Meanwhile, a federal judge ruled \u2064in favor of illegal\u200b immigrants&#8217; gun\u200b rights, sparking controversy. This\u2062 ruling \u2063highlights ongoing debates on gun control \u200band immigration laws, posing challenges for law\u200c enforcement and citizens alike. \u200dThe Biden Administration&#8217;s backing \u2063of &#8220;red flag laws&#8221; \u2064to combat gun violence has \u200bsparked apprehension \u2064among Second\u2063 Amendment advocates. Concurrently, a federal judge&#8217;s decision favoring gun rights for illegal immigrants has stirred controversy, underscoring the contentious \u200bdiscussions around gun control and\u200c immigration policies, presenting dilemmas for both law\u200c enforcement and the general public.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p><span style=\"font-weight: 400\">The Biden Administration continues to champion efforts to take legally purchased guns away from American citizens after Vice President Kamala Harris <\/span><a href=\"https:\/\/www.dailywire.com\/news\/vp-harris-pushes-gun-control-in-parkland-visit-promotes-new-push-for-red-flag-laws\"><span style=\"font-weight: 400\">touted<\/span><\/a><span style=\"font-weight: 400\"> \u201cred flag laws\u201d as an effort to tackle gun violence during a recent visit to Parkland, FL.<\/span><\/p>\n<p><span style=\"font-weight: 400\">During her visit, the vice president announced the creation of a national office that would focus on the implementation of <\/span><a href=\"https:\/\/www.theguardian.com\/us-news\/2024\/mar\/23\/red-flag-laws-gun-control\"><span style=\"font-weight: 400\">red flag laws<\/span><\/a><span style=\"font-weight: 400\"> in states that currently have these laws in place. The Department of Justice (DOJ) would oversee the office which raises alarm bells for supporters of the Second Amendment and Republican <\/span><a href=\"https:\/\/www.foxnews.com\/politics\/republicans-blast-biden-admins-red-flag-operation-will-violate-second-amendment-rights\"><span style=\"font-weight: 400\">lawmakers<\/span><\/a><span style=\"font-weight: 400\"> on Capitol Hill are raising concerns that this so-called \u201cred flag\u201d operation would indeed violate the Constitution.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Meanwhile, the courts are telling American citizens that illegal immigrants have the right to legally possess a weapon after an Obama-appointed federal judge in Illinois <\/span><a href=\"https:\/\/www.foxnews.com\/politics\/judge-rules-illegal-immigrants-have-gun-rights-protected-second-amendment\"><span style=\"font-weight: 400\">ruled<\/span><\/a><span style=\"font-weight: 400\"> that our Constitution protects the rights of individuals who enter this country illegally.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Law-abiding American citizens are frustrated, and they have a right to be.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Approximately 986 different bills to restrict gun <\/span><a href=\"https:\/\/www.billtrack50.com\/blog\/important-gun-law-changes-in-2023\/\"><span style=\"font-weight: 400\">rights<\/span><\/a><span style=\"font-weight: 400\"> were introduced in the first half of 2023, according to the most recent data available.<\/span><\/p>\n<p><span style=\"font-weight: 400\">My home state of Illinois enacted a law in 2023, <\/span><a href=\"https:\/\/www.ilga.gov\/legislation\/publicacts\/102\/PDF\/102-1116.pdf\"><span style=\"font-weight: 400\">Public Act 102-1116<\/span><\/a><span style=\"font-weight: 400\">, which prohibits the sale and distribution of so-called \u201cassault weapons\u201d and high-capacity magazines. Citizens who owned these previously legal weapons could keep them, only if they <\/span><a href=\"https:\/\/isp.illinois.gov\/Home\/AssaultWeapons#:~:text=Illinois%20residents%20cannot%20lawfully%20purchase,e)%20within%20the%20link%20above.\"><span style=\"font-weight: 400\">registered<\/span><\/a><span style=\"font-weight: 400\"> their weapons with the State.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Gun laws do not stop criminals from using guns while committing crimes. Criminals, by definition, do not care about gun laws. <\/span><a href=\"https:\/\/crsreports.congress.gov\/product\/pdf\/IF\/IF11121\/1\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">Federal law<\/span><\/a><span style=\"font-weight: 400\"> requires a criminal background check for all firearm sales and transfers by licensed dealers. The challenge is that most criminals do not legally obtain their guns.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Moreover, semi-automatic weapons are not the weapon of choice when committing a crime. According to <\/span><a href=\"https:\/\/www.pewresearch.org\/short-reads\/2023\/04\/26\/what-the-data-says-about-gun-deaths-in-the-u-s\/\"><span style=\"font-weight: 400\">Pew Research Center<\/span><\/a><span style=\"font-weight: 400\">, in 2020 \u201chandguns were involved in 59% of gun murders and non-negligent manslaughters. Rifles \u2014 the category that includes \u201cassault weapons\u201d \u2013 were involved in 3% of firearm murders.\u201d This means that approximately 408 people were killed by semi-automatic firearms in 2020.<\/span><\/p>\n<p><span style=\"font-weight: 400\">In <\/span><a href=\"https:\/\/www.inquirer.com\/news\/philadelphia-gun-arrests-2021-convictions-vufa-20210330.html\"><span style=\"font-weight: 400\">Philadelphia<\/span><\/a><span style=\"font-weight: 400\">, people who are accused of illegally carrying a gun have seen their chances of being convicted in court decline from 63% in 2017 to 49% in 2019.<\/span><\/p>\n<p><span style=\"font-weight: 400\">This is why the recent ruling by an Obama-appointed district court judge for the Northern District of Illinois, Sharon Johnson Coleman, is so concerning.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Judge Coleman ruled that a federal ban on <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/what-will-scotus-say-about-illegals-owing-guns\/\" title=\"What will the Supreme Court decide regarding undocumented immigrants owning firearms\">undocumented immigrants owning firearms<\/a> is <\/span><a href=\"https:\/\/nypost.com\/2024\/03\/20\/us-news\/illinois-judge-rules-illegal-migrants-can-carry-guns\/\"><span style=\"font-weight: 400\">unconstitutional<\/span><\/a><span style=\"font-weight: 400\"> and dismissed charges against an illegal named Heriberto Carbajal-Flores, who was arrested in 2020 for violating a federal law which prohibits non-citizens from possessing guns. Judge Coleman\u2019s ruling stated that since this illegal immigrant had no criminal record, and the circumstances behind his arrest were not violent, he should not be deprived of his Second Amendment right to bear arms.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Case in point, being in the United States illegally was not enough cause to deny this individual his Second Amendment rights.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Judge Coleman seems to have forgotten one important fact; being in the country illegally is a violation of 8 U.S.C. \u00a7 1325, which makes it a <\/span><a href=\"https:\/\/www.americanimmigrationcouncil.org\/research\/immigration-prosecutions#:~:text=%C2%A7%201325%20makes%20it%20a,entering%20or%20attempting%20to%20enter.\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">felony<\/span><\/a><span style=\"font-weight: 400\"> to unlawfully enter the United States.<\/span><\/p>\n<p><span style=\"font-weight: 400\">In <\/span><a href=\"https:\/\/www.williamsnickl.com\/can-i-own-a-gun-after-a-felony-conviction-in-illinois\/#:~:text=Once%20you%20are%20convicted%20of,in%20the%20last%2020%20years\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">Illinois<\/span><\/a><span style=\"font-weight: 400\">, it is illegal for a person convicted of a felony to possess a firearm.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Any person desiring to legally purchase a firearm in the state of Illinois must obtain a Firearms Owners Identification Card (FOID Card). To be eligible for a <\/span><a href=\"https:\/\/www.ispfsb.com\/Public\/Faq.aspx#:~:text=To%20be%20eligible%20for%20a,been%20convicted%20of%20a%20felony.\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">FOID<\/span><\/a><span style=\"font-weight: 400\"> card, amongst other regulations, a person must not be an alien who is lawfully present in the United States.<\/span><\/p>\n<p><span style=\"font-weight: 400\">You cannot even enter a gun shop or buy ammunition without a FOID card in the state of Illinois.<\/span><\/p>\n<p><span style=\"font-weight: 400\">So, this individual\u2019s firearm must have been illegally obtained which is another federal violation. Yet, this Obama-appointed judge ruled that he could keep his weapon and cannot be prosecuted for any of his numerous crimes.<\/span><\/p>\n<p><span style=\"font-weight: 400\">On the flip side, a law-abiding American citizen in Illinois, who legally obtains a firearm is now, by definition, a felon, for not registering his or her weapon with the state police.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The Biden administration\u2019s DOJ may want to think twice before coming after a citizen\u2019s right to bear arms \u2014 a right guaranteed by our Constitution.
