The defense argues, among other points, that a plea deal granting Biden immunity was withdrawn.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/tag\/hunter-biden\/\" target=\"_blank\" rel=\"noopener\" title=\"Hunter Biden\">Hunter Biden<\/a>\u2018s attorneys will appear in court in <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/california\" target=\"_blank\" rel=\"noopener\" title>California<\/a> on Wednesday to make the case that a judge should dismiss the nine <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2791878\/hunter-biden-pleads-not-guilty-to-nine-tax-charges\/\" target=\"_blank\" rel=\"noopener\" title=\"tax charges\">tax charges<\/a> brought against the first son by special counsel <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/david-weiss\" target=\"_blank\" rel=\"noopener\" title=\"Hunter Biden\">David Weiss<\/a>.<\/p>\n<p>Judge Mark Scarsi will hear from both defense attorneys and prosecutors at 1:00 p.m. local time in Los Angeles about the several arguments Biden has filed in court regarding why he believes his tax charges should be dropped.<\/p>\n<p>It is unclear if the first son will be present for the hearing. His attorney did not respond to a request for comment.<\/p>\n<p>Weiss, who has been leading an investigation into Biden since 2019, brought three felony and six misdemeanor charges against him in December. The charges included failure to pay <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/taxes\" target=\"_blank\" rel=\"noopener\" title>taxes<\/a>, failure to file taxes, and filing false returns for the 2016 to 2019 tax years.<\/p>\n<p>Weiss alleged that Biden \u201cwould earn handsomely and spend wildly\u201d on a lavish lifestyle while failing to pay $1.4 million in taxes during that time period.<\/p>\n<p>Biden\u2019s <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/lawyers\" target=\"_blank\" rel=\"noopener\" title>attorneys<\/a>, among their several arguments that the charges should be dropped, have claimed that a now-withdrawn plea deal Biden struck with Weiss last summer granted the first son \u201csweeping immunity\u201d that protected him from future charges. The agreement included Biden pleading guilty to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/hunter-biden-lawyer-calls-irs-whistleblower-a-criminal\/\" title=\"Hunter Biden Lawyer Calls IRS Whistleblower a Criminal\">misdemeanor tax charges<\/a>, but Weiss has argued that because a probation office never signed off on the agreement, it was never executed.<\/p>\n<p>Biden\u2019s attorneys have also argued that the tax charges should be dismissed because Weiss\u2019s prosecution is \u201cselective and vindictive\u201d and has been \u201ccompromised by politics.\u201d<\/p>\n<p>\u201cThis case follows a nearly six-year record of [the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/Justice-Department\" target=\"_blank\" rel=\"noopener\" title>Department of Justice<\/a>] changing its charging decisions and upping the ante on Mr. Biden in direct response to political pressure and its own self-interests,\u201d defense attorneys wrote in their motion.<\/p>\n<p>They accused the DOJ specifically of caving to pressure to prosecute Biden from former President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\" target=\"_blank\" rel=\"noopener\" title=\"Donald Trump\">Donald Trump<\/a> and congressional Republicans such as House Oversight Committee Chairman James Comer (R-KY).<\/p>\n<p>Prosecutors for the DOJ responded that the argument was \u201cnothing more than a house of cards.\u201d<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/a><\/strong><\/p>\n<p>\u201cFrom this fairly unremarkable set of procedural events, the defendant concocts a conspiracy theory that the prosecution has \u2018upped the ante\u2019 to appease politicians who have absolutely nothing to do with the prosecution and are not even members of the current <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/Executive-Branch\" target=\"_blank\" rel=\"noopener\" title>Executive Branch<\/a>,\u201d the prosecutors wrote.<\/p>\n<p>Scarsi, the presiding judge, has indicated that he plans to decide on whether to dismiss any of the charges by mid-April.
