The Biden administration faces criticism for overstepping\u2064 legal\u200b boundaries, impacting gun control efforts negatively. The legality and ethical implications of such actions remain contentious.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><\/p>\n<div class=\"article-content\">\n<p>On Saturday, Vice President Kamala Harris <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2024\/03\/23\/fact-sheet-vice-president-harris-announces-gun-safety-solutions-while-continuing-efforts-to-keep-schools-safe-from-gun-violence\/\" target=\"_blank\" rel=\"noreferrer noopener\">touted<\/a> the administration\u2019s new National Extreme Risk Protection Order Resource Center, which will \u201csupport the effective implementation of state red flag laws\u201d <a href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-launches-national-extreme-risk-protection-order-resource-center\">and<\/a> \u201ckeep guns out of the hands of people who pose a threat to themselves or others.\u201d But there is a problem: Congress never authorized the U.S. Department of Justice to create this resource center. The administration confuses \u201c<a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/senate-bill\/2938\" target=\"_blank\" rel=\"noreferrer noopener\">grants \u2026 to implement state \u2026 mental health courts, drug courts, veterans\u2019 courts, and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/reports-red-flag-laws-result-in-66-firearm-confiscations\/\" title=\"Reports: Red flag laws result in 66 firearm confiscations\">extreme risk protection order<\/a> programs<\/a>\u201d with creating an entirely new center for one of these areas.<\/p>\n<p>This isn\u2019t the first time the Biden administration has gone beyond what the law allows and done more harm than good.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-266827736\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-f9c57a991ff130c635e3d22fbc2083cf fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-f9c57a991ff130c635e3d22fbc2083cf\"><\/div>\n<p>The Department of Justice press release claims that Extreme Risk Protection Orders (ERPOs, also known as red flag laws) will \u201c<a href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-launches-national-extreme-risk-protection-order-resource-center\" target=\"_blank\" rel=\"noreferrer noopener\">reduce firearm homicides and suicides<\/a>.\u201d Surveys show likely voters support laws that \u201c<a href=\"https:\/\/uh.edu\/hobby\/txtrends\/gunsafety2022.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">allow guns to be temporarily confiscated by a judge from people considered by a judge to be a danger to themselves or others<\/a>\u201d by at least <a href=\"https:\/\/crimeresearch.org\/2022\/09\/original-research-support-for-red-flag-laws-depends-on-people-not-understanding-how-red-flag-laws-operate\/\" target=\"_blank\" rel=\"noreferrer noopener\">2-1<\/a> <a href=\"https:\/\/www.dataforprogress.org\/blog\/2022\/6\/13\/after-the-uvalde-shooting-majority-of-voters-support-red-flag-laws-and-stricter-gun-control\" target=\"_blank\" rel=\"noreferrer noopener\">margins<\/a>.<\/p>\n<p>But despite what the Biden administration and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/gun-control-groups-got-cdc-to-scrub-good-guys-with-guns-study-emails-show\/\" title=\"Gun Control Groups Got CDC To Scrub \u2018Good Guys With Guns\u2019 Emails and Study\">gun control advocates claim<\/a>, all 50 states and the federal government have long made it possible to take a dangerous person\u2019s guns away. Civil commitment laws go by various names, such as the Baker Act in Florida or the 5150 code in California.<\/p>\n<p>If you worry that someone is dangerous, you can tell the police your concerns. If the police agree that there is a \u201creasonable\u201d chance the person is a danger to themselves or others, mental health professionals will evaluate the individual. If the professionals give their consent, an emergency court hearing is held. A lawyer is provided to those who cannot afford one. Judges have recourse to a wide range of options, such as outpatient mental health care or driver\u2019s license suspension. Gun confiscation or involuntary commitment may also be options, but only after going through the proper legal process.<\/p>\n<h2 class=\"wp-block-heading\">Difference with Red Flag Laws<\/h2>\n<p>Under <a href=\"https:\/\/www.criminaldefenselawyer.com\/resources\/maryland-red-flag-laws-and-extreme-risk-protective-orders.html\" target=\"_blank\" rel=\"noreferrer noopener\">red<\/a> <a href=\"http:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&#038;Search_String=&#038;URL=0700-0799\/0790\/Sections\/0790.401.html\" target=\"_blank\" rel=\"noreferrer noopener\">flag<\/a> laws, a judge acts solely on the basis of a written complaint. He never talks to the person who made the complaint or the person against whom it was made. States vary on how quickly hearings must occur, but they all require that they take place within a month after one\u2019s guns are taken away. But the steep cost of legal representation often deters defendants from seeking counsel, as lawyers can charge upwards of $10,000 for a hearing.<\/p>\n<div class=\"fdrlst__b89e9-08f54b69c0c63db298538534aec089dc fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-08f54b69c0c63db298538534aec089dc\"><\/div>\n<p>When told that red flag laws do not entail consultation of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/report-biden-admin-still-holding-tens-of-thousands-of-migrant-kids-with-little-oversight\/\" title=\"Report: Biden Admin Still Holding \u2018Tens Of Thousands\u2019 Of Migrant Kids With \u2018Little Oversight\u2019\">mental health experts<\/a> and that there are no court hearings before guns are confiscated, public support appears to flip. <a href=\"https:\/\/crimeresearch.org\/2022\/09\/original-research-support-for-red-flag-laws-depends-on-people-not-understanding-how-red-flag-laws-operate\/\" target=\"_blank\" rel=\"noreferrer noopener\">A McLaughlin &#038; Associates survey<\/a> (commissioned by the Crime Prevention Research Center) of 1,000 likely voters found 29 percent support and 47 percent oppose these laws.<\/p>\n<p>Gun confiscation isn\u2019t a serious means of preventing suicides. People can commit suicide in many different ways, and places that have banned all guns or all handguns have seen <a href=\"https:\/\/www.amazon.com\/More-Guns-Less-Crime-Understanding\/dp\/1707911975\/ref=sr_1_1?crid=2PYQ4HPEPWQN0&#038;keywords=more+guns+less+crime&#038;qid=1636267088&#038;sprefix=More+Guns+L%2Caps%2C238&#038;sr=8-1\" target=\"_blank\" rel=\"noreferrer noopener\">no change in total suicides<\/a>. The evidence shows suicide rates remain statistically <a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=3316573\">unchanged<\/a> or <a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=3492120\" target=\"_blank\" rel=\"noreferrer noopener\">even slightly increased<\/a>.<\/p>\n<p>Simply talking to others is important in overcoming depression, but red flag laws may make people reluctant to discuss their feelings. For example, police officers experience work-related depression at high rates but may be less likely to talk about their <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/junior-bankers-at-goldman-sachs-claim-inhumane-work-conditions-abuse-in-new-survey\/\" title=\"Junior Bankers At Goldman Sachs Claim \u2018Inhumane\u2019 Work Conditions, \u2018Abuse\u2019 In New Survey\">mental health due<\/a> to red flag laws. Take away officers\u2019 ability to carry a gun, and they might lose their jobs.<\/p>\n<p>One can also harm others without the use of a firearm, for instance, by <a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/darrell-brooks-wisconsin-christmas-parade-sentenced-rcna57411\" target=\"_blank\" rel=\"noreferrer noopener\">driving<\/a> a car into a crowd of people.<\/p>\n<div class=\"fdrlst__b89e9-99659ab1dffdedbe2072a44c9d6e8c25 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-99659ab1dffdedbe2072a44c9d6e8c25\"><\/div>\n<p>Allowing for easy gun confiscation can leave good, law-abiding people defenseless. Andrew Pollack, who lost his daughter in the 2017 Stoneman Douglas High School shooting in Parkland, Florida, recently had an Extreme Risk Protection Order used against him by a neighbor in rural Oregon. When Pollack finally had his hearing in court, the judge didn\u2019t even need to hear a defense because there was no evidence that Pollack had threatened anyone. Unfortunately, while disarmed, he faced a mountain lion outside his home. His dog tangled with the mountain lion, requiring 50 stitches on his side. As is virtually always the case, there was no punishment for the neighbors bringing the false claim.<\/p>\n<p>A Democrat-controlled Congress authorized the president to give grants to states that have red flag laws, but never was he authorized to establish a federal red flag center.
