The \u206313-year-old filed a lawsuit citing \u200ca violation of Title\u200d IX and the Fourteenth Amendment. Despite expressing a\u200c transgender identity since third grade, the\u200b school\u200d allegedly failed to accommodate the student&#8217;s needs, leading\u200c to distress \u200dand missed class \u2064time.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p>A <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/exclusive-parents-group-demands-netflix-be-investigated-for-pornographic-show-involving-middle-schoolers\/\" title=\"EXCLUSIVE: Parents Group Demands Netflix Be Investigated For Pornographic Show Involving Middle-Schoolers\">middle school boy<\/a> is suing his <a href=\"https:\/\/www.dailywire.com\/topic\/wisconsin\" target=\"_blank\" rel=\"noopener\">Wisconsin<\/a> school district for allegedly barring him from using the girls\u2019 bathroom.<\/p>\n<p>The unnamed seventh grader, known as Jane Doe in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/boeing-agrees-to-2-5b-settlement-over-737-max-crashes\/\" title=\"Boeing agrees to .5B settlement over 737 MAX crashes\">court documents<\/a>, <a href=\"https:\/\/www.jsonline.com\/story\/news\/education\/2024\/03\/26\/transgender-student-sues-elkhorn-school-district-over-bathroom-access\/73096940007\/\" target=\"_blank\" rel=\"noopener\">filed<\/a> the lawsuit Thursday in federal court.<\/p>\n<p>The 13-year-old is accusing the Elkhorn Area School District southwest of Milwaukee of violating Title IX, which prohibits discrimination on the basis of sex in schools, as well as the Fourteenth Amendment.<\/p>\n<p>The boy says that he told a teacher he identified as transgender and wanted to use female pronouns back in the fall of 2022 when he was in sixth grade. He claims he had <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/does-gender-affirming-care-for-trans-kids-actually-prevent-suicide-heres-what-the-data-say\/\" title=\"Does \u2018Gender-Affirming Care\u2019 For Trans Kids Actually Prevent Suicide? Here\u2019s What The Data Say\">experienced gender dysphoria<\/a> since third grade.<\/p>\n<p>The teacher brought his parents in to establish a \u201cgender support plan,\u201d but the guidance counselor did not offer to let the boy use the girls\u2019 bathroom or locker room, according to the lawsuit. The boy was told he could use the faculty bathrooms, however, the suit says.<\/p>\n<p>\u201cThese restrooms, which were located further away from her classes than the nearest girls\u2019 restrooms, caused Jane to miss class time and to experience distress at being treated differently from other girls at school,\u201d <a href=\"https:\/\/www.wpr.org\/news\/transgender-middle-schooler-files-federal-lawsuit-against-elkhorn-school-district\" target=\"_blank\" rel=\"noopener\">said<\/a> the child\u2019s attorney, Joseph Wardenski, head of a New York-based civil rights law firm.<\/p>\n<p>The boy sometimes stayed home from school or drank less water while at school to avoid needing to use the bathroom, the suit claims.<\/p>\n<p>The suit also claims the boy received \u201cunwanted attention by classmates and teachers, stigma, heightened anxiety and distress, bullying and harassment by peers, and social and academic withdrawal\u201d due to using the faculty restrooms.<\/p>\n<p><b><a href=\"https:\/\/onelink.to\/dwapp\" target=\"_blank\" rel=\"noopener noreferrer\" aria-describedby=\"sk-tooltip-9096\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/onelink.to\/dwapp&#038;source=gmail&#038;ust=1700760801843000&#038;usg=AOvVaw2PQrVSrJfhxNb4LcARqniG\">CLICK HERE TO GET THE DAILYWIRE+ APP<\/a><\/b><\/p>\n<p>The boy sometimes used the girls\u2019 bathrooms to \u201cavoid the distress and humiliation\u201d of using the faculty bathroom, causing teachers and administrators to reprimand him, according to the suit.<\/p>\n<p>Superintendent Jason Tadlock said Monday that he was not able to comment immediately because he had not yet reviewed it with an attorney.<\/p>\n<p>\u201cThat being said, we always strive to meet all our student\u2019s needs, and I am saddened to learn that one of our students and\/or parents feel that we are not meeting their needs to their satisfaction,\u201d Tadlock <a href=\"https:\/\/www.jsonline.com\/story\/news\/education\/2024\/03\/26\/transgender-student-sues-elkhorn-school-district-over-bathroom-access\/73096940007\/\" target=\"_blank\" rel=\"noopener\">told<\/a> the Milwaukee Journal Sentinel.<\/p>\n<p>It is not clear how the federal court will rule in this case as the federal courts have so far been divided on policies that bar trans-identifying students from using the bathrooms of the opposite sex.<\/p>\n<p>Some federal courts have <a href=\"https:\/\/crsreports.congress.gov\/product\/pdf\/LSB\/LSB10953#:~:text=Eleventh%20Circuit%3A%20Such%20Policies%20Do%20Not%20Violate%20Title%20IX&#038;text=The%20board%20did%20not%20accept,bathrooms%20were%20available%20to%20students.\" target=\"_blank\" rel=\"noopener\">ruled<\/a> that policies allowing such bathroom use violate Title IX, while others have ruled that policies prohibiting such bathroom use is a violation.<\/p>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A Wisconsin middle school student, identified as Jane Doe, has initiated legal action against the Elkhorn Area School District, alleging discrimination for not being allowed to use the girls&#8217; restroom.
