In New York, a judge denied Trump&#8217;s request to\u200b delay his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-hush-money-witness-michael-cohen-grilled-for-perjury-judge\/\" title=\"Judge questions Michael Cohen about potential perjury regarding Trump hush money\">hush \u2063money trial<\/a>, citing lack of previous attempts to claim presidential immunity. In \u2064Georgia, a judge rejected Trump&#8217;s First Amendment defense in a RICO case, \u200dhighlighting that certain statements were allegedly part of criminal activities.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Former President <a href=\"http:\/\/washingtonexaminer.com\/tag\/donald-trump\" target=\"_blank\" rel=\"noopener\" title>Donald Trump<\/a> lost three <a href=\"http:\/\/washingtonexaminer.com\/tag\/court\" target=\"_blank\" rel=\"noopener\" title><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/state-agency-probes-cuomos-ethics-violations-in-5m-book-deal\/\" title=\"State agency probes Cuomo\u2019s ethics violations in M book deal\">major legal challenges<\/a><\/a> in the past week, including his efforts to dismiss a racketeering case on <a href=\"http:\/\/washingtonexaminer.com\/tag\/first-amendment\" target=\"_blank\" rel=\"noopener\" title>First Amendment grounds<\/a>.<\/p>\n<p>Here is a look at the rulings in three separate cases this week in Georgia, Florida, and New York.<\/p>\n<h2><strong>New York judge denies Trump\u2019s attempt to delay hush money trial<\/strong><\/h2>\n<p><a href=\"http:\/\/washingtonexaminer.com\/tag\/new-york\" target=\"_blank\" rel=\"noopener\" title>New York<\/a> Judge Juan Merchan denied the former president\u2019s attempt to <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/2955735\/trump-hush-money-judge-rejects-last-ditch-subpoena-but-weighs-motion-to-recuse\/\" target=\"_blank\" rel=\"noopener\" title>delay his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/donald-trumps-criminal-hush-money-trial-set-for-march-25\/\" title=\"Trump's hush money trial scheduled for March 25\">criminal hush money trial<\/a> <\/a>on Wednesday, after Trump claimed he was protected under presidential immunity. <\/p>\n<p>Merchan said that Trump had plenty of opportunity before March to claim presidential immunity in the case. Trump asked Merchan to delay the trial until after the Supreme Court rules on his immunity claim, but the trial is slated to begin April 15, and the Supreme Court won\u2019t hear arguments in the immunity case until April 25. <\/p>\n<p>The case, which is the only criminal trial that could have a verdict prior to the 2024 elections this November, centers on claims that Trump allegedly paid hush money to former porn star Stormy Daniels in 2016. <\/p>\n<p>He has been charged with 34 felony counts of falsifying business records in the first degree, and has pleaded \u201cnot guilty,\u201d to all counts.<\/p>\n<h2><strong>Georgia judge rejects Trump\u2019s attempt to dismiss RICO case through a First Amendment challenge<\/strong><\/h2>\n<p><a href=\"http:\/\/washingtonexaminer.com\/tag\/georgia\" target=\"_blank\" rel=\"noopener\" title>Georgia<\/a> judge Scott McAfee on Thursday denied Trump\u2019s claim that his public statements and efforts to overturn the results of the 2020 presidential election were protected under his right to free speech. <\/p>\n<p>McAfee said that Trump was <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/2953448\/judge-denies-trumps-bid-to-dismiss-georgia-rico-case-on-free-speech-grounds\/\" target=\"_blank\" rel=\"noopener\" title>not protected by the First Amendment<\/a> because the indictments claim the statements were made in \u201cfurtherance of criminal activity.\u201d <\/p>\n<p>\u201cIn other words, the law does not <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-rules-against-trump-attempt-to-have-georgia-election-case-thrown-out-over-first-amendment\/\" title=\"Court rejects Trump's bid to dismiss Georgia election lawsuit based on First Amendment\">insulate speech allegedly made<\/a> during fraudulent or criminal conduct from prosecution under the guise of petitioning the government,\u201d McAfee <a href=\"https:\/\/www.axios.com\/2024\/04\/04\/trump-case-georgia-charged-free-speech?utm_source=newsletter&#038;utm_medium=email&#038;utm_campaign=newsletter_axiossneakpeek&#038;stream=top\" target=\"_blank\" rel=\"noopener\" title>wrote<\/a> in the ruling. \u201cThe defense has not presented, nor is the Court able to find, any authority that the speech and conduct alleged is protected political speech.\u201d<\/p>\n<p>No court date has been set in the racketeering case so far, but prosecutors have pushed for the trial to begin in August. Fourteen other people have also been charged in the wide-reaching RICO case. <\/p>\n<p>The ruling comes after McAfee dismissed three charges against the former president, and six charges in the case total last month. But Trump still faces six charges in the Georgia case.<\/p>\n<h2><strong>Florida judge declines Trump\u2019s latest bid to dismiss classified docs case <\/strong><\/h2>\n<p>Florida judge Aileen Cannon ruled that Trump<a href=\"https:\/\/www.washingtonexaminer.com\/news\/2953911\/judge-wont-dismiss-trump-documents-case-rebukes-jack-smith-demand-as-unjust\/\" target=\"_blank\" rel=\"noopener\" title> was not protected<\/a> under the <a href=\"https:\/\/www.axios.com\/2024\/04\/04\/judge-reject-trump-dismiss-classified-documents?utm_source=newsletter&#038;utm_medium=email&#038;utm_campaign=newsletter_axiossneakpeek&#038;stream=top\" target=\"_blank\" rel=\"noopener\" title>Presidential Records Act<\/a> on Thursday, marking the second time she rejected Trump\u2019s attempt to dismiss the case.<\/p>\n<p>Trump\u2019s team claimed that he had the authority as president to designate certain presidential documents, such as the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/brad-slager-did-mark-zuckerberg-prove-the-fbi-created-the-russian-disinfo-narrative-on-hunters-laptop\/\" title=\"Brad Slager: Did Mark Zuckerberg Prove the FBI Created the \u201cRussian Disinfo\u201d Narrative on Hunter\u2019s Laptop?\">classified documents discovered<\/a> at his <a href=\"http:\/\/washingtonexaminer.com\/tag\/mar-a-lago\" target=\"_blank\" rel=\"noopener\" title>Mar-a-Lago<\/a> resort, as personal even after he left office. <\/p>\n<p>Presidents are usually required to hand over presidential records to the National Archives at the end of their term, but they can keep personal documents that are unrelated to their duties as commander in chief. <\/p>\n<p><strong><a href=\"http:\/\/washingtonexaminer.com\" target=\"_blank\" rel=\"noopener\" title>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/a><\/strong><\/p>\n<p>Cannon has indicated that she would take the PRA into account in the case, directing Trump\u2019s legal team and the prosecution to prepare jury instructions with the PRA in mind. But she claimed that the current argument Trump filed earlier this week is not grounds for dismissal of the case. <\/p>\n<p>The Florida trial was originally expected to begin in May, but there will likely be a delay in the proceedings.
