The legal\u200b battle, initiated by \u200dGovernor Greg Abbott&#8217;s law, continues with\u2064 the Biden administration opposing the law due to conflicting federal authority concerns. The Supreme\u200b Court\u2063 briefly allowed the \u200blaw to come into effect\u2063 but sent it \u200bback\u2062 for further review.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>A <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/texas\/\" target=\"_blank\" rel=\"noreferrer noopener\">Texas<\/a> law that would permit state police to arrest and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-appeals-court-places-texas-immigration-law-on-hold-again-after-scotus-allowed-it-to-take-effect\/\" title=\"Federal Appeals Court Suspends Texas Immigration Law Following SCOTUS Approval\">deport immigrants suspected<\/a> of <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/illegal-immigrant\/\" target=\"_blank\" rel=\"noopener\" title=\"illegally\">illegally<\/a> entering the United States will remain on hold for now, an appeals court ruled late Tuesday.<\/p>\n<p>The divided 2-1 order from the U.S. Court of Appeals for the 5th Circuit came after a March 20 hearing by a three-judge panel on the court. It\u2019s the latest instance of legal whiplash related to Republican Gov. <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/greg-abbott\" target=\"_blank\" rel=\"noopener\" title=\"Greg Abbott\">Greg Abbott<\/a>\u2018s law, in what has become tumultuous litigation over its future.<\/p>\n<figure><figcaption>A Texas National Guard Soldier escorts immigrants back south behind a concertina barrier on the Rio Grande in El Paso, Texas, on Thursday, March 21, 2024. (Omar Ornelas\/El Paso Times via AP)<\/figcaption><\/figure>\n<p>President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/joe-biden\/\" target=\"_blank\" rel=\"noreferrer noopener\">Joe Biden<\/a>\u2018s Justice Department argues the law, known as Senate Bill 4, violates federal authority and would create chaos at the southern border. Texas contends the Biden administration is failing at its job to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-romney-cotton-minimum-wage-plan-is-anti-conservative-and-embraces-the-logic-of-the-left\/\" title=\"The Romney\/Cotton Minimum Wage Plan Is Anti-Conservative And Embraces The Logic Of The Left\">control illegal immigration<\/a> and that the Lone Star State is right to take action.<\/p>\n<p>The law was in effect briefly on March 19 after the\u00a0<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/supreme-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme Court<\/a>\u00a0cleared a path for it to become enacted. But the justices did not rule on the merits of the case and sent it back to the 5th Circuit, which then suspended enforcement while they consider the appeal.<\/p>\n<p>The latest ruling on Tuesday evening keeps the hold on SB 4 in place.<\/p>\n<p>The law was initially challenged by the Biden administration and a pair of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/amnesty-lobby-bbb-will-fix-joe-bidens-inflation-by-cutting-voters-wages\/\" title=\"Amnesty Lobby: BBB Will Fix Joe Biden's Inflation by Cutting Voters' Wages\">immigrant advocacy groups<\/a> along with El Paso County, all of which argue that the Supreme Court\u2019s 2012 precedent in\u00a0<em>Arizona v. United States<\/em>\u00a0clearly states that removal of immigrants is the federal government\u2019s prerogative.<\/p>\n<p>Texas Attorney General Ken Paxton has argued that SB 4 complies with federal law and argues \u201cstates generally enjoy wide latitude to regulate alien misconduct and prosecute crimes involving illegal entry.\u201d There have so far been no arrests made under SB 4 despite its brief enactment.<\/p>\n<p>The challenge to SB 4 is just one of several legal disputes between Republican state officials and the Biden administration over the state\u2019s ability to enforce its own border measures. Other open disputes involve Texas\u2019s placement of razor wire fencing and a 1,000-foot-long floating barrier on the Rio Grande.<\/p>\n<p>The Biden administration also argues the razor wire and floating barrier make it more difficult and dangerous for the Department of Homeland Security to do its job and pose risks to immigrants who are entering the country through the southern border.<\/p>\n<p>In response to Texas\u2019s law, Iowa passed a law similar to the Texas measure that is awaiting the signature of Gov. Kim Reynolds (R-IA). Other states that are currently seeking to pass immigration legislation include Missouri, Kansas, New Hampshire, Arizona, Louisiana, and Florida.<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p>Texas\u2019s SB 4 was introduced by Republican state Sen. Charles Perry and Republican state Rep.
