This ruling seeks to promote inclusivity in\u200d sports.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div data-td-block-uid=\"tdi_78\">\n<p>A federal judge on Thursday upheld New York Attorney General<a href=\"http:\/\/washingtonexaminer.com\/tag\/letitia%20james\"> <\/a><a href=\"https:\/\/www.washingtonexaminer.com\/news\/2914218\/new-york-lawmaker-letitia-james-trying-to-burn-down-justice-system\/\" target=\"_blank\" rel=\"noopener\" title>Letitia James\u2019s<\/a> challenge of a so-called ban on <a href=\"http:\/\/washingtonexaminer.com\/tag\/transgender\" target=\"_blank\" rel=\"noopener\" title>transgender athletes<\/a> in Nassau County. The ruling comes after an earlier executive order from County Executive Bruce Blakeman that required participants to play on teams based on an individual\u2019s birth sex, not gender identity.<\/p>\n<p>Blakeman\u2019s executive order, which went into effect last month, required all players on sports teams to submit their original biological sex at birth should they compete in county facilities and parks. <a href=\"https:\/\/x.com\/NassauExec\/status\/1763623017622405409?s=20\">According<\/a> to Blakeman, the order was meant to prevent \u201cthe bullying of women and girls by transgender males who have many outlets to compete without putting the safety and security of females in danger.\u201d<\/p>\n<p>However, James challenged the order, issuing a cease-and-desist letter to Blakeman that threatened \u201cdecisive legal action\u201d should Blakeman not rescind the order. When Blakeman sued to block the cease-and-desist order, Eastern District of New York Judge Nusrat Jahan Choudhury ruled in James\u2019s favor, allowing her office to continue in its legal attempt to repeal the order.<\/p>\n<p>According to Choudhury, Blakeman failed to prove that biological women \u201cface an imminent threat of physical injury, discrimination, or exclusion from recognition, accolades, or college scholarships, or any other long-term benefit from any current or future athletic activities on Nassau County Parks property.\u201d Choudhury was skeptical that there was any evidence that the Nassau County executive could produce that would support his claim that James\u2019s cease-and-desist letter \u201cviolated the Fourteenth Amendment\u2019s Equal Protection Clause.\u201d<\/p>\n<p>The <em>Washington Examiner<\/em> reached out to James and Blakeman for comment.<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/\"><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p>Blakeman is also facing<a href=\"https:\/\/www.washingtonexaminer.com\/sports\/2934351\/new-york-county-ban-transgender-athletes-roller-derby\/\"> a lawsuit<\/a> from the American Civil Liberties Union on behalf of the Long Island Roller Rebels, a team in the city\u2019s female roller derby league. The Rebels claimed to be negatively affected by the ban. The team\u2019s next game in the county is slated for April 27.<\/p>\n<p>Blakeman\u2019s executive order had affected around 100 facilities in Nassau County. While other states have enacted so-called bans on transgender athletes, this is a rare case in New York.
