However, his understanding of the state Constitution leaves much to be desired. <\/p>\n<p>In the fight for life in Wisconsin, Kaul has made an\u200c <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-roasted-for-straight-faced-claim-gop-needs-to-give-him-money-to-protect-border\/\" title=\"Biden mocked for claiming GOP must fund him to secure border\">audacious request<\/a> to \u200bthe Wisconsin Supreme Court, claiming \u200da\u200b constitutional right to abortion. The state Constitution does not guarantee such a right, and in\u2063 fact, there are provisions \u2063that prohibit abortion in Wisconsin. <\/p>\n<p>It is <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/nbc-news-covers-the-biden-administration\/\" title=\"NBC News Covers the Biden Administration\u00a0\">worth noting<\/a> that Kaul has already \u2062achieved a victory \u2063by losing in the liberal-controlled Dane County Circuit Court. Whether \u2064his expanded \u200dargument \u2063will hold\u200d up in the state Supreme Court remains to be seen. <\/p>\n<div class=\"fdrlst__b89e9-73b09690ca5fa082b2e4134dc71e22fc fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-73b09690ca5fa082b2e4134dc71e22fc\"><\/div>\n<h2 class=\"wp-block-heading\">\u2018Rife with Uncertainty\u2019 <\/h2>\n<p>Last \u200dmonth, Kaul filed\u2064 a supplemental petition asking the court to take jurisdiction over the case of Kaul, et al. v. Urmanski, et al. This appeal challenges a ruling by \u2062the\u200d Dane County Circuit Court that\u2063 the 1849 Wisconsin law banning most abortions does not apply. The law only addresses infanticide, according to the interpretation of the judge. <\/p>\n<p>Following the U.S. Supreme Court&#8217;s recent ruling in Dobbs v. Jackson Women&#8217;s\u2064 Health, which found that the U.S. Constitution does not\u2062 guarantee the right to an abortion, Wisconsin&#8217;s dormant abortion statute\u2064 was revived. Kaul swiftly filed a lawsuit arguing \u200cthat the 1849\u200c law conflicted with a 1985 law allowing abortions up \u2064until viability. <\/p>\n<p>The Dane County judge, without needing Kaul&#8217;s\u200b argument, ruled\u2063 that\u200b abortions \u2063were legal in Wisconsin because the\u2062 1849 law did not explicitly mention the word &#8220;abortion.&#8221; <\/p>\n<div class=\"fdrlst__b89e9-31c2d33e90207112b5243cd2c74ddb2f fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-31c2d33e90207112b5243cd2c74ddb2f\"><\/div>\n<p>However, Kaul \u200cis not satisfied with this outcome. He wants the Wisconsin Supreme Court to establish\u200c a definitive ruling \u2064that protects abortion on demand. Backed by Planned Parenthood, Kaul is pushing for \u2064the\u200c court to declare\u200d a constitutionally\u2063 protected right to abortion, even though it does not \u200dexist \u2064in the state Constitution. <\/p>\n<h2 class=\"wp-block-heading\">\u2018Inherent Rights\u2063 to Life\u2019<\/h2>\n<p>The\u2064 Wisconsin Institute for Law and Liberty dismisses Kaul&#8217;s claim as baseless. The state \u200cConstitution does not mention the right to an abortion, and throughout Wisconsin&#8217;s \u200bhistory, abortion has been prohibited to some extent. <\/p>\n<p>Even during the era of Roe\u200b v. Wade,\u200c Wisconsin had laws in place \u200dregarding parental consent, waiting periods, and bans on <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/becerra-i-hope-to-find-common-ground-on-late-term-abortions\/\" title=\"Becerra: I hope to find common ground on late-term abortions\">partial-birth abortions<\/a>. <\/p>\n<p>The Institute is seeking to intervene in\u2062 the case \u2063to \u2064challenge Kaul&#8217;s attempt to change the scope of the \u200clawsuit and introduce a constitutional\u2064 question. Kaul&#8217;s actions are highly unusual and go against \u200bestablished legal \u2064advice. <\/p>\n<p>Kaul&#8217;s alignment with\u2063 Planned Parenthood \u200cis\u2063 evident, as they both\u200b seek to establish an affirmative \u2062right to abortion.
