Democrats are questioning the treatment he\u2062 received\u200b at the Northwest Immigration and Customs Enforcement Processing Center. They raised concerns\u2064 about solitary confinement\u2063 and demanded better treatment\u2063 for detained\u2063 individuals.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><\/p>\n<div class=\"article-content\">\n<p>After he died last month in federal custody, Democrats are rallying around the death of an illegal alien who was convicted of murder more than two decades ago. Charles Leo Daniel, a Trinidad and Tobago citizen who illegally <a href=\"https:\/\/jsis.washington.edu\/humanrights\/2024\/03\/15\/nwdc-conditions-research-update-daniel-death-in-context\/\" target=\"_blank\" rel=\"noreferrer noopener\">overstayed his U.S. visa<\/a>, <a href=\"https:\/\/www.ice.gov\/news\/releases\/trinidad-and-tobago-national-ice-custody-dies-nwipc\" target=\"_blank\" rel=\"noreferrer noopener\">died due to unknown circumstances on March 7<\/a> in the Northwest\u00a0Immigration and Customs Enforcement (ICE) Processing\u00a0Center in Tacoma, Washington. <\/p>\n<p>Daniel was first jailed after he was convicted in 2003 of the brutal murder of his landlord roommate with a \u201cbloody butcher knife.\u201d <a href=\"https:\/\/casetext.com\/case\/state-v-daniel-41\" target=\"_blank\" rel=\"noreferrer noopener\">Court documents<\/a> say police arrived on the scene to find Daniel \u201ccovered in blood.\u201d <\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1254466909\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-9f4af1d11feb98c2ff76232d00bfc02c fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-9f4af1d11feb98c2ff76232d00bfc02c\"><\/div>\n<p>Daniel claimed self-defense but the court determined that \u201ctestimony to be lacking in credibility\u201d and \u201cfound the forensic evidence inconsistent with Daniel\u2019s account of how he had stabbed\u201d the victim, Raymond Lindsay. The court initially <a href=\"https:\/\/www.ice.gov\/news\/releases\/trinidad-and-tobago-national-ice-custody-dies-nwipc\">sentenced <\/a>Daniel to \u201c220 months prison and 24 to 48 months of community custody.\u201d A per curiam decision issued in 2007 affirmed that sentence after concluding that \u201cthe court did not misapply the law of self-defense.\u201d<\/p>\n<p>After an immigration judge ruled in favor of expelling Daniel from the country in 2020, Daniel was transferred into the custody of the Office of Enforcement and Removal Operations, where he died.  <\/p>\n<p>Shortly after his death, researchers at the University of Washington quickly alleged that the circumstances of Daniel\u2019s detention, which included \u201cthe second-longest stretch in solitary confinement of any person in ICE custody since 2018,\u201d caused him suffering and may have played a role in his death. The UW activists demand that Congress send \u201cwritten information requests of the agency\u2019s Congressional liaison.\u201d <\/p>\n<p>\u201cIf members of Washington\u2019s Congressional delegation have chosen not to make use of this tool to date, now is the time to start, in the interests of transparency, accountability, and supporting the leadership of Washington communities who are using every tool at our disposal in our effort to stop the abuse of our neighbors,\u201d the \u201cresearch update\u201d concludes.<\/p>\n<div class=\"fdrlst__b89e9-4d91fba221613735d22e141172068fd4 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-4d91fba221613735d22e141172068fd4\"><\/div>\n<p>A few weeks later, a <a href=\"https:\/\/www.murray.senate.gov\/wp-content\/uploads\/2024\/04\/letter_solitary_confinement_in_immigration_detention_32924.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">dozen Democrat Senators<\/a> sent a letter to Department of Homeland Security Secretary Alejandro Mayorkas and Patrick J. Lechleitner, the ICE official performing the duties of the director, on March 29 demanding an end to the \u201cmisuse of solitary confinement in immigration detention.\u201d<\/p>\n<p>Sens. Elizabeth Warren and Dick Durbin, two of the signees, also <a href=\"https:\/\/www.politico.com\/news\/2021\/04\/19\/capitol-riot-defendants-warren-483125\" target=\"_blank\" rel=\"noreferrer noopener\">spoke out against solitary confinement <\/a>for those convicted of crimes connected to the Jan. 6, 2021 Capitol riot. They did not, however, ever send a formal letter demanding better treatment for detained Americans than for illegal border crossers. <\/p>\n<p>Democrats\u2019 letter to ICE does not mention Daniel\u2019s name. It does, however, use the same language as UW to pressure ICE into reducing punishments for foreigners who break U.S. law and murder Americans. <\/p>\n<p>On March 21, Rep. Pramila Jayapal also released a <a href=\"https:\/\/jayapal.house.gov\/2024\/03\/21\/jayapal-statement-on-death-of-detainee-at-the-northwest-detention-center\/#:~:text=The%20vast%20majority%20of%20detained,offenses%20such%20as%20traffic%20violations.\">statement <\/a>scolding ICE for \u201coverreliance on detention\u201d and even suggested that \u201cnearly 67 percent of people detained in ICE custody have no criminal record and many more only have minor offenses such as traffic violations.\u201d While mentioning Daniel by name, she did not mention Daniel\u2019s criminal record atop his violation of U.S. immigration law. Instead, she offered sympathy to his family for the \u201cunacceptable tragedy.\u201d <\/p>\n<div class=\"fdrlst__b89e9-df6f0cbbc651def88625e8be298bc150 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-df6f0cbbc651def88625e8be298bc150\"><\/div>\n<p>\u201cFirst and foremost, my heart goes out to Mr. Daniel\u2019s family and loved ones. His death is an unacceptable tragedy and there must be accountability and a full investigation to understand exactly what happened at the Northwest Detention Center,\u201d she said. <\/p>\n<p>Democrats\u2019 attention to Daniel\u2019s death <a href=\"https:\/\/archive.is\/dsAwt\" target=\"_blank\" rel=\"noreferrer noopener\">received amplification<\/a> from The News Tribune. The pro-illegal migration group La Resistencia also saw their fact-free <a href=\"https:\/\/www.instagram.com\/p\/C5RVvfIP5Xc\/\">claims <\/a>of  <a href=\"https:\/\/www.thenewstribune.com\/news\/local\/article287121775.html\" target=\"_blank\" rel=\"noreferrer noopener\">\u201charassment\u201d and \u201cintimidation\u201d<\/a> amid protests outside of the Tacoma detention facility published in a positive light.<\/p>\n<figure class=\"wp-block-image size-full\"><\/figure>\n<p>Neither article mentioned Daniel\u2019s criminal history.<\/p>\n<\/p>\n<div class=\"fdrlst__b89e9-127dd18e356b785c084ab3760c6db778 fdrlst__b89e9-after-post-content\" id=\"fdrlst__b89e9-127dd18e356b785c084ab3760c6db778\"><\/div>\n<hr class=\"wp-block-separator\">    \t\t\t\t\t   \t\t\t\t\t\t\t\t\t<\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Democrats are showing support for the late Charles Leo Daniel, an illegal alien from Trinidad and Tobago convicted of murder, who passed away in federal custody on March 7 under unclear circumstances.
