Scarsi expressed doubts about political influence \u200con\u2063 the case.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Judge Mark Scarsi appeared skeptical during a hearing in <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/los-angeles\" target=\"_blank\" rel=\"noopener\" title>Los Angeles<\/a> on Wednesday as <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/hunter-biden\" target=\"_blank\" rel=\"noopener\" title>Hunter Biden<\/a>\u2018s attorney argued that the first son\u2019s nine tax charges should be dropped.<\/p>\n<p>Scarsi, an appointee of former President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\" target=\"_blank\" rel=\"noopener\" title>Donald Trump<\/a>, scrutinized attorney Abbe Lowell\u2019s claim that the Department of Justice\u2019s charges against Biden were the result of a Republican pressure campaign, as well as the claim that a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/special-counsel-rejects-hunter-biden-misleading-plea-deal-claims\/\" title=\"Special counsel denies Hunter Biden's 'misleading' plea deal allegations.\">defunct plea deal<\/a> also shielded the first son from charges, according to reports from the courtroom.<\/p>\n<p>Lowell was present at the hearing, as was special counsel David Weiss. Biden waived his appearance and did not attend. <\/p>\n<p>Biden\u2019s attorneys had argued in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/former-nfl-star-sentenced-to-prison-over-deadly-dui-crash\/\" title=\"Ex-NFL star jailed for fatal DUI accident.\">court filings ahead<\/a> of the hearing that the tax charges should be dismissed for numerous reasons, including that Weiss\u2019s prosecution was \u201cselective and vindictive\u201d and had been \u201ccompromised by politics.\u201d<\/p>\n<p>\u201cThis case follows a nearly six-year record of the DOJ changing its charging decisions and upping the ante on Mr. Biden in direct response to political pressure and its own self-interests,\u201d defense attorneys wrote in their motion.<\/p>\n<p>On Wednesday, Scarsi said, according to ABC News, that the argument <a href=\"https:\/\/abcnews.go.com\/US\/attorneys-hunter-biden-return-court-bid-toss-tax\/story?id=108513232\" target=\"_blank\" rel=\"noopener\" title>seemed<\/a> to present \u201csmoke\u201d without \u201cfire.\u201d<\/p>\n<p>\u201cThere doesn\u2019t seem to be any evidence\u201d that pressure from Republicans \u201cinfluenced the prosecutors\u2019 decision other than the timeline,\u201d Scarsi said.<\/p>\n<p>Biden\u2019s attorneys had also argued in court filings that a now-withdrawn plea deal Biden reached last summer with Weiss granted the first son \u201csweeping immunity\u201d that protected him from future charges. The agreement involved Biden pleading guilty to misdemeanor tax charges, but Weiss has argued that a probation office never signed off on the agreement and it was therefore never executed.<\/p>\n<p>Scarsi also challenged the notion that the plea agreement had been executed, <a href=\"https:\/\/www.cnn.com\/2024\/03\/27\/politics\/hunter-biden-tax-charges-hearing-los-angeles\/index.html\" target=\"_blank\" rel=\"noopener\" title>saying<\/a> that a \u201cnatural reading\u201d of the agreement would indicate that it was missing a necessary signature, according to CNN.<\/p>\n<p>In a separate case, Weiss indicted former FBI informant Alexander Smirnov last month for allegedly lying to the FBI about Joe and Hunter Biden to hurt Joe Biden\u2019s political prospects ahead of the 2020 election.<\/p>\n<p>Smirnov\u2019s attorney David Chesnoff was present for Hunter Biden\u2019s hearing on Wednesday, according to an NBC reporter.
