Chief Justice John Roberts <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/2926887\/supreme-court-denies-navarros-bid-to-avoid-prison-sentence\/\" target=\"_blank\" rel=\"noopener\" title=\"denied\">denied<\/a> <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/2923643\/navarro-taps-supreme-court-to-avert-prison-sentence\/\" target=\"_blank\" rel=\"noopener\" title=\"Navarro's bid\">Navarro\u2019s bid<\/a> to remain out of prison pending appeal on March 18, and Navarro\u2019s lawyer <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23A843\/306519\/20240402144050476_2024-04-02%20-%20Gorsuch%20Petition%20Reconsideration.pdf\" target=\"_blank\" rel=\"noopener\" title=\"Navarro's bid\">sent a letter<\/a> to the high court asking for Gorsuch, a Trump appointee, to consider the latest request.<\/p>\n<figure><figcaption>Supreme Court Justices Neil Gorsuch, left, and Elena Kagan, right, arrive before President Joe Biden speaks during the State of the Union address on Thursday, March 7, 2024, on Capitol Hill in Washington. (AP Photo\/Mark Schiefelbein)<\/figcaption><\/figure>\n<p>Stanley Woodward, an attorney for Navarro, argued that the U.S. Court of Appeals for the District of Columbia Circuit set a briefing schedule in his appeal that would \u201cnot be concluded until July 19, 2024, after he is scheduled to have served the entirety of his prison sentence.\u201d<\/p>\n<p>\u201cAccordingly, we respectfully request your reconsideration of the Chief Justice\u2019s denial,\u201d Woodward added.<\/p>\n<p>Roberts wrote on March 18 that he saw no reason to disagree with an appeals court decision denying Navarro\u2019s request to remain free, adding that the decision was distinct from a ruling on the appeal itself, according to a one-page order.<\/p>\n<p>Navarro\u2019s latest bid marks his second request to the Supreme Court in recent weeks and follows another legal setback he sustained on Monday.<\/p>\n<p>A federal judge separately threatened in February to hold Navarro in contempt of court if he failed to hand over emails from his time in the Trump administration to the National Archives in a ruling the appeals court affirmed on Monday.<\/p>\n<p>Navarro\u2019s request \u201cwould leave the United States with no ability to retrieve Presidential records from employees if they refuse to return Presidential records after being disciplined or exiting federal employment,\u201d the panel <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cadc.39578\/gov.uscourts.cadc.39578.1208609758.0.pdf\" target=\"_blank\" rel=\"noopener\" title=\"wrote\">wrote<\/a> in a four-page judgment.<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noopener\" title><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p>It is unclear whether or how soon Gorsuch will respond to the request.<\/p>\n<p>Navarro has served 15 days of his four-month sentence.
