The justices are tasked with determining whether to let a decision from the 5th U.S. Circuit Court of Appeals that found the Food and Drug Administration likely violated the law when it approved the abortion pill for <a href=\"https:\/\/thefederalist.com\/2021\/12\/17\/biden-administration-endorses-more-baby-killing-by-green-lighting-mail-order-abortion-pills\/\" target=\"_blank\" rel=\"noreferrer noopener\">mail order<\/a> and other expansions stand.<\/p>\n<p>U.S. Solicitor General Elizabeth Prelogar introduced the case by claiming that the plaintiffs, a coalition of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-agencies-are-regulating-radically-rapidly\/\" title=\"Biden Agencies Are Regulating Radically, Rapidly\">pro-life medical professionals<\/a>, had no standing to bring it.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1395544486\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-5ad59c2568abc4de2396a5b1602d1054 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-5ad59c2568abc4de2396a5b1602d1054\"><\/div>\n<p>Federal Judge Matthew Kacsmaryk previously established that the plaintiffs had standing based on their own experiences and on behalf of their patients. As Federalist Legal Correspondent Margot Cleveland noted in her <a href=\"https:\/\/thefederalist.com\/2023\/04\/11\/everything-you-need-to-know-about-the-case-freezing-the-fdas-abortion-pill-approval\/\" target=\"_blank\" rel=\"noreferrer noopener\">analysis of his ruling<\/a>, \u201cThe Supreme Court has allowed abortion doctors to represent the interests of women seeking abortions, notwithstanding the conflict of interest between the two \u2014 with the abortionists often seeking to scrap laws designed to protect their patients.\u201d<\/p>\n<p>When pressed by Justices Clarence Thomas and Samuel Alito, however, Prelogar could not name anyone, including <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/she-was-in-the-middle-of-having-an-abortion-daily-wire-reporter-joins-laura-ingraham-to-discuss-gruesome-reports-of-d-c-abortion-clinic\/\" title=\"\u2018She Was In The Middle Of Having An Abortion\u2019: Daily Wire Reporter Joins Laura Ingraham To Discuss Gruesome Reports Of D.C. Abortion Clinic\">pro-life doctors<\/a>, states, and women harmed by the drug, who the government believed would have judicial recourse to sue the FDA over the abortion pill. <\/p>\n<p>\u201cSo your argument here is that it doesn\u2019t matter if the FDA flagrantly violated the law, didn\u2019t do what it should have done, endangered the health of women, it\u2019s just too bad? Nobody can sue in court? There\u2019s no remedy \u2014 the American people have no remedy for that?\u201d Alito asked. <\/p>\n<p>\u201cWell, I think that it would be wrong to suggest that if the FDA had made a mistake and a drug were actually producing safety consequences that there was nothing to be done,\u201d Prelogar replied.<\/p>\n<div class=\"fdrlst__b89e9-adcfbcd944b354c03ac33c8272aadb3c fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-adcfbcd944b354c03ac33c8272aadb3c\"><\/div>\n<p>She concluded that Alito\u2019s suggestion that \u201cunsafe drugs could somehow remain on the market\u201d is \u201cincorrect,\u201d despite data showing mifepristone is responsible for a\u00a0<a href=\"https:\/\/thefederalist.com\/2023\/04\/07\/federal-judge-says-fda-wrongfully-approved-abortion-pill\/\" target=\"_blank\" rel=\"noreferrer noopener\">500 percent increase<\/a>\u00a0in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/women-misrepresenting-chemical-abortions-as-miscarriages-at-increased-risk-of-multiple-hospitalizations-study-finds\/\" title=\"Women Misrepresenting Chemical Abortions As Miscarriages At Increased Risk Of Multiple Hospitalizations, Study Finds\">abortion-related emergency room visits<\/a> for complications such as <a href=\"https:\/\/prochoice.org\/wp-content\/uploads\/phone_triage_guide.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">hemorrhage<\/a>,\u00a0<a href=\"https:\/\/www.mayoclinic.org\/drugs-supplements\/mifepristone-oral-route\/side-effects\/drg-20067123\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cfast, weak pulse,\u201d \u201cshortness of breath,\u201d diarrhea, dizziness, headache, vomiting<\/a>, and\u00a0<a href=\"https:\/\/www.mayoclinic.org\/drugs-supplements\/mifepristone-oral-route\/side-effects\/drg-20067123\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cpain\u201d across the back, arms, neck, and abdomen<\/a>, and <a href=\"https:\/\/lozierinstitute.org\/fact-sheet-risks-and-complications-of-chemical-abortion\/#_ftn19\" target=\"_blank\" rel=\"noreferrer noopener\">a myriad of other risks<\/a>. Even the FDA admits in the mifepristone label that <a href=\"https:\/\/www.accessdata.fda.gov\/drugsatfda_docs\/label\/2016\/020687s020lbl.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">1 in 25 women<\/a>\u00a0who down the drug will end up in the hospital.<\/p>\n<p>The justices\u2019 question-and-answer volley over standing quickly devolved into a debate about conscience objections.<\/p>\n<p>Prelogar, representing the most hostile administration to conscience objections regarding abortion, <a href=\"https:\/\/x.com\/angiejaime\/status\/1772637602262175913?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">repeatedly argued<\/a> that medical professionals, even those who work in emergency rooms, have the federally guaranteed space to abstain from aiding or abetting a chemical abortion.<\/p>\n<p>As Roger Severino, the Trump-era director of the Office of Civil Rights at the U.S. Department of Health and Human Services, noted, however, President Joe Biden has not only <a href=\"https:\/\/thehill.com\/policy\/healthcare\/4397912-biden-administration-rescinds-much-of-trump-conscience-rule-for-health-workers\/\" target=\"_blank\" rel=\"noreferrer noopener\">worked overtime to undo these protections<\/a>, but his Department of Justice has also refused to pursue legal recourse for healthcare workers <a href=\"https:\/\/x.com\/RogerSeverino_\/status\/1772633309173969196?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">whose conscience rights were verifiably violated<\/a>.<\/p>\n<div class=\"fdrlst__b89e9-511d5da9e63495629f3b9128b6711973 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-511d5da9e63495629f3b9128b6711973\"><\/div>\n<figure class=\"wp-block-image size-large\"><\/figure>\n<p>Erin Hawley, the Alliance Defending Freedom senior counsel representing the plaintiffs, repeatedly noted that even pro-life doctors like OB-GYNs Ingrid Skop and Christina Francis, who register their conscience objections ahead of time, could face emergencies hampering their ability to object to continuing a chemically-induced abortion.<\/p>\n<p>\u201cThe FDA\u2019s decision to weaken commonsense safeguards, removing doctors from the process, shows they prioritize ending unborn life over the health and safety of women. As a practicing OB-GYN with over 30 years of experience, I have seen how abortion drugs have harmed my patients, both mothers and their unborn children. I have cared for many of these women in the ER, even though abortion advocates pretend they don\u2019t exist. Their stories must be heard, but abortion advocates, working with corporate media, have gaslighted them into silence. I hope the Supreme Court holds the FDA accountable for their reckless actions,\u201d Skop said in a statement.<\/p>\n<p>Yet, Democratic-nominated justices continually dismissed these concerns. Justice Sonya Sotomayor even implied that because the risk of harm for doctors like Skop and Francis is so \u201c<a href=\"https:\/\/thehill.com\/policy\/healthcare\/4556399-supreme-court-abortion-pill-oral-arguments\/#153873\" target=\"_blank\" rel=\"noreferrer noopener\">infinitesimally small<\/a>,\u201d their objections are not necessarily relevant to the case.<\/p>\n<h2 class=\"wp-block-heading\">A Two-Decade Fight<\/h2>\n<p>Prelogar concluded oral arguments by claiming that the case against the FDA \u201charms the agency,\u201d \u201charms the pharmaceutical industry,\u201d and \u201charms women who need access to medication abortion.\u201d Her conclusion that the FDA\u2019s approval alone means mifepristone is \u201csafe and effective,\u201d however, is not present in data about the drug. <\/p>\n<p>For more than\u00a0<a href=\"https:\/\/aaplog.org\/wp-content\/uploads\/2021\/01\/2002-Aug-Citizen-Petition_Mifeprex-8.20.02.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">two decades<\/a>, pro-life doctors repeatedly asked the FDA to repeal its approval of chemical abortion drugs because the agency used <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-judge-says-fda-wrongfully-approved-abortion-pill\/\" title=\"Federal Judge Says FDA Wrongfully Approved Abortion Pill\">accelerated drug approval authority<\/a> to fast-track pills that can cause\u00a0dangerous\u00a0and\u00a0<a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/33939340\/\" target=\"_blank\" rel=\"noreferrer noopener\">sometimes fatal<\/a> complications. The FDA repeatedly stonewalled petitioners\u2019 requests despite its legal obligation to address concerns.<\/p>\n<p>The FDA claims to limit the pill use to 70 days gestation. Yet, it does not require prescribers to conduct an ultrasound verifying the unborn baby\u2019s age or location in the woman\u2019s body, leaving some patients with ectopic pregnancy more susceptible to complications.<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\"> <span class=\"KYaAl307Sn8coTqhHjyd\"><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">About 1 in 50 pregnancies are ectopic. Our doctors should be able to screen and serve their patients for serious issues and complications like this before prescribing drugs. <a href=\"https:\/\/twitter.com\/hashtag\/FDAdoyourjob?src=hash&#038;ref_src=twsrc%5Etfw\">#FDAdoyourjob<\/a> and recognize that <a href=\"https:\/\/twitter.com\/hashtag\/WomensHealthMatters?src=hash&#038;ref_src=twsrc%5Etfw\">#WomensHealthMatters<\/a> <a href=\"https:\/\/t.co\/p975PiL2Ig\">pic.twitter.com\/p975PiL2Ig<\/a><\/p>\n<p>\u2014 AAPLOG (@aaplog) <a href=\"https:\/\/twitter.com\/aaplog\/status\/1772624955655475433?ref_src=twsrc%5Etfw\">March 26, 2024<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/span> <\/div>\n<\/figure>\n<p>Thanks to the\u00a0<a href=\"https:\/\/thefederalist.com\/2024\/03\/05\/selling-abortion-pills-bloodies-the-hands-of-walgreens-and-cvs\/\" target=\"_blank\" rel=\"noreferrer noopener\">radically relaxed policies<\/a>\u00a0introduced at the bidding of the Biden administration and the manufacturer of mifepristone Danco Laboratories, the drug regimen is readily available via mail order and sale in pharmacies like <a href=\"https:\/\/thefederalist.com\/2024\/03\/05\/selling-abortion-pills-bloodies-the-hands-of-walgreens-and-cvs\/\" target=\"_blank\" rel=\"noreferrer noopener\">Walgreens and CVS<\/a> and could easily be obtained by women well beyond that 70-day limit.<\/p>\n<p>Under the Biden administration, the FDA\u00a0<a href=\"https:\/\/thefederalist.com\/2023\/01\/05\/fda-aids-bidens-abortion-for-all-agenda-by-letting-pharmacies-sell-dangerous-abortion-pill\/\" target=\"_blank\" rel=\"noreferrer noopener\">quietly modified<\/a>\u00a0its already debated regulation to accommodate the\u00a0<a href=\"https:\/\/www.reuters.com\/world\/us\/biden-administration-signals-fight-over-medication-abortion-2022-06-25\/\" target=\"_blank\" rel=\"noreferrer noopener\">White House\u2019s<\/a>\u00a0post-<em>Roe<\/em>\u00a0activism and open the door for the nation\u2019s pharmacies to become abortion pill dispensaries. That was after it permanently allowed abortion pills via\u00a0<a href=\"https:\/\/thefederalist.com\/2021\/12\/17\/biden-administration-endorses-more-baby-killing-by-green-lighting-mail-order-abortion-pills\/\" target=\"_blank\" rel=\"noreferrer noopener\">mail<\/a> in 2021.<\/p>\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><\/figure>\n<\/div>\n<p>Before that, under the Obama administration <a href=\"https:\/\/thefederalist.com\/2023\/04\/07\/federal-judge-says-fda-wrongfully-approved-abortion-pill\/\" target=\"_blank\" rel=\"noreferrer noopener\">in 2016<\/a>, the FDA expanded when girls and women could take the pill, changed its dosing, reduced the required number of doctor visits to obtain the drug, allowed more people than licensed doctors to prescribe the pill, and eradicated reporting standards for non-fatal complications from the pills.<\/p>\n<p>Just a few weeks after the court <a href=\"https:\/\/twitter.com\/greg_price11\/status\/1765930544431550651?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">faced threats<\/a> from Biden over its latest abortion\u00a0decision, New York\u2019s Democrat Gov. Kathy Hochul publicly attempted shortly before Tuesday\u2019s arguments to sway justices away from siding with the plaintiffs in the abortion pill case. <\/p>\n<p>\u201cDon\u2019t underestimate the rage of women in this country.
