on the Georgia election interference case, Friday, March, 1, 2024, in Atlanta. (AP Photo\/Alex Slitz, Pool)<\/figcaption><\/figure>\n<p>The district attorney argued the trial court already held an evidentiary hearing which \u201cspanned several days\u201d and ultimately failed to establish \u201cany actual conflict of interest and declined to dismiss the indictment.\u201d<\/p>\n<p>\u201cThe trial court also permitted the prosecution to proceed under the direction of the Fulton County District Attorney\u2019s Office upon the withdrawal of Special Assistant District Attorney Nathan Wade,\u201d attorneys from Willis\u2019s office wrote, referring to McAfee\u2019s ultimatum that either Willis or Wade had to step aside after it became apparent that the pair engaged in a romantic relationship.<\/p>\n<p>Last month, McAfee granted Trump\u2019s legal team permission to bring the case to the Georgia Court of Appeals. The former president\u2019s lawyers argued to the appeals court that the evidence brought up during the previous trial court hearing revealed Willis and Wade\u2019s relationship did create an \u201cappearance of impropriety in this case that cast a pall over these entire proceedings\u201d and that the decision to allow Willis to continue \u201cis plain legal error requiring reversal.\u201d<\/p>\n<p>After Trump filed his appeal of McAfee\u2019s decision on March 29, it commenced a 45-day window for the appeals court to decide whether to grant the appeal. Defendants must prove to the court that the order they\u2019re appealing \u201cappears to be dispositive of the case\u201d was made erroneously and could result in \u201csubstantial error at trial or affect the rights of the appealing party.\u201d<\/p>\n<p>If the appeals court were to take up the appeal of the decision not to remove Willis, it could help Trump achieve his goal of attempting to delay trials in his four criminal cases before the 2024 election as he seeks another four years in the Oval Office.<\/p>\n<p>Willis\u2019s filing on Monday coincided with a request by Trump and his remaining 13 co-defendants to appeal a ruling by McAfee not to dismiss the case on First Amendment grounds, another potential avenue for Trump to delay his trial if the effort to remove the lead prosecutor ultimately fails.<\/p>\n<p>\u201cPresident Trump and the other unjustly accused defendants have jointly filed a motion requesting the Court to grant a certificate of immediate review of its Order denying their pretrial First Amendment challenges,\u201d <a href=\"https:\/\/www.atlantanewsfirst.com\/2023\/08\/24\/trump-replaces-top-georgia-lawyer-ahead-surrender-fulton-county\/\" target=\"_blank\" rel=\"noreferrer noopener\">Steve Sadow<\/a>, one of Trump\u2019s Georgia attorneys, wrote in a statement.<\/p>\n<p>McAfee wrote last week that the defense had not shown any \u201cauthority that the speech and conduct alleged is <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/rnc-fires-back-at-trump-says-it-has-every-right-to-use-his-name\/\" title=\"RNC Fires Back at Trump, Says It Has \u2018Every Right\u2019 to Use His Name\">protected political speech<\/a>.\u201d <\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/a><\/strong><\/p>\n<p>\u201cAfter interpreting the indictment\u2019s language liberally in favor of the State as required at this pretrial stage, the Court finds that the Defendants\u2019 expressions and speech are alleged to have been made in furtherance of criminal activity and constitute false statements knowingly and willfully made in matters within a government agency\u2019s jurisdiction which threaten to deceive and harm the government,\u201d the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-refuses-cnns-motion-to-dismiss-dershowitz-defamation-lawsuit\/\" title=\"Judge Refuses CNN's Motion to Dismiss Dershowitz Defamation Lawsuit\">judge wrote<\/a> in his decision last week.<\/p>\n<p>McAfee will first have to grant defendants\u2019 permission to appeal his denial to dismiss the charges on First Amendment grounds.<\/p>\n<\/p><\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Fulton County District Attorney Fani Willis urged an appeals court to reject former President Donald Trump&#8217;s appeal regarding her disqualification from his case.
