Whether it\u2019s her <a href=\"https:\/\/nypost.com\/2022\/03\/24\/supreme-court-nominee-judge-ketanji-brown-wont-define-woman\/\" target=\"_blank\" rel=\"noreferrer noopener\">refusing to define what a woman is<\/a> or realizing for the first time that <a href=\"https:\/\/intellectualtakeout.org\/2024\/03\/ketanji-brown-jackson-first-amendment\/\" target=\"_blank\" rel=\"noreferrer noopener\">the First Amendment is intended to be a restraint on the government<\/a>, she certainly has a gift for the obtuse. <\/p>\n<p>This gift was recently on full display in the <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/2925194\/supreme-court-split-government-contact-social-media-censorship\/\" target=\"_blank\" rel=\"noreferrer noopener\">hypothetical she posited<\/a> in the oral arguments for <em>Murthy v. Missouri<\/em> when she asked whether the government should be able to erase popular posts on social media that encouraged kids to jump off buildings. Not only is posting such content illegal, as Joy Pullmann <a href=\"https:\/\/thefederalist.com\/2024\/03\/21\/this-country-cannot-afford-a-weak-supreme-court-decision-on-internet-censorship\/\" target=\"_blank\" rel=\"noreferrer noopener\">notes<\/a> at The Federalist, but this whole scenario is absurd.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1236113248\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-15a42f86634c67e8ee803b0d2eb0690e fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-15a42f86634c67e8ee803b0d2eb0690e\"><\/div>\n<p>Then again, maybe it isn\u2019t. In <a href=\"https:\/\/www.law.cornell.edu\/supct\/cert\/23-235\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Food and Drug Administration v. Alliance for Hippocratic Medicine<\/em><\/a>, a group of doctors is charging the FDA with wrongly approving and under-regulating the abortion drug mifepristone. Despite the lack of studies to prove the safety of the drug, the FDA fast-tracked its approval in 2000 and removed the restrictions in 2016 that were originally put in place to justify the fast-track. With the drug becoming more easily available, it has quickly become a workaround for women to procure abortions in states that place limits on the practice. <\/p>\n<p>In other words, a popular trend has arisen that encourages mothers to take a pill that kills their babies in the womb and possibly <a href=\"https:\/\/thefederalist.com\/2024\/03\/19\/popping-abortion-pills-is-way-more-dangerous-than-big-pharma-wants-women-to-know\/\" target=\"_blank\" rel=\"noreferrer noopener\">does severe harm<\/a> to themselves. In the interest of protecting life, it seems logical that the government should take action against this trend, either banning mifepristone or restoring the preexisting restrictions. In light of the <a href=\"https:\/\/www.msn.com\/en-us\/news\/politics\/what-is-the-comstock-act-the-law-mentioned-in-scotus-abortion-pill-case\/ar-BB1kxNQs\" target=\"_blank\" rel=\"noreferrer noopener\">Comstock Act<\/a>, which forbids the use of the U.S. Postal Service to transport abortifacients, none of it should be crossing state lines.<\/p>\n<p>However, nothing like this was debated in the oral arguments. Rather, the lawyers and justices debated whether the group bringing the charge, an association of health care professionals, had legal standing. As legal experts Thomas Jipping and Sarah Parshall Perry <a href=\"https:\/\/www.dailysignal.com\/2024\/03\/26\/safety-women-hangs-balance-after-oral-arguments-abortion-pill-regulation\/\" target=\"_blank\" rel=\"noreferrer noopener\">helpfully explain<\/a> at The Daily Signal, legal standing requires three things: \u201ca concrete legal injury, one that was caused by the defendant, and that a court can remedy.\u201d <\/p>\n<p>Essentially, the FDA argued it was none of these doctors\u2019 business what the department decides about mifepristone, and the plaintiffs had to argue why it actually was their business. <\/p>\n<div class=\"fdrlst__b89e9-5f8e501340222d6cb6d0ff12b30c5cf9 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-5f8e501340222d6cb6d0ff12b30c5cf9\"><\/div>\n<p>In this regard, the plaintiffs asserted women entering the emergency room with <a href=\"https:\/\/www.dailysignal.com\/2024\/03\/28\/woman-graphically-describes-holding-her-chemically-aborted-baby-on-bloody-bathroom-floor\/\">injuries caused by mifepristone<\/a> and possibly needing emergency abortions did in fact constitute an injury to doctors who don\u2019t want to perform them. Although the case hasn\u2019t yet been decided, the justices were skeptical about this argument since it seemed primarily based on hypotheticals \u2014 which apparently only work for arguments about government censorship.<\/p>\n<p>Justice Elena Kagan led the charge against the plaintiffs for having standing, accusing them of using \u201cvery probabilistic\u201d reasoning. Evidently, unless the doctors themselves were suffering from botched abortions after taking mifepristone and had the receipts showing that it was the drug and only the drug that caused the injury, then they have no right to complain. Americans will just have to learn the hard way that mifepristone is poison and make their case all over again when they have the requisite standing to prove it in court.<\/p>\n<p>On the conservative side, it was mostly Justice Neil Gorsuch speaking up \u2014 also against the plaintiffs. While Kagan complained that the doctors were not sufficiently harmed by mifepristone, Gorsuch complained it was out of place for the court to do what the doctors requested, which was to force the FDA to reestablish the old restrictions for using mifepristone. Apparently, this is something only lower courts could do, not the highest court of the land. Perhaps one just has to be a true textualist to understand this argument. <\/p>\n<p>As for violating the Comstock Act, Justices Clarence Thomas and Samuel Alito were the only ones to bring this up. But because this issue was ignored by lower courts when plaintiffs included it in their case, this will likely be ignored by the Supreme Court as well. Although there was no answer to Thomas\u2019 question of why the makers of mifepristone can brazenly violate the law, it seems to be understood that this is simply what\u2019s necessary now that <em>Roe v. Wade<\/em> has been repealed.<\/p>\n<div class=\"fdrlst__b89e9-87b5332a96cec252a145bed4c6fcd14d fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-87b5332a96cec252a145bed4c6fcd14d\"><\/div>\n<p>Thus, it looks like the justices will rule in favor of the FDA and make Jackson\u2019s scenario of a murderous trend going viral a government-endorsed reality. It\u2019s telling that the whole conversation centered on what amounts to a technicality. As for a large government department fast-tracking a drug that can kill babies and harm mothers without even providing sufficient evidence of its safety, this doesn\u2019t seem to be a conversation anyone, leftist or conservative, wants to have. <\/p>\n<p>As usual, it\u2019s left to grassroots organizations to campaign against the use of mifepristone \u2014 though the media may very well label this \u201cmisinformation\u201d as they have with <a href=\"https:\/\/thefederalist.com\/2024\/03\/28\/dont-read-this-birth-control-misinformation-unless-you-want-to-be-twice-as-happy-as-you-are-now\/\" target=\"_blank\" rel=\"noreferrer noopener\">critics of birth control pills<\/a>. Even laws prohibiting the interstate delivery of the drug can be waved away when the government says so. <\/p>\n<p>If the Supreme Court justices rule in favor of the FDA, they will have missed an important opportunity to safeguard the lives and health of American mothers and to curb the tyrannical ambitions of Big Pharma and the administrative state. <\/p>\n<div class=\"fdrlst__b89e9-e8c209ed7f80f6de1f1744d5762b8d7f fdrlst__b89e9-after-post-content\" id=\"fdrlst__b89e9-e8c209ed7f80f6de1f1744d5762b8d7f\"><\/div>\n<hr class=\"wp-block-separator\">    \t\t\t\t\t   \t\t\t\t\t\t\t\t\t<\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The latest addition to the U.S. Supreme Court, Justice Ketanji Brown Jackson, brings inadvertent humor to the court.
