This\u2063 bill may signal \u2064forthcoming national \u200cvaping regulations, highlighting worries about youth vaping and deceptive product labeling \u2062for customs avoidance.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>A proposed vaping ban in <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/florida\/\" target=\"_blank\" rel=\"noopener\" title=\"Florida\">Florida<\/a> could find its way to the national stage as lawmakers look to crack down on illicit products being brought into the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/united-states\/\" target=\"_blank\" rel=\"noopener\" title=\"United States\">United States<\/a> from foreign countries.\u00a0<\/p>\n<p>The Florida legislature <a href=\"https:\/\/floridapolitics.com\/archives\/664164-legislature-approves-flavor-targeting-vape-restrictions-but-exempts-e-liquids\/\">passed a bill<\/a> earlier this month to implement stricter restrictions on flavored vape products and allow the state attorney general to compile a registry of products that are deemed attractive to minors. Once a product is added to the list, vendors have 60 days to remove it from their inventory.\u00a0<\/p>\n<p>The bill has passed through both chambers in the state legislature and awaits Gov. Ron DeSantis\u2019s (R-FL) signature to take effect. It\u2019s unclear when DeSantis plans to take action on the bill, and the <em>Washington Examiner<\/em> contacted his office for comment. <\/p>\n<p>Advocates of the bill praised its passage, arguing the legislation is needed to address the <a href=\"https:\/\/floridapolitics.com\/archives\/619594-frf-warns-consumers-about-illegal-potentially-deadly-vaping-products\/\">rising number of possibly dangerous vapes<\/a> being brought into the country, particularly in Florida. Lawmakers have called for stricter enforcement of federal regulations on these products, prompting some states to take further action.\u00a0<\/p>\n<p>\u201cThe federal regulations that are in place, there\u2019s really no enforcement mechanism from the feds,\u201d Ned Bowman, president of the Florida Petroleum Marketers Association, told the <em>Washington Examiner. <\/em>\u201cI mean, the amount of vaping and the amount of imports that are coming in from China \u2014 it\u2019s very difficult for the FDA, within their budget means, to stop all the products.\u201d<\/p>\n<p><a href=\"https:\/\/vaping360.com\/vape-news\/129685\/utah-governor-signs-flavor-ban-and-pmta-registry-bill\/\">At least six states<\/a> have already implemented some form of a ban on flavored vaping products, and five states have some sort of registry bills. Roughly two dozen other states are currently debating registry bills that would further restrict what products can be sold in stores. <\/p>\n<p>A handful of senators on both sides of the aisle have called on the FDA to crack down on the number of illegal vapes coming into the country from China, such as Sens. Dick Durbin (D-IL) and Tom Cotton (R-AR). Now, with the passage of Florida\u2019s proposed ban, similar proposals could find their way into the halls of Congress.<\/p>\n<p>\u201cWe\u2019ve had constituents and law enforcement reach out about the CCP-made vapes, and even some that have fentanyl,\u201d a Senate staffer told the <em>Washington Examiner. <\/em>\u201cGood for Florida to get ahead of this. I expect several senators will introduce similar legislation at the federal level.\u201d\u00a0<\/p>\n<p>Florida\u2019s bill comes as Chinese manufacturers have managed to dodge U.S. customs and taxes to import e-cigarettes into the country, according to public records and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-bureau-of-land-management-nominee-tracy-stone-manning-was-involved-in-eco-terrorism-case-resulted-in-college-roommates-conviction-prison-sentence-court-records-show\/\" title=\"Biden Bureau Of Land Management Nominee Tracy Stone-Manning Was Involved In \u2018Eco-Terrorism\u2019 Case, Resulted In College Roommate\u2019s Conviction, Prison Sentence, Court Records Show\">court documents obtained<\/a> and reviewed by the <em>Associated Press. <\/em>Manufacturers have imported products that are worth hundreds of millions of dollars, all while avoiding efforts by the U.S. government to block products that encourage teenage vaping.\u00a0<\/p>\n<p>Manufacturers have managed to dodge customs by mislabeling their shipments as \u201cbattery chargers\u201d or \u201cflashlights,\u201d among other things, to evade detection.\u00a0<\/p>\n<p>\u201cSome of these vapes are coming in and \u2026 they\u2019re saying a different product than actually what they are,\u201d Bowman said. \u201cSo by this rule, by the legislature passing it, we\u2019re hoping to slow down and stop the vape pens from being sold to kids.\u201d<\/p>\n<p>\u201cAnd, again, going back to the vape pens,\u201d he added, \u201cwe don\u2019t know from the citizen standpoint or from the state of Florida standpoint what is actually in these vape pens, what chemicals, because there\u2019s no regulation.\u201d<\/p>\n<p>Top lawmakers in the Senate have begun efforts to limit the products being sold in convenience stores, with chairmen of five key Senate committees warning wholesalers they may be in violation of federal law. As part of that warning, the senators urged the FDA to \u201cdo more\u201d to restrict the products.<\/p>\n<p>\u201cF.D.A. and the industry must do more to address the youth vaping epidemic and remove unauthorized vaping products from their shelves immediately,\u201d Durbin said earlier this month.\u00a0<\/p>\n<p>Advocates are calling on lawmakers to follow the lead of the Florida proposal, arguing it\u2019s an effort that must be addressed by all corners of the federal government to rein in.\u00a0<\/p>\n<p>\u201cIt has to be a combined effort between the community, the federal government, and local government,\u201d said Rich Marianos, former deputy director of the Bureau of Alcohol, Tobacco, Firearms and Explosives. \u201cIt needs to be a three-front war and an aggressive war that you can\u2019t back down to.\u201d<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\"><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p>Lawmakers are also calling on the FDA to complete its review of e-cigarette sales applications in order to eliminate illicit vapes from the market.
