The proposed legislation, sponsored\u2063 by Democratic Assemblymember Wendy Carillo, would allow warrantless arrests based on \u200dprobable cause for theft not witnessed\u200b by officers.\u2063 This move seeks to address the rise in retail theft affecting\u2063 businesses in urban areas.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>A <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/los-angeles\/\" target=\"_blank\" rel=\"noopener\" title=\"Los Angeles\">Los Angeles<\/a> County Democrat proposed legislation that would make retail theft a misdemeanor in an effort that could make <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/retail-theft\/\" target=\"_blank\" rel=\"noopener\" title=\"shoplifters\">shoplifters<\/a> more fearful of stealing. <\/p>\n<p>The bill would make shoplifting a misdemeanor and allow law enforcement to make warrantless arrests for theft not committed in their presence if officers have probable cause. Democratic Assemblymember Wendy Carillo sponsored the legislation, along with two other Democrats and one Republican lawmaker. <\/p>\n<p>\u201cRight now, there\u2019s no fear, right? It\u2019s like we can steal, we can commit these petty misdemeanor crimes, but it\u2019s cite and release and there\u2019s no record,\u201d Carrillo <a href=\"https:\/\/www.politico.com\/newsletters\/california-playbook-pm\/2024\/04\/01\/using-fear-to-deter-theft-in-california-00150046\">told<\/a> <em>Politico<\/em>. <\/p>\n<p><a href=\"https:\/\/a52.asmdc.org\/press-releases\/20240320-assemblywoman-wendy-carrillo-unveils-bipartisan-effort-secured-transactions\">AB 1990<\/a>, also known as the Secured Transactions and Organized Theft Prevention Act, is a result of the state\u2019s surge in retail theft that has left small and large businesses alike packing up and leaving big cities where property crime is most common.<\/p>\n<p>\u201cThis is just going back to traditionally what we used to have, which was book-and-arrest, so you\u2019ll have a record,\u201d Carrillo said.<\/p>\n<p>Still, Carillo\u2019s legislation does not touch Proposition 47, a measure that categorizes nonviolent property crime that does not exceed $950 in value as a misdemeanor, nor does the bill combine minor crimes to make them more serious. <\/p>\n<p>Democratic Assemblymember Tina McKinnor criticized Carillo\u2019s legislation, saying in a <a href=\"https:\/\/twitter.com\/AsmTinaMcKinnor\/status\/1772359914054144119\" title=\"post\">post<\/a> on X that it would \u201cpromote mass incarceration.\u201d<\/p>\n<p>\u201cWe need our law enforcement partners to enforce the law, not discourage retailers from asking for help,\u201d McKinnor wrote.  <\/p>\n<p>Meanwhile, the legislation\u2019s lone-Republican sponsor and former law enforcement officer, Juan Alanis, praised the bill, <a href=\"https:\/\/kmph.com\/news\/local\/new-bill-introduced-to-combat-rising-retail-theft-in-california\">telling<\/a> Fox 26 News that it \u201cchecks all the boxes.\u201d <\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/?utm_source=google&#038;utm_medium=cpc&#038;utm_campaign=WE_Search_Brand-Keyword_2024&#038;gad_source=1&#038;gclid=Cj0KCQjw2a6wBhCVARIsABPeH1v2wivuDbtsrChcLdeq-dqjYvl_alwr1z6OyBCkEbmDhrgwSasUHuUaAkqFEALw_wcB\" title=\"CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER\"><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a> <\/p>\n<p>Democrat lawmakers unveiled provisions in a separate bill last month that would also take small steps to curb the Golden State\u2019s theft problem. <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202320240AB2943\" target=\"_blank\" rel=\"noopener\" title>AB 2943<\/a> would impose a criminal penalty of up to three years in prison if a person was found possessing stolen property. It would also allow the value of stolen property to be added up to reach the $950 minimum value for theft to be considered a felony. <\/p>\n<p>However, both Carillo\u2019s legislation and AB 2943 are still making their way through the legislative process with Carillo\u2019s expected to be discussed in a hearing sometime next week, per <em>Politico<\/em>.<\/p>\n<\/p><\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A Los Angeles County Democrat is pushing a bill to reclassify retail theft as a misdemeanor, aiming to increase the fear of shoplifters.
