In this case, Judicial Watch, on behalf of Jan. 6 protester Ashli Babbitt&#8217;s family, alleges that the Justice Department is unfairly associating\u200c her with deaths during the Capitol riots. They aim to retain the case in San Diego, suggesting the Justice Department&#8217;s\u2063 venue change request is biased. The lawsuit primarily concerns Babbitt&#8217;s demise at\u200d the hands \u2064of\u200c a Capitol Police officer.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The legal watchdog group suing the federal government for the \u201cwrongful\u201d death of Jan. 6 protester <a href=\"https:\/\/www.washingtonexaminer.com\/news\/washington-secrets\/2710404\/shes-dead-shes-dead-jan-6-video-has-new-angle-on-ashli-babbitt-shooting\/\" target=\"_blank\" rel=\"noopener\" title>Ashli Babbitt<\/a> has charged that the Biden administration is acting \u201cas if\u201d she caused other deaths related to the election riots at the Capitol.<\/p>\n<p>In a new court filing, Washington-based <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2835513\/fbi-charged-with-jan-6-cover-up-in-ashli-babbitt-shooting-case\/\" target=\"_blank\" rel=\"noopener\" title>Judicial Watch<\/a> said that the Justice Department has responded to its <a href=\"https:\/\/www.washingtonexaminer.com\/news\/washington-secrets\/2711680\/30-million-suit-filed-over-jan-6-protester-ashli-babbitts-death\/\" target=\"_blank\" rel=\"noopener\" title>$30 million suit<\/a> by attacking Babbitt, the 35-year-old Air Force veteran killed by a U.S. Capitol Police officer as she entered the House Speaker\u2019s Lobby just feet from the House floor at the height of the riot Jan. 6, 2021.<\/p>\n<p><a href=\"https:\/\/www.judicialwatch.org\/\" target=\"_blank\" rel=\"noopener\" title>Judicial Watch<\/a> said that in trying to move the case from Babbitt\u2019s home in San Diego, California, to Washington, D.C., Justice is trying to find a friendlier court and jury and tie her to the government\u2019s claim that 140 police were injured in the brawls and three later died from their involvement.<\/p>\n<p>In a 20-page filing, Judicial Watch said:<\/p>\n<p><em>\u201cDefendant\u2019s position [to transfer venue] illustrates and underscores the prejudice and injustice that Plaintiffs would face if venue were transferred to the District of Columbia. Defendant mentions 80 Capitol Police officers and 60 Metropolitan Police officers that were injured and connects the deaths of three officers to the events on that day, thus connecting Ashli Babbitt to these deaths and other injuries, as if she caused them. The request for a change in venue is clearly influenced by defendant\u2019s strongest motivation for changing venue, which is to select the forum where it feels it would receive a favorable process and outcome based on adversity against January 6 participants. By its motion, defendant hopes to unfairly and unjustly connect Ashli Babbitt to violence, injuries, and deaths for which she is blameless and connect her by association to thousands of individuals convicted of misdemeanors and felonies for which she was never charged and is unable to present a defense due to the lawless actions of one of defendant\u2019s employees in shooting and killing her.\u201d<\/em><\/p>\n<p>Judicial Watch, which filed the case on behalf of Babbitt\u2019s husband and family, argued that the case should stay in <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/San-Diego\" target=\"_blank\" rel=\"noopener\" title>San Diego<\/a>.<\/p>\n<p>It made two key points. First, it said that the law should favor those filing suits and not bow to claims of inconvenience made by Justice.<\/p>\n<p>Second, it said that Washington judges and juries are biased against anybody involved in the riots. Several key defense lawyers have <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/democrats-argue-at-impeachment-trial-that-capitol-breach-wasnt-sparked-by-one-speech\/\" title=\"Democrats Argue at Impeachment Trial That Capitol Breach Wasn\u2019t Sparked by \u2018One Speech\u2019\">made similar claims<\/a>.
