However, last month, the Appellate Division for the Second Judicial Department <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2868162\/ny-court-rules-noncitizen-voting-local-elections-unconstitutional\/\" title=\"ruled\">ruled<\/a> 3-1 that the law, which had yet to take effect, was unconstitutional.\u00a0<\/p>\n<p>The council argued that because noncitizens pay taxes and \u201ccontribute to our communities,\u201d they should be able to participate in local elections.<\/p>\n<p>\u201cEmpowering New Yorkers to participate in our local democratic process can only strengthen New York City by <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/how-biden-is-trying-to-turn-election-offices-into-partisan-get-out-the-vote-operations\/\" title=\"How Biden Is Trying To Turn Election Offices Into Partisan Get Out The Vote Operations\">increasing civic engagement<\/a>,\u201d the council <a href=\"https:\/\/council.nyc.gov\/press\/2024\/03\/25\/2579\/\">said<\/a> in a statement.\u00a0\u00a0\u00a0<\/p>\n<p>The high court\u2019s February decision was a major triumph for state Republicans who filed a lawsuit against the Democratic-supported law, <a href=\"https:\/\/malliotakis.house.gov\/media\/press-releases\/malliotakis-statement-noncitizen-voting-lawsuit-victory\">saying<\/a> that it was unconstitutional and a \u201csacred right given only to United States citizens.\u201d<\/p>\n<p>LatinoJustice, a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-admin-puts-plans-for-national-police-oversight-board-on-hold\/\" title=\"Biden Admin Puts Plans For National Police Oversight Board On Hold\">national civil rights organization<\/a>, also filed an appeal over the ruling last week.\u00a0\u00a0<\/p>\n<p>Rep.
