Facing 11 disciplinary charges, Eastman&#8217;s case is advancing to the\u2063 California Supreme Court for a conclusive decision.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>A judge ruled that former President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\/\" target=\"_blank\" rel=\"noopener\" title=\"John Eastman\">Donald Trump\u2019s<\/a> lawyer <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2437675\/john-eastman-defends-2020-election-conduct-in-interview-ahead-of-arraignment\/\" target=\"_blank\" rel=\"noopener\" title=\"John Eastman\">John Eastman<\/a> should be disbarred for his attempts to overturn the 2020 election.<\/p>\n<p>State Bar Court of California Judge Yvette Roland <a href=\"https:\/\/www.documentcloud.org\/documents\/24521380-sbc-23-o-30029-decision-trial\" target=\"_blank\" rel=\"noopener\" title>announced her ruling<\/a> Wednesday. Hong, File)<\/figcaption><\/figure>\n<p>\u201cIn view of the circumstances surrounding Eastman\u2019s misconduct and balancing the aggravation and mitigation, the court recommends that Eastman be disbarred,\u201d Roland wrote in her decision. The recommendation will now go to the California Supreme Court for a final ruling.<\/p>\n<p>Roland\u2019s ruling marks a defeat for Eastman, though she did side with him on one of his 11 counts.\u00a0<\/p>\n<p>The state bar accused Eastman of moral turpitude over a speech he gave on Jan. 6 at the Ellipse outside the White House, tying it to the riot later in the day, but the judge dismissed the count after holding the bar \u201cpresented no evidence to show that Eastman\u2019s statements contributed to the assault on the Capitol.\u201d<\/p>\n<p>In early November, Roland found Eastman culpable for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/house-censures-paul-gosar-strips-him-of-committee-seats-over-ocasio-cortez-video\/\" title=\"House Censures Paul Gosar, Strips Him Of Committee Seats Over Ocasio-Cortez Video\">multiple ethics violations<\/a>, a tentative ruling that gave the Office of Chief Trial Counsel more time to consider further evidence that could have strengthened their argument for a harsher punishment.<\/p>\n<p>Eastman, a former Chapman University law school dean, faced 11 counts of ethical and legal violations for his post-2020 election activities ahead of the Jan. 6 Capitol attack. He and Trump, along with 17 others, were also charged in Georgia over an alleged plot to overturn the election results in August last year.<\/p>\n<p>The lawyer and constitutional law professor defended himself against the ethical violations by saying he was advising then-President Trump as a client, advice that included suggesting to then-Vice President Mike Pence that the electoral count be suspended so state legislatures could investigate alleged illegalities or election irregularities, concerns he said were \u201cwell-grounded in fact and anything but frivolous.\u201d No evidence of election interference on a large scale has been found.<\/p>\n<p>Eastman\u2019s trial in California began in June and continued intermittently until early November. <\/p>\n<p>An initial complaint was filed in October 2021 by the group States United Democracy Center, a left-leaning election law organization founded by Obama-era White House \u201cEthics Czar\u201d Norm Eisen, and the state bar brought its case in early 2023.<\/p>\n<p>Christine P. Sun, States United\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/senate-confirms-kathleen-hicks-as-deputy-defense-secretary\/\" title=\"Senate Confirms Kathleen Hicks as Deputy Defense Secretary\">senior vice president<\/a> of legal, previously said Roland\u2019s preliminary findings in November revealed \u201cEastman had no legal or factual basis for his plan to help Donald Trump steal the 2020 presidential election,\u201d <a href=\"https:\/\/statesuniteddemocracy.org\/eastman-preliminary-finding\/\" target=\"_blank\" rel=\"noopener\" title=\"according\">according<\/a> to a statement from Nov. 2.<\/p>\n<p>The trial featured several witnesses from both sides, including a former Wisconsin Supreme Court justice who testified on Eastman\u2019s behalf, along with former Justice Department attorney John Yoo and U.S. Court of Appeals Judge Janice Rogers Brown. The state bar called on a former chief counsel to then-Vice President Pence, among other witnesses.<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noopener\" title><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p>In the Georgia case, prosecutors have charged Eastman with eight counts, including racketeering and solicitation of violation of oath by a public officer.
