Judge Acosta, via teleconference, allowed their release despite riot-related charges. Most were granted personal recognizance, with only those facing federal detention remaining\u2063 in custody. Judge Acosta criticized the District Attorney&#8217;s office for unpreparedness during detention hearings.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<div>\n<div>\n<figure>                         <\/figure>\n<\/p><\/div>\n<p>A federal judge in Texas ruled on Easter Sunday that some of the illegal border crossers accused of storming the National Guard members guarding the Lone Star State border should be released with no-cost bail.<\/p>\n<p>Presiding Magistrate Judge Humberto Acosta decided via teleconference on March 31 that the hoard of illegal border crossers who stampeded the Texas border last month are free to go. <\/p>\n<p>The Texas Department of Public Safety arrested <a href=\"https:\/\/www.dailymail.co.uk\/news\/article-13253659\/Texas-arrests-migrants-rioting-charges-El-Paso.html\" target=\"_blank\" rel=\"noreferrer noopener\">hundreds of illegal border crossers<\/a> for riot participation, criminal mischief, and even assault charges along the El Paso border on March 21. Footage of the stampede shows the rioters, mostly Venezuelan males, tearing down razor wire barriers and mobbing the <a href=\"https:\/\/nypost.com\/2024\/03\/31\/us-news\/migrants-arrested-in-storming-at-us-border-released-by-el-paso-judge-report\/?utm_source=twitter&#038;utm_medium=social&#038;utm_campaign=nypost\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cseverely outnumbered\u201d<\/a> Texas National Guard members to illegally force their way into the Lone Star State.<\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<div lang=\"en\" dir=\"ltr\">\n<p>NEW: Texas has arrested 70 more migrants who rioted at the southern border in El Paso, Texas and assaulted National Guard troops. <\/p>\n<p>Glad to see someone is taking action.  <\/p>\n<p>Texas charged nine of the migrants on Wednesday involved in the riot. <\/p>\n<p>Knives and shanks were\u2026 <a href=\"https:\/\/t.co\/LXgME5ivrX\">pic.twitter.com\/LXgME5ivrX<\/a><\/p>\n<\/div>\n<p>\u2014 Collin Rugg (@CollinRugg) <a href=\"https:\/\/twitter.com\/CollinRugg\/status\/1773735562320683032?ref_src=twsrc%5Etfw\">March 29, 2024<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<p>Despite the violent nature of the rioters, Acosta granted most of them personal recognizance, meaning they simply had to sign papers promising they would appear in court instead of posting monetary bail. Only the arrested illegal border crossers who face federal detention holds will remain jailed.<\/p>\n<p>Acosta justified the decision by blaming the local District Attorney\u2019s office for failing to adequately prepare for detention hearings.<\/p>\n<p>\u201cSo if the DA\u2019s office is telling me that they are not ready to go, what we\u2019re going to do is we\u2019re going to release all these individuals on their own recognizance,\u201d Acosta said, <a href=\"https:\/\/www.elpasotimes.com\/story\/news\/immigration\/2024\/03\/31\/el-paso-border-riot-judge-orders-migrants-release\/73161289007\/\" target=\"_blank\" rel=\"noreferrer noopener\">according to the El Paso Times<\/a>. <\/p>\n<p>Acosta\u2019s decision comes just after U.S. Customs and Border Protection reported the highest number of illegal border crosser encounters <a href=\"https:\/\/thefederalist.com\/2024\/03\/25\/february-data-shows-new-record-high-for-bidens-border-invasion\/\" target=\"_blank\" rel=\"noreferrer noopener\">in the month of February<\/a> since the agency began <a href=\"https:\/\/www.cbp.gov\/sites\/default\/files\/assets\/documents\/2020-Jan\/U.S.%20Border%20Patrol%20Monthly%20Apprehensions%20%28FY%202000%20-%20FY%202019%29_1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">tracking apprehensions in 2000<\/a>: 189,900.<\/p>\n<p>Texas has tried to exercise its authority to deport illegal border crossers entering the U.S. through the Lone Star State borer but has <a href=\"https:\/\/thefederalist.com\/2024\/03\/20\/after-fleeting-scotus-victory-appeals-court-pauses-texas-border-security-law-again\/\" target=\"_blank\" rel=\"noreferrer noopener\">faced repeated legal and political attacks from the Biden administration for it<\/a>.<\/p>\n<hr>\n<p>      Jordan Boyd is a staff writer at The Federalist and co-producer of The Federalist Radio Hour.
