The recent constitutional amendment has sparked controversy,\u200d allowing greater access to abortions and challenging existing protections \u2062for\u200d women. The ACLU and Planned Parenthood are at the forefront of legal action against Ohio&#8217;s regulations.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Pro-lifers warned that abortion activists would exploit Issue One in Ohio to undo every layer of protection for women and unborn babies, but their cries fell on deaf ears. <\/p>\n<p>Now, just four months after Ohioans voted to pass the\u00a0constitutional amendment declaring \u201cevery individual has a right\u201d to \u201creproductive decisions\u201d regardless of their age or their baby\u2019s gestational age, the American Civil Liberties Union (ACLU), the organization\u2019s Ohio chapter, and Planned Parenthood Federation of America <a href=\"https:\/\/www.scribd.com\/document\/718248401\/Motion-for-Preliminary-Injunction#from_embed\" target=\"_blank\" rel=\"noreferrer noopener\">filed a lawsuit<\/a> challenging the Buckeye State\u2019s informed consent laws.<\/p>\n<p>The motion for  \u201cunnecessarily requiring\u201d women to wait to obtain an abortion often results in a delayed or canceled appointment.<\/p>\n<p>The lawsuit comes at the same time Republican Attorney General Dave Yost <a href=\"https:\/\/apnews.com\/article\/abortion-amendment-ohio-attorney-general-e6586d27b115372ede261c41d3ce2346\">agreed<\/a> that Ohio\u2019s 2019 law barring abortion beyond the detection of a fetal heartbeat is no longer constitutional after the state\u2019s November referendum.<\/p>\n<p>The reason for the suit is far from obscure. Now that Ohio has a <a href=\"https:\/\/thefederalist.com\/2023\/05\/23\/abortion-activists-try-to-fool-ohioans-into-constitutional-amendment-threatening-unborn-lives-and-parental-rights\/\" target=\"_blank\" rel=\"noreferrer noopener\">free pass to end unborn lives and trample on parents\u2019 rights<\/a>,\u00a0the abortion industry has an easy path to targeting what\u2019s left of the state\u2019s protections for women.<\/p>\n<p>Ohio laws currently require women seeking an abortion to be informed of the dangerous and sometimes fatal risks associated with the practice and examined by a doctor who can estimate the unborn baby\u2019s gestational age and find a fetal heartbeat. These requirements are paired with a 24-hour waiting period that is supposed to give mothers on the fence about their scheduled abortion time to rethink it and review the <a href=\"https:\/\/odh.ohio.gov\/know-our-programs\/informed-consent\/informedconsent#:~:text=The%20law%20also%20requires%20any,the%20material%20about%20alternate%20providers.\" target=\"_blank\" rel=\"noreferrer noopener\">fetal development guide<\/a> the state requires abortionists to hand out to expecting mothers.<\/p>\n<p>Any abortionists who do not comply with these conditions could face scrutiny from the state medical board and\/or <a href=\"https:\/\/www.cincinnati.com\/story\/news\/politics\/2024\/03\/29\/aclu-sues-ohio-over-24-hour-waiting-period-for-abortions\/73145130007\/\" target=\"_blank\" rel=\"noreferrer noopener\">criminal charges<\/a>.<\/p>\n<p>The plaintiffs, however, allege that this \u201cinterference\u201d by the state is now prohibited under Ohio\u2019s newest constitutional amendment. <\/p>\n<p>\u201cThese laws are now in clear violation of the newly amended Ohio Constitution, which enshrines the explicit and fundamental right to abortion and forbids the state from burdening, prohibiting, penalizing, and interfering with access to abortion, and discriminating against abortion patients and providers,\u201d Jessie Hill, cooperating attorney for the ACLU of Ohio, <a href=\"https:\/\/www.aclu.org\/press-releases\/ohio-abortion-providers-file-lawsuit-challenging-24-hour-waiting-period-and-other-abortion-restrictions\" target=\"_blank\" rel=\"noreferrer noopener\">said in a statement<\/a>.<\/p>\n<p>Pro-life groups warned that the national abortion activist groups leading the Issue One ballot initiative would not stop their efforts at effectively passing one of the most sweeping, <a href=\"https:\/\/thefederalist.com\/2023\/11\/06\/here-are-some-of-the-horror-stories-issue-1-would-welcome-to-ohio\/\" target=\"_blank\" rel=\"noreferrer noopener\">horror-inducing<\/a> abortion amendments in the nation. Their suggestion, however, was taunted and memory-holed by the corporate media, which falsely but deliberately accused them of spreading <a href=\"https:\/\/apnews.com\/article\/abortion-ohio-constitutional-amendment-election-misinformation-d7b3d8273389a432b011964c14959789\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cmisinformation.\u201d <\/a><\/p>\n<p>The Ohio Capital Journal <a href=\"https:\/\/ohiocapitaljournal.com\/2023\/10\/19\/rejecting-issue-1-would-bring-back-ohios-6-week-abortion-ban-with-no-exceptions-for-rape-or-incest\/\" target=\"_blank\" rel=\"noreferrer noopener\">published several articles<\/a> shortly before the November election claiming voters who check \u201cyes\u201d on the amendment were simply reaffirming the state\u2019s status quo 22-week abortion law by rejecting a <a href=\"https:\/\/ohiocapitaljournal.com\/2023\/10\/19\/what-is-ohio-issue-1-we-explain-the-proposed-abortion-rights-amendment\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u201ccontroversial\u201d<\/a> six-week ban <a href=\"https:\/\/ohiocapitaljournal.com\/2023\/10\/19\/rejecting-issue-1-would-bring-back-ohios-6-week-abortion-ban-with-no-exceptions-for-rape-or-incest\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cwith no exceptions for rape or incest\u201d<\/a> from taking effect. <\/p>\n<p>In reality, the change to the state constitution opened the door for abortion activists to legally protest <a href=\"https:\/\/thefederalist.com\/2023\/11\/02\/issue-1-permanently-writes-planned-parenthoods-business-model-into-ohios-constitution\/\" target=\"_blank\" rel=\"noreferrer noopener\">any attempt to rein in abuses<\/a> in abortion, contraception, assisted reproductive technology, the radical trans-ing of children, and any of the other \u201crights\u201d that are encompassed by the ambiguous amendment.<\/p>\n<p>When it comes to advancing their abortion-for-all activism, Democrats\u2019 <a href=\"https:\/\/thefederalist.com\/2023\/11\/06\/democrats-abortion-activism-hinges-on-lies-and-deception\/\" target=\"_blank\" rel=\"noreferrer noopener\">lies and deceptions<\/a> abound. They don\u2019t merely rely on vague language and undefined terms in confusing ballot initiatives to achieve their abortion at any time for any reason agenda. With the help of their <a href=\"https:\/\/thefederalist.com\/2022\/09\/20\/media-activists-wont-grill-democrats-on-unpopular-abortion-extremism-because-they-agree-with-it\/\" target=\"_blank\" rel=\"noreferrer noopener\">allies in the corrupt corporate media<\/a>, leftists eager to enshrine abortion in state constitutions overlook voters\u2019 <a href=\"https:\/\/thefederalist.com\/2023\/10\/26\/poll-less-than-1-4-of-ohioans-support-the-unlimited-abortion-outlined-in-issue-1\/\" target=\"_blank\" rel=\"noreferrer noopener\">strong opposition<\/a> to making that fatal practice unlimited to continue undoing protections. <\/p>\n<p>Pro-life laws and limits <a href=\"https:\/\/thefederalist.com\/2023\/10\/04\/two-years-later-the-texas-heartbeat-act-has-saved-thousands-of-lives\/\" target=\"_blank\" rel=\"noreferrer noopener\">save lives<\/a>. Yet, several states, including Florida, are subjecting themselves to the same deceptive ballot initiatives that passed in Ohio and opened the door for abortion giants to challenge every safeguard. <\/p>\n<p>\u201cFloridians and those who live in states where abortion could be on the ballot should take note of the unfortunate realities playing out in Ohio where out-of-state interests are using Issue 1 to keep women in the dark and further Big Abortion\u2019s profit motives,\u201d Sue Liebel, midwestern regional director for SBA Pro-Life America, said in a statement. \u201cEvery health and safety protection on the books will be targeted because even the abortion advocates say this lawsuit is only step one.
