The judge rejected the subpoena,\u200c citing it\u2064 as too broad,\u2064 and is reviewing the recusal motion.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The judge presiding over <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">Donald Trump<\/a>\u2018s hush money case declined the former president\u2019s bid to subpoena NBCUniversal over a documentary it created about porn star <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/stormy-daniels\/\" target=\"_blank\" rel=\"noopener\" title=\"Stormy Daniels\">Stormy Daniels<\/a> but granted consideration of Trump\u2019s <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/2950086\/trump-attorneys-revive-push-for-new-york-judge-to-recuse-himself-in-hush-money-case\/\" target=\"_blank\" rel=\"noopener\" title=\"effort to replace him\">effort to replace him<\/a> on the case.<\/p>\n<p>A weekslong trial is approaching on April 15 over Trump\u2019s 34-count indictment for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/indicting-trump-will-usher-in-americas-banana-republic-stage\/\" title=\"Indicting Trump Will Usher In America\u2019s Banana-Republic Stage\">allegedly falsifying business records<\/a> in <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/new-york\/\" target=\"_blank\" rel=\"noreferrer noopener\">New York<\/a> to hide a hush money payment to Daniels to cover up an alleged years-old affair in the final days of his 2016 campaign. Trump accused NBCUniversal of colluding with Daniels and sought the subpoena for records associated with its production of <em>Stormy<\/em>, which it released last month on the network\u2019s streaming service, Peacock.<\/p>\n<p>In back-to-back movement on the courtroom docket, New York Supreme Court Justice Juan Merchan rejected Trump\u2019s subpoena effort but later granted the former president\u2019s bid to brief arguments on whether his daughter\u2019s role for a progressive consulting firm warrants his recusal from the case.<\/p>\n<figure><figcaption>Former President Donald Trump sits with his lawyer Susan Necheles before the start of a hearing at New York Criminal Court on Monday, March 25, 2024, in New York. (Brendan McDermid\/Pool Photo via AP)<\/figcaption><\/figure>\n<p>Merchan said Trump failed to show a \u201cclear and specific\u201d finding of relevant material necessary to subpoena the documentary records, according to his four-page decision on the subpoena.<\/p>\n<p>Trump\u2019s lawyers, led by Todd Blanche and Susan Necheles, said they were seeking information that would reveal \u201ccollusion between NBCU and Daniels relating to the release date of the documentary,\u201d as well as any information that could affect his trial, which is slated to begin with jury selection on April 15.<\/p>\n<p>NBCUniversal argued Trump had no \u201cright to approve the content of the Documentary or the timing of its release,\u201d according to a legal affirmation filed in the case from Erica Forstadt, senior vice president of production and development at the media company.<\/p>\n<p>Merchan found the subpoena was \u201cfar too broad\u201d and rejected it, in part on the basis that NBCUniversal is a media organization and that Trump failed to meet the burdens required by New York\u2019s Civil Rights Law to do so.<\/p>\n<p>\u201cBecause defendant\u2019s claims are purely speculative and unsupported, his subpoena and the demands therein are the very definition of a fishing expedition,\u201d Merchan wrote.<\/p>\n<figure><\/figure>\n<p>The recently released documentary tells the story of Daniels, whose real name is Stephanie Clifford, and how her life was changed in 2018 when she publicly claimed she\u2019d had an affair with Trump in 2006. Trump has pleaded not guilty to the charges and denies Daniels\u2019s affair allegations.<\/p>\n<p>Daniels is expected to testify in Trump\u2019s hush money trial, in addition to <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/michael-cohen\/\" target=\"_blank\" rel=\"noreferrer noopener\">Michael Cohen<\/a>, Trump\u2019s former attorney and fixer who a judge recently found <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/2930635\/trump-hush-money-witness-michael-cohen-perjury\/\" target=\"_blank\" rel=\"noopener\" title=\"likely committed perjury\">likely committed perjury<\/a> during a separate trial.<\/p>\n<p>The rejection comes as Trump has recently seen setbacks in Merchan\u2019s court over a gag order dispute prompted by Trump\u2019s criticism of his daughter Loren, who holds a leadership role with Authentic Campaigns. The firm has done work with multiple Democratic clients, including Rep. (AP Photo\/Seth Wenig)<\/figcaption><\/figure>\n<p>As a result of Trump raising awareness about the judge\u2019s daughter, the gag order was expanded to bar the former president from making insults and accusations about Merchan\u2019s family members and the relatives of Manhattan District Attorney Alvin Bragg, the elected Democrat who is leading the case.<\/p>\n<p>\u201cThe manner in which Authentic and Ms. Merchan are marketing the company, and making money, through expressions of animus toward President Trump has created a prohibited appearance of impropriety,\u201d Trump\u2019s lawyers wrote in a <a href=\"https:\/\/img1.wsimg.com\/blobby\/go\/5de1e0d7-8488-4b16-ac1c-207ae9668720\/downloads\/2024.04.03%20-%20DJT%20Recusal%20Motion%20-%20Brief.pdf?ver=1712345705474\" target=\"_blank\" rel=\"noopener\" title=\"motion\">motion<\/a> to recuse Merchan on April 3, which became visible on Friday afternoon after Merchan said he would allow briefing on the matter.<\/p>\n<p>Last year, Merchan denied Trump\u2019s original recusal motion that cited his daughter\u2019s employment and $35 in donations the judge made during the 2020 campaign cycle to the Biden campaign and two left-leaning groups.
