The defense sought dismissal due to this mishap, but the judge ruled that the missing recordings were not \u200bdestroyed intentionally. The prosecution maintains that the lost interviews are not crucial evidence in the case. In the Delphi murder \u2064case involving Richard Allen, the judge decided \u200bnot to \u2063drop charges despite police mistakenly recording over interviews with key suspects. The defense requested dismissal citing this error, but the judge concluded the recordings were not deliberately destroyed. Prosecutors argue that the lost interviews\u2064 are not \u200cpivotal\u200b evidence in the case.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p>The special judge overseeing the case against Richard Allen won\u2019t dismiss the charges despite police recording over interviews defense attorneys said were with \u201ckey suspects,\u201d FOX 59 <a href=\"https:\/\/fox59.com\/news\/judge-wont-throw-out-delphi-murder-charges-over-deleted-interviews\/\">reported<\/a>.<\/p>\n<p>Allen has been charged with kidnapping and killing 3-year-old Abby Williams and 14-year-old Libby German, whose bodies were found off a hiking trail in Delphi, Indiana, back in 2017. His attorneys, Andrew Baldwin and Bradley Rozzi, argued that the charges should be dismissed because police recorded over interviews with two men the attorneys described as \u201ckey suspects.\u201d<\/p>\n<p>Carroll County Prosecutor Nicholas McLeland <a href=\"https:\/\/www.dailywire.com\/news\/delphi-prosecutor-says-deleted-interviews-with-witnesses-were-not-useful-evidence-in-murders-of-teenage-girls\" target=\"_blank\" rel=\"noopener\">pushed back<\/a> against the defense\u2019s claims, arguing that the interviews were \u201cnot evidence at all related to this case.\u201d<\/p>\n<p>He acknowledged that the interviews, which were conducted just days after the bodies of Williams and German were found, had been inadvertently recorded over, but \u201cwere not destroyed by the state purposefully or in bad faith.\u201d Prosecutors <a href=\"https:\/\/www.dailywire.com\/news\/police-recorded-over-interviews-with-key-witnesses-in-delphi-murders-defense-attorneys-say\">said<\/a> the interviews had been \u201crecorded over\u201d because of \u201ca DVR program error.\u201d<\/p>\n<p>Judge Fran Gull agreed with McLeland that charges against Allen shouldn\u2019t be dismissed based on the missing interviews, saying Baldwin and Rozzi didn\u2019t prove that the recordings were destroyed \u201cnegligently, intentionally, or in bad faith,\u201d according to Fox 59.<\/p>\n<p>\u201cThe recordings of interviews between February 14 -17, 2017, were lost due to human error or were spontaneously lost due to equipment resetting,\u201d Gull wrote in her ruling, according to the outlet.<\/p>\n<p>Even though the recordings don\u2019t exist, there are memorialized summaries of the interviews, but defense attorneys Andrew Baldwin and Bradley Rozzi wanted the recordings so they could \u201clisten to the exact spoken words\u201d of the two men who were interviewed, \u201cparticularly the statements that the author of the document admits were not memorialized in the document,\u201d the attorneys wrote in a filing in late February.<\/p>\n<p>McLeland, in his response, argued that the interviews \u201care not evidence related to this case.\u201d<\/p>\n<p>\u201cThe evidence in question is not exculpatory evidence nor is it potentially useful evidence,\u201d McLeland\u00a0wrote, according to Fox 59.<\/p>\n<p>Baldwin and Rozzi have claimed in <a href=\"https:\/\/www.dailywire.com\/news\/police-recorded-over-interviews-with-key-witnesses-in-delphi-murders-defense-attorneys-say\" target=\"_blank\" rel=\"noopener\">a past filing<\/a> that the teenage girls were killed by \u201c[m]embers of a pagan Norse religion, called Odinism, hijacked by white nationalists.\u201d<\/p>\n<p>The attorneys said in the filing that two groups of Odinists, one from Delphi and the other from Rushville, Indiana, were investigated for their possible involvement in the murders. As evidence the girls were murdered as part of a ritual sacrifice, the attorneys point to ritualistic symbols allegedly found at the crime scene, which include the strange way young Libby\u2019s body was positioned.<\/p>\n<p>A March 2017 search warrant request from the FBI <a href=\"https:\/\/www.dailywire.com\/news\/police-recorded-over-interviews-with-key-witnesses-in-delphi-murders-defense-attorneys-say\" target=\"_blank\" rel=\"noopener\">noted<\/a> that the girls\u2019 bodies looked as though they had been \u201cmoved and staged.\u201d<\/p>\n<p>The filing also notes that investigators didn\u2019t further investigate the alleged ritualistic symbols left at the crime scene, which included sticks and tree branches placed on the girls\u2019 bodies that mimicked certain Norse runes. At least one branch appeared to have been cut with an electronic device, suggesting premeditation, the defense argues.
