Prosecutors and defense attorneys\u200b are at odds over interpreting the order, escalating\u2063 the legal \u2064discord.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Confusion over the <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/2941702\/trump-tests-limits-gag-order-fresh-attacks-hush-money-judges-daughter\/\" target=\"_blank\" rel=\"noopener\" title=\"latest gag order\">latest gag order<\/a> against <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\" target=\"_blank\" rel=\"noreferrer noopener\">Donald Trump<\/a> in his <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/new-york\" target=\"_blank\" rel=\"noreferrer noopener\">New York<\/a> criminal hush money case came to a head Friday evening after warring pre-motions filed by defense counsel and prosecutors questioned whether the former president is barred from commenting on the judge and his family members.<\/p>\n<p>Ever since New York Judge Juan Merchan <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/2939749\/trump-handed-gag-order-in-manhattan-criminal-trial\/\" target=\"_blank\" rel=\"noopener\" title=\"imposed\">imposed<\/a> a gag order against Trump on March 26, the former president has lashed out at his daughter, who is president of a marketing firm that serves Democratic politicians, including by calling her a \u201cRabid Trump Hater\u201d in a social media post. Prosecutors with <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/manhattan\" target=\"_blank\" rel=\"noreferrer noopener\">Manhattan<\/a> District Attorney Alvin Bragg\u2019s office told Merchan in a letter sent Thursday that the Democratic DA understands the recent order to cover family members.<\/p>\n<figure><figcaption>Former President Donald Trump reacts during a news conference after attending the wake of New York City police officer Jonathan Diller, Thursday, March 28, 2024, in Massapequa Park, New York. But to avoid any doubt, this Court should now clarify or confirm that the Order protects family members of the Court, the District Attorney, and all other individuals mentioned in the Order,\u201d prosecutor Joshua Steinglass <a href=\"https:\/\/www.scribd.com\/document\/718310206\/2024-03-28-People-People-s-Pre-Motion-Letter-FILED\" target=\"_blank\" rel=\"noopener\" title=\"wrote\">wrote<\/a> in a letter\u00a0to the judge.<\/p>\n<p>In response to Steinglass\u2019s Thursday letter, which became publicly available on Friday, Trump\u2019s counsel <a href=\"https:\/\/www.scribd.com\/document\/718310570\/2024-03-29-Letter-to-Justice-Merchan\" target=\"_blank\" rel=\"noopener\" title=\"filed\">filed<\/a> their own pre-motion arguing that \u201cContrary to the People\u2019s suggestion, the Court cannot \u2018direct\u2019 President Trump to do something that the gag order does not require.\u201d<\/p>\n<p>\u201cTo \u2018clarify or confirm\u2019 the meaning of the gag order in the way the People suggest would be to expand it,\u201d Trump attorneys Todd Blanche and Susan Necheles wrote, adding that the district attorney\u2019s office failed to make their case \u201con the basis of a one-page letter citing only two cases.\u201d<\/p>\n<div>\n<p>Attorneys with Bragg\u2019s office were clear in their Thursday letter to Merchan that they believe the gag order should apply to Merchan\u2019s family but stopped short of saying the order should apply to the judge himself.<\/p>\n<p>The March 26 gag order limits Trump from making statements about potential witnesses, attorneys, court staff, or other family members of prosecutors or lawyers but left open the ability for Trump to speak about Bragg.<\/p>\n<\/div>\n<p>Eric Columbus, former special litigation counsel for the House of Representatives, speculated that the purpose of the letter from Bragg\u2019s office is to \u201cmake crystal-clear that Trump cannot attack his family.\u201d<\/p>\n<p>\u201cGag order, read fairly, encompasses the DA\u2019s family, but not 100% clear. Judge\u2019s daughter discussed just for optics,\u201d Columbus wrote in a <a href=\"https:\/\/twitter.com\/EricColumbus\/status\/1773827925034344822\" target=\"_blank\" rel=\"noopener\" title=\"post\">post<\/a> on X, formerly known as Twitter.<\/p>\n<p>Steinglass also warned Trump should \u201cimmediately desist\u201d from future violations of the order, and that if he doesn\u2019t, he should be held accountable under two sections of New York judiciary law that pertain to criminal contempt.<\/p>\n<p>Trump has ramped up his attacks on those involved in his hush money case as his trial date approaches. Merchan at a Monday hearing refused Trump\u2019s lawyers request to postpone the trial past its April 15 start date.<\/p>\n<p>Trump\u2019s lawyers cited two media reports in their letter, one from the Associated Press, crediting the outlet for \u201cexplaining that the gag order \u2018does not bar comments about Merchan or his family.&#8217;\u201d A separate article from <em>Forbes <\/em>is credited for \u201cexplaining that social media posts at issues \u2018are not barred by the gag order issued earlier this week.&#8217;\u201d<\/p>\n<p>The filings come one day after a U.S. District Court Judge Reggie Walton, an appointee of former President George W.
