The scholarship, available since June 2020, awards a four-year full-tuition scholarship\u200b based on community recommendations and an \u200cessay. The\u200d complaint, filed by William\u200b Jacobson, contends that the \u2062eligibility criteria are racially discriminatory, breaching Title VI of \u200cthe Civil Rights\u2064 Act.  <\/p>\n<p only to \u201cBlack or African American, that is, a person having origins in any of the black racial groups of Africa,\u201d students violates the Civil Rights Act, a federal complaint says.<\/p>\n<p>North Central University in Minneapolis, Minnesota, has offered the scholarship since June 2020, and says on its <a href=\"https:\/\/www.northcentral.edu\/george-floyd-scholarship-fund\/george-floyd-memorial-scholarship-application\/\" target=\"_blank\" rel=\"noopener\">website<\/a> that the memorial scholarship \u201cis a four-year, full-tuition scholarship awarded to one student each year based on two community recommendations and a written essay.\u201d<\/p>\n<p>William Jacobson, a Cornell Law professor who runs the conservative website Legal Insurrection and founded the Equal Protection Project, filed <a href=\"https:\/\/www.scribd.com\/document\/717276341\/Equal-Protection-Project-OCR-complaint-against-North-Central-University\" target=\"_blank\" rel=\"noopener\">a complaint<\/a> with the U.S. Department of Education\u2019s Office for Civil Rights in Chicago, alleging the scholarship violates Title VI of the Civil Rights Act of 1964, which prohibits schools from discriminating based on race.<\/p>\n<p>\u201cThe George Floyd Scholarship eligibility requirements are openly racially discriminatory,\u201d Jacobson <a href=\"https:\/\/www.thecollegefix.com\/george-floyd-scholarship-violates-civil-rights-law-federal-complaint\/\" target=\"_blank\" rel=\"noopener\">told\u00a0<\/a>The College Fix. \u201cRegardless of the purpose of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/a-survival-guide-for-conservatives-during-the-biden-years\/\" title=\"A Survival Guide for Conservatives During the Biden Years\">racial discrimination<\/a>, it is wrong and unlawful.\u201d<\/p>\n<p>\u201cNCU needs to come up with a remedial plan to compensate students shut out of the George Floyd Scholarship due to discrimination,\u201d Jacobson added.<\/p>\n<p>In addition to violating the federal Civil Rights Act, the scholarship also violates Minnesota\u2019s Human Rights Act, Jacobson\u2019s complaint alleges.<\/p>\n<p>\u201cSimilarly, the [scholarship] defies the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-touts-equality-act-in-proclamation-for-pride-month\/\" title=\"Biden Touts Equality Act In Proclamation For Pride Month\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/sidney-powell-is-an-american-legal-giant\/\" title=\"Sidney Powell Is an American Legal Giant\">civil rights<\/a> protections<\/a> of Minnesota\u2019s Human Rights Act, which makes it a criminal offense for an educational institution to limit access to any educational program on the basis of race,\u201d a footnote in the complaint says.<\/p>\n<p>Jacobson also told The College Fix that the Supreme Court\u2019s decision last year on affirmative action should make clear that discriminating based on race is illegal.<\/p>\n<p><b><a href=\"https:\/\/onelink.to\/dwapp\" target=\"_blank\" rel=\"noopener noreferrer\" aria-describedby=\"sk-tooltip-9096\" APP<\/a><\/b><\/p>\n<p>\u201cAfter the Supreme Court\u2019s decision in [<em>Students For Fair Admissions<\/em>], it is clear that discriminating on the basis of race to achieve diversity is not lawful,\u201d Jacobson told\u00a0the Fix. \u201cAs Chief Justice Roberts wrote in the majority opinion, \u2018[e]liminating racial discrimination means eliminating all of it.\u2019\u201d<\/p>\n<p>In Justice Neil Gorsuch\u2019s concurring opinion on the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/universities-scrap-sat-scramble-to-stay-diverse-ahead-of-affirmative-action-ruling\/\" title=\"Universities Scrap SAT, Scramble To Stay Diverse Ahead Of Affirmative Action Ruling\">affirmative action ruling<\/a>, he stated that it doesn\u2019t \u201cmatter if the recipient discriminates against an individual member of a protected class with the idea that doing so might favor the interests of that class as a whole or otherwise promote equality at the group level.\u201d<\/p>\n<p>The Supreme Court <a href=\"https:\/\/www.dailywire.com\/news\/supreme-court-issues-landmark-ruling-on-affirmative-action-at-universities\" target=\"_blank\" rel=\"noopener\">ruling<\/a> was based on allegations that Harvard discriminated against Asian and white students by enrolling students of other races over them, even when the Asian and white students had better test
