The case questions the impact of Biden&#8217;s Executive Order \u206414019 on election procedures.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><\/p>\n<div class=\"article-content\">\n<p>Pennsylvania\u2019s legal battle over \u201c<a href=\"https:\/\/thefederalist.com\/2024\/02\/22\/bidenbucks-stink-emanates-from-leftist-groups-voter-drive-in-milwaukee-schools\/\" target=\"_blank\" rel=\"noreferrer noopener\">Bidenbucks<\/a>\u201d will go on after a federal judge last week <a href=\"https:\/\/thefederalist.com\/2024\/03\/29\/bidenbucks-tentacles-expand-as-judge-shuts-down-lawsuit\/\" target=\"_blank\" rel=\"noreferrer noopener\">dismissed a lawsuit<\/a> by a group of Keystone State lawmakers challenging President Joe Biden\u2019s constitutionally suspect executive order that uses federal agencies as a Democrat get-out-the-vote machine. <\/p>\n<p>Attorney <a href=\"https:\/\/www.mklaw.com\/attorney\/kaardal-erick-g\/\" target=\"_blank\" rel=\"noreferrer noopener\">Erick Kaardal<\/a>, who represents<a href=\"https:\/\/www.politicspa.com\/pa-freedom-caucus-files-civil-rights-complaint-against-biden-shapiro-and-dept-of-state\/131064\/\" target=\"_blank\" rel=\"noreferrer noopener\"> Freedom Caucus Republicans<\/a> in the Pennsylvania General Assembly, tells The Federalist that the 26 lawmakers plan to ask the U.S. Supreme Court to hear the lawsuit against the president and Gov. Josh Shapiro, a Democrat. <\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1770385558\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-f402ec88b22a06b09bfda2dbe2d960e6 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-f402ec88b22a06b09bfda2dbe2d960e6\"><\/div>\n<p>\u201cWe\u2019re going to be petitioning for accelerated review by the Supreme Court, using the Purcell Principle, not as a shield but as a sword,\u201d Kaardal said. <\/p>\n<p>The <a href=\"https:\/\/www.scotusblog.com\/election-law-explainers\/the-purcell-principle-a-presumption-against-last-minute-changes-to-election-procedures\/\" target=\"_blank\" rel=\"noreferrer noopener\">Purcell Principle<\/a> deals with the timeliness of election rules, asserting that changing laws just before an election could confuse voters and create headaches for election administrators.  <\/p>\n<p>The principle, according to <a href=\"https:\/\/www.scotusblog.com\/election-law-explainers\/the-purcell-principle-a-presumption-against-last-minute-changes-to-election-procedures\/\" target=\"_blank\" rel=\"noreferrer noopener\">SCOTUSblog,<\/a> was drawn from <a href=\"https:\/\/casetext.com\/case\/purcell-v-gonzalez\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Purcell v. Gonzalez<\/em><\/a>, \u201cin which the Supreme Court reversed an October 2006 decision of the U.S. Court of Appeals for the 9th Circuit blocking an Arizona voter ID law during that year\u2019s midterm election.\u201d<\/p>\n<p>Kaardal says his clients will soon file a motion in the U.S. 3rd Circuit Court of Appeals and petition the Supreme Court to immediately review the lower court\u2019s decision. <\/p>\n<div class=\"fdrlst__b89e9-89768051b10e74bfb7fce06850a0ce9a fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-89768051b10e74bfb7fce06850a0ce9a\"><\/div>\n<p>\u201cThe idea of filing under the Purcell Principle is that the Supreme Court should take this before the summer recess so it can decide whether President Biden\u2019s <a href=\"https:\/\/thefederalist.com\/2024\/03\/13\/doj-is-using-bidenbucks-to-encourage-illegals-and-felons-to-vote-says-mississippi-secretary-of-state\/\" target=\"_blank\" rel=\"noreferrer noopener\">Executive Order 14019<\/a> is to be the law of the land,\u201d the election integrity attorney said. <\/p>\n<p>If the courts don\u2019t act soon on the constitutionally suspect executive order, the Biden administration will likely use the Purcell argument to claim that stopping the GOTV fiat would only confuse voters and burden election administrators. <\/p>\n<h2 class=\"wp-block-heading\">\u2018Bidenbucks\u2019 Tentacles Spreading<\/h2>\n<p>Election integrity advocates have dubbed the executive order \u201cBidenbucks\u201d \u2014 a nod to the \u201c<a href=\"https:\/\/thefederalist.com\/2024\/03\/13\/wisconsins-left-led-supreme-court-could-bring-back-illegal-widespread-ballot-drop-boxes\/\" target=\"_blank\" rel=\"noreferrer noopener\">Zuckerbucks<\/a>\u201d rolled out in the 2020 election. Signed within months of Biden\u2019s narrow victories in election-deciding battleground states like Pennsylvania, the executive order is benignly painted as \u201cpromoting access to voting.\u201d It\u2019s ultimately designed to employ government to recruit voters for one political party.<\/p>\n<p>\u201cSounds harmless on its face, until you consider the fact that it is being carried out by political appointees \u2026  and that the person charged with collecting the plans and leading this effort is President Joe Biden\u2019s domestic policy advisor, Susan Rice,\u201d Tarren Bragdon, president of the Foundation for Government Accountability, wrote in a <a href=\"https:\/\/thefederalist.com\/2022\/07\/27\/bidens-illegal-election-hail-mary-might-still-be-intercepted\/\" target=\"_blank\" rel=\"noreferrer noopener\">2022 column<\/a> in The Federalist. <\/p>\n<div class=\"fdrlst__b89e9-b493790a0a3699b59d1e6cd74c53ec49 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-b493790a0a3699b59d1e6cd74c53ec49\"><\/div>\n<p>As The Federalist <a href=\"https:\/\/thefederalist.com\/2024\/03\/29\/bidenbucks-tentacles-expand-as-judge-shuts-down-lawsuit\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> last week, the Michigan Department of State has <a href=\"https:\/\/www.sba.gov\/article\/2024\/03\/19\/sba-administrator-guzman-announces-agencys-first-ever-voter-registration-agreement-michigan\" target=\"_blank\" rel=\"noreferrer noopener\">signed a Memorandum of Understanding (MOU)<\/a> with the U.S. Small Business Administration \u201cto promote civic engagement and voter registration in Michigan.\u201d According to Michigan Secretary of State Jocelyn Benson and SBA Administrator Isabel Casillas Guzman, the agreement is a \u201cfirst-of-its-kind collaboration\u201d for the federal agency and is expected to run through Jan. 1, 2036 \u2014 if the legal challenges can\u2019t stop the apparently unconstitutional \u201cunderstanding.\u201d <\/p>\n<p>The MOU calls for Michigan\u2019s Department of State to create a \u201cunique URL for the SBA to use to drive online visitors to register to vote.\u201d The SBA\u2019s Michigan field office will also let state department officials do in-person voter registration drives at SBA outreach events.\u00a0It\u2019s one of many \u201cpartnerships\u201d between federal and state agencies and third-party actors. <\/p>\n<p>Kaardal said an analysis of what is known of the federalized voter registration plan found it explicitly targets 15 traditional Democrat and left-leaning voter groups, and only voting-age people who \u201cinteract\u201d with federal agencies are to receive voter registration information. <\/p>\n<p>\u201cThey\u2019re trying to get the procedures in place. Later, the conditions will come,\u201d the attorney said, adding that the conditions may very well be that small businesses, for instance, will have to provide voter registration information to their employees. Kaardal noted Michigan city ordinances that mandated landlords provide new tenants with voter registration information. On the threat of First Amendment <a href=\"https:\/\/news.jrn.msu.edu\/2023\/04\/east-lansing-landlords-win-fight-against-city-as-council-suspends-voter-registration-ordinance\/\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuits,<\/a> the ordinances have been rolled back. <\/p>\n<h2 class=\"wp-block-heading\">\u2018Executive Fiat\u2019<\/h2>\n<p>In January, Pennsylvania Republican lawmakers led by Rep. Dawn Keefer, R-York County, sued Biden, Shapiro, and Pennsylvania\u2019s Secretary of State, charging that federal and state election-related actions are an overreach of executive power and a usurping of the <a href=\"https:\/\/constitution.congress.gov\/browse\/article-1\/section-4\/#:~:text=The%20Times%2C%20Places%20and%20Manner,the%20Places%20of%20chusing%20Senators.\" target=\"_blank\" rel=\"noreferrer noopener\">constitutional authority<\/a> of state legislatures to prescribe the \u201cTimes, Places and Manner of holding Elections\u2026\u201d<\/p>\n<p>\u201c[A]ll agency action in conformity with [EO] 14019 is without congressional delegation or funding, and conducted merely by executive fiat,\u201d the lawsuit <a href=\"https:\/\/www.democracydocket.com\/wp-content\/uploads\/2024\/01\/M.D.-Pa.-24-cv-00147-dckt-000048_000-filed-2024-03-26.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">asserts<\/a>.<\/p>\n<p>Keefer has said the orders have \u201cvictimized\u201d Pennsylvania citizens because they have \u201cmade changes to election laws with no authority to do so.\u201d <\/p>\n<p>\u201cIf we don\u2019t take action to stop this, there is no limit to the changes they might make to further erode Pennsylvania\u2019s election system in 2024 and beyond,\u201d the leader of the legislature\u2019s Freedom Caucus said when the lawsuit was filed. <\/p>\n<p>Middle\u00a0Pennsylvania District Court <a href=\"https:\/\/www.pamd.uscourts.gov\/content\/judge-jennifer-p-wilson\" target=\"_blank\" rel=\"noreferrer noopener\">Judge Jennifer P. Wilson<\/a>, a Trump appointee, granted the Biden administration\u2019s motions to dismiss because of the \u201cPlaintiffs\u2019 lack of standing to raise the claims at issue.\u201d\u00a0The district court judge cited rulings from the U.S. Supreme Court and the U.S. 3rd Circuit Court of Appeals that found \u201cindividual legislators did not have standing to bring a challenge to an action that allegedly injured the legislature as a whole.\u201d<\/p>\n<p>\u201c\u2026Plaintiffs have alleged only an institutional injury resulting from \u2018a general loss of legislative power,\u2019\u201d the judge wrote in her <a href=\"https:\/\/www.democracydocket.com\/wp-content\/uploads\/2024\/01\/M.D.-Pa.-24-cv-00147-dckt-000048_000-filed-2024-03-26.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">decision<\/a>. \u201cA vague, generalized allegation that elections, generally, will be undermined, is not the type of case or controversy that this court may rule on under Article III.\u201d <\/p>\n<p>Keefer said Wilson\u2019s decision was not on the merits of the lawsuit but on a technicality. She told The Federalist that she and her fellow plaintiffs \u201cbelieve we absolutely have standing.\u201d <\/p>\n<p>Attorneys for Shapiro also argued that the General Assembly gave the state executive branch authority to issue elections actions through previous laws. Keefer told The Federalist that Shapiro\u2019s unilateral decision to implement automatic voter registration and the Pennsylvania Department of State\u2019s voter roll decisions conflict with state law.  <\/p>\n<p>\u201cWhile we do delegate authority, at no time do we delegate the authority or power to not follow the law,\u201d Keefer, who serves as chairwoman of the House\u2019s State Government Subcommittee on Campaign Finance and Elections, told The Federalist on Monday in an interview. <\/p>\n<p>She said \u201cBidenbucks\u201d and its use of third-party groups also violates a state law passed in the wake of the 2020 election banning \u201cZuckbucks\u201d \u2014 private and nonprofit organizations\u2019 involvement in election administration.<\/p>\n<h2 class=\"wp-block-heading\">\u2018Smacks of Suspicion\u2019 <\/h2>\n<p>Kaardal says the lawsuit specifically deals with state lawmakers and their powers under the Constitution\u2019s <a href=\"https:\/\/constitution.congress.gov\/browse\/essay\/artI-S4-C1-2\/ALDE_00013577\/#:~:text=Article%20I%2C%20Section%204%2C%20Clause,the%20Places%20of%20chusing%20Senators.\" target=\"_blank\" rel=\"noreferrer noopener\">elections<\/a> clause. Those questions, the attorney said, remain unsettled. <\/p>\n<p>In a memorandum of opposition, Biden\u2019s U.S. Department of Justice argues the Pennsylvania lawmakers claim Biden issued his executive order without congressional authorization. Congress\u2019s approval was unnecessary, the DOJ attorneys argue, noting, \u201cThe authority of the President to control and supervise executive policymaking is derived from the Constitution.\u201d <\/p>\n<p>Indeed. But states also have election-related authority under the Constitution, and Biden\u2019s federalization of election registration interferes with those powers, the plaintiffs contend.  <\/p>\n<p>Kaardal said the DOJ\u2019s brief is a \u201chuge tell\u201d in which they concede Biden\u2019s fiat is not connected to any law passed by Congress. <\/p>\n<p>\u201cThat the president is only going forward on Article II authority doesn\u2019t pass muster on the elections clause,\u201d the attorney said. <\/p>\n<p>Stewart Whitson of the Foundation for Government Accountability has <a href=\"https:\/\/www.dailysignal.com\/2024\/03\/22\/this-state-lawmaker-sues-to-take-down-bidens-election-meddling-executive-order\/#:~:text=Stewart%20Whitson%2C%20legal%20director%20of,integrity%20lawsuit%20in%20the%20country.%E2%80%9D\" target=\"_blank\" rel=\"noreferrer noopener\">called<\/a> the Pennsylvania challenge to Bidenbucks \u201cthe MOST important election integrity lawsuit in the country.\u201d <\/p>\n<p>Perhaps that\u2019s because it\u2019s reportedly the only lawsuit taking on Biden\u2019s election meddling. Why? Kaardal said a lot of red-state legislatures, attorneys general, and secretaries of state \u201chave been spineless.\u201d He called Keefer and her 25 legislative colleagues \u201cbrave patriots\u201d who are saying, \u201cIt\u2019s upon us to take this on.\u201d<\/p>\n<p>Keefer said the GOTV end-around by Biden and Pennsylvania Democrats only serves to further erode voter confidence in elections. The Biden administration has refused to release thousands of pages of internal records related to his executive order. The Foundation for Government Accountability filed the lawsuit demanding the release of the documents. <\/p>\n<p>\u201cIf you\u2019re trying to engender voter confidence, why wouldn\u2019t you be transparent,\u201d the lawmaker said. \u201cWith the president and this executive order having these agencies engage with third parties and we\u2019re not privy to who those third parties are or what that contract is or how much money is involved, it all smacks of suspicion.\u201d <\/p>\n<div class=\"fdrlst__b89e9-cdfe587ffb74f5f596769f71de6dc1a6 fdrlst__b89e9-after-post-content\" id=\"fdrlst__b89e9-cdfe587ffb74f5f596769f71de6dc1a6\"><\/div>\n<hr class=\"wp-block-separator\">    \t\t\t\t\t   \t\t\t\t\t\t\t\t\t<\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Pennsylvania&#8217;s ongoing legal fight concerning &#8220;Bidenbucks&#8221; continues as a federal judge recently threw out a lawsuit by a group of state lawmakers challenging President Joe Biden&#8217;s contentious executive order.
