Texas will face limitations as the law remains on hold. Texas\u200d will\u2062 be constrained as the law stays suspended.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p><span style=\"font-weight: 400\">A <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/title-42-may-end-as-soon-as-april\/\" title=\"Title 42 May End as Soon as April\">federal appeals court panel<\/a> on Tuesday extended a block of a <a href=\"https:\/\/www.dailywire.com\/topic\/texas\" target=\"_blank\" rel=\"noopener\">Texas<\/a> law that would allow state authorities to arrest and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-appeals-court-places-texas-immigration-law-on-hold-again-after-scotus-allowed-it-to-take-effect\/\" title=\"Federal Appeals Court Suspends Texas Immigration Law Following SCOTUS Approval\">deport immigrants suspected<\/a> of entering the U.S. illegally, prompting a stern dissent from the court\u2019s lone dissenter.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The 2-1 <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ca5.218049\/gov.uscourts.ca5.218049.163.0.pdf\" target=\"_blank\" rel=\"noopener\">decision<\/a> from a panel on the Fifth Circuit Court of Appeals comes after a month of legal back and forth on the law, also known as SB 4. The majority opinion said that Texas would not likely succeed in its argument that the law was constitutional and necessary because the federal government has historically had exclusive control over immigration law.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cFor nearly 150 years, the Supreme Court has held that the power to control immigration \u2014 the entry, admission and removal of noncitizens \u2014 is exclusively a federal power,\u201d Judge Priscilla Richman, a George W. Bush appointee, <a href=\"https:\/\/www.nytimes.com\/2024\/03\/27\/us\/texas-migrant-law-appeals-court.html\" target=\"_blank\" rel=\"noopener\">wrote<\/a>. \u201cTexas has not shown that it is likely to succeed on the merits \u2026\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">Judge Irma Ramirez, an appointee of President Joe Biden, signed onto Richman\u2019s decision, while Judge Andrew Oldham, an appointee of former President Donald Trump, dissented. Oldman said that the majority\u2019s ruling would harm Texas, making the state \u201cforever helpless.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cTexas can do nothing because Congress apparently did everything, yet federal non-enforcement means Congress\u2019s everything is nothing. And second, while the dispute before us is entirely hypothetical, the consequences of today\u2019s decision will be very real,\u201d Oldham said.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The law, which was set to take effect on March 5, was blocked by a federal judge on February 29. After an appeal by Texas, the Fifth Circuit Court of Appeals <a href=\"https:\/\/www.dailywire.com\/news\/appeals-court-reverses-block-on-texas-law-allowing-police-to-arrest-illegal-immigrants\" target=\"_blank\" rel=\"noopener\">said<\/a> that the law could take effect while the case made its way through the courts and put a hold on its ruling for seven days to allow time for the Biden administration to take the case to the Supreme Court.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The Supreme Court<\/span><a href=\"https:\/\/www.dailywire.com\/news\/supreme-court-extends-stay-preventing-texas-from-enforcing-immigration-law\"><span style=\"font-weight: 400\">\u00a0extended<\/span><\/a><span style=\"font-weight: 400\"> the hold on SB 4 <\/span><a href=\"https:\/\/www.dailywire.com\/news\/scotus-indefinitely-blocks-texas-law-allowing-police-to-arrest-illegal-immigrants\"><span style=\"font-weight: 400\">multiple<\/span><\/a><span style=\"font-weight: 400\"> times before rejecting an emergency appeal from the Biden administration to block the law while it made its way through the lower courts. Just hours after the Supreme Court allowed the law to take effect, the Fifth Circuit placed <\/span><a href=\"https:\/\/www.dailywire.com\/news\/federal-appeals-court-places-texas-immigration-law-on-hold-again-after-scotus-allowed-it-to-take-effect\"><span style=\"font-weight: 400\">another hold<\/span><\/a><span style=\"font-weight: 400\"> on the law, which it extended on Tuesday.\u00a0<\/span><\/p>\n<p><b><a href=\"https:\/\/onelink.to\/dwapp\" target=\"_blank\" rel=\"noopener noreferrer\" aria-describedby=\"sk-tooltip-9096\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/onelink.to\/dwapp&#038;source=gmail&#038;ust=1700760801843000&#038;usg=AOvVaw2PQrVSrJfhxNb4LcARqniG\">CLICK HERE TO GET THE DAILYWIRE+ APP<\/a><\/b><\/p>\n<p><span style=\"font-weight: 400\">Oldham\u2019s dissent said that the Biden administration had no standing to sue Texas and that it would harm the state\u2019s right to self-government.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cMany people will be understandably frustrated by today\u2019s ruling,\u201d Oldham wrote. \u201cA high-profile state statute \u2014 duly enacted by the people\u2019s representatives to address a problem that Texans personally experience \u2014 likely will never go into effect. Why? Because a federal district judge enjoined the law in its entirety before anyone ever used it to do anything. And because today\u2019s majority opinion does not let state officials and state judges attempt to implement the state law passed by the state legislature and signed by the Texas Governor.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">Oldham also wrote that the crisis at the southern border was in part due to the Biden administration\u2019s decision to release more than <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/newt-gingrich-the-biden-opportunity-for-republicans\/\" title=\"Newt Gingrich: The Biden Opportunity For Republicans\">3 million illegal immigrants<\/a> into the country.
