The lawsuit questions the legality of the $144 billion loan forgiveness plan and highlights potential taxpayer expenses nearing $475 billion.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Kansas and other GOP-led states have sued the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/biden-administration\" target=\"_blank\" rel=\"noopener\" title=\"Biden administration\">Biden administration<\/a> over its plans to cancel <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/student-loans\" target=\"_blank\" rel=\"noopener\" title=\"student loans\">student loans<\/a>. <\/p>\n<p>President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/joe-biden\/\" target=\"_blank\" rel=\"noopener\" title=\"Joe Biden\">Joe Biden<\/a> has announced $144 billion in student loan forgiveness since his original plan was struck down by the Supreme Court and devised a new plan to lower future payments that could cost taxpayers another <a href=\"https:\/\/budgetmodel.wharton.upenn.edu\/issues\/2023\/7\/17\/biden-income-driven-repayment-budget-update\" target=\"_blank\" rel=\"noopener\" title=\"$475 billion\">$475 billion<\/a>. <\/p>\n<p>Kansas Attorney General Kris Kobach <a href=\"https:\/\/freebeacon.com\/columns\/why-kansas-plans-to-sue-the-biden-administration-over-the-latest-student-loan-gambit\/\" target=\"_blank\" rel=\"noreferrer noopener\">announced<\/a>\u00a0in February that he planned to file suit but did not provide an exact time frame for when that would happen. His state and 10 others ultimately submitted their lawsuit on Thursday in the United States District Court for the District of Kansas.<\/p>\n<p>\u201cLast time defendants tried this the Supreme Court said that this action was illegal,\u201d reads a portion of the suit. \u201cNothing since then has changed, other than introducing more legal errors into this rule\u2019s underlying analysis.\u201d <\/p>\n<p>The suit, which names Biden, Education Secretary Miguel Cardona, and the U.S. Department of Education as defendants, sets up a second round of legal battles between red states and the Biden administration over student loans. <\/p>\n<p>Biden announced in August 2022 a plan to \u201cforgive\u201d at least $400 billion in students loans in amounts of up to $20,000 per person. <\/p>\n<p>That plan was not approved by Congress, leading Kansas and other states to sue the Department of Education within weeks arguing it was unconstitutional. The Supreme Court agreed, striking the program down in a <a href=\"https:\/\/www.washingtonexaminer.com\/news\/1533584\/supreme-court-strikes-down-bidens-costly-student-loan-relief-plan\/\" target=\"_blank\" rel=\"noopener\" title=\"6-3 ruling\">6-3 ruling<\/a> last June. <\/p>\n<p>Biden wasted little time attempting to work around the ruling, announcing that 804,000 borrowers would have $39 billion of their student debt transferred to the public debt just two weeks later. He\u2019s announced a steady trickle of new rounds since then, totaling roughly $144 billion affecting 4 million borrowers. <\/p>\n<p>The original plan rested on the HEROES Act of 2003 for its legal justification, while more recent moves <a href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/2932356\/how-biden-defied-supreme-court-to-cancel-144-billion-in-student-loans\/\" target=\"_blank\" rel=\"noopener\" title=\"rely on\">rely on<\/a> the Higher Education Act of 1965. <\/p>\n<p>But Kansas and the other states \u2014 Alabama, Alaska, Idaho, Iowa, Louisiana, Montana, Nebraska, South Carolina, Texas, and Utah \u2014 say the new plan is just as illegal.<\/p>\n<p>\u201cThis lawsuit is now necessary to prevent defendants from continuing to flout the law, which includes ignoring Supreme Court decisions,\u201d the suit reads. <\/p>\n<p>An even bigger issue may be the Saving on a Valuable Education,\u00a0<a href=\"https:\/\/www.washingtonexaminer.com\/news\/2452005\/biden-launches-student-loan-website-for-save-debt-relief-plan\/\" target=\"_blank\" rel=\"noreferrer noopener\">or SAVE, Plan<\/a>,\u00a0under which <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/teachers-unions-aclu-want-biden-to-extend-student-loan-repayment-pause-cancel-student-debt\/\" title=\"Teachers Unions, ACLU Want Biden To Extend Student Loan Repayment Pause, Cancel Student Debt\">monthly student loan payments<\/a> are as low as $0 for lower-income borrowers and loans can be written off completely after as little as 10 years.<\/p>\n<p>The SAVE Plan was not approved by Congress and, similar to loan forgiveness, has generated controversy because any <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/kamala-harris-launches-day-of-action-to-boost-student-loans-program\/\" title=\"Kamala Harris initiates 'Day of Action' to enhance student loan program\">unpaid debts fall<\/a> on taxpayers. The Penn-Wharton Budget Model\u00a0<a href=\"https:\/\/budgetmodel.wharton.upenn.edu\/issues\/2023\/7\/17\/biden-income-driven-repayment-budget-update\" target=\"_blank\" rel=\"noreferrer noopener\">estimates<\/a>\u00a0that SAVE could cost $475 billion over 10 years.<\/p>\n<p>Biden has been explicit in his defiance of the high court. <\/p>\n<p>\u201cThe Supreme Court blocked it. They blocked it,\u201d Biden said on Feb. 21 in a speech about SAVE. \u201cBut that didn\u2019t stop me. I announced we were going to pursue alternative paths for student debt relief for as many borrowers as possible. And that\u2019s the effort that\u2019s been underway the last two years.\u201d<\/p>\n<p>Advocates for student loan forgiveness say it will remove debt burdens from young people who attended college, allowing them to focus on bigger life goals such as buying a home or starting a family. Detractors say the plans would result in blue-collar workers who didn\u2019t go to college paying off the loans of white-collar workers who did. <\/p>\n<p>The White House has not commented on the new lawsuit, but a Department of Education spokesperson described it as an attempt by Kansas officials to hurt their own constituents.<\/p>\n<p>\u201cIn Kansas, nearly 1,300 borrowers have already received $9.9 million in debt relief under the Biden-Harris Administration\u2019s SAVE plan, and 60,000 Kansas borrowers are saving money on their payments month after month because of SAVE,\u201d the spokesperson said. \u201cThe Biden-Harris Administration won\u2019t stop fighting to provide support and relief to borrowers across the country \u2014 no matter how many times Republican elected officials try to stop us.\u201d<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/a><\/strong><\/p>\n<p>The lawsuit cites other times when Biden took unilateral action that was struck down in court, including an eviction moratorium the president extended in 2021. <\/p>\n<p>\u201cAlthough this round of unilateral debt nullification takes on a new name, with a different putative authority, it is every bit as improper as his first unlawful attempt at debt forgiveness in <em>Biden v.
