The law allows anyone to obtain an early mail-in ballot. Every Republican in the state legislature opposed the legislation, alongside five Democrats. <\/p>\n<p>The Republican National Committee, Republican Reps. Elise Stefanik and Claudia Tenney, Restoring Integrity and Trust in Elections and other Republican groups <a href=\"https:\/\/thefederalist.com\/2023\/09\/21\/lawsuit-democrats-no-excuse-absentee-voting-law-violates-new-york-constitution\/\">alleged<\/a> the law was enacted in \u201cdefiance of Article II, \u00a7 2, ignoring and subverting the will of the People whom the Legislature is supposed to represent.\u201d<\/p>\n<p>New Yorkers had previously issued a resounding \u201cno\u201d when asked to vote on the constitutional amendment in 2021. Prior to the state\u2019s Democrats usurping the will of the people, the New York State <a href=\"https:\/\/dos.ny.gov\/system\/files\/documents\/2022\/01\/Constitution-January-1-2022.pdf\">Constitution<\/a> said voters who wanted an absentee ballot had to provide an excuse. Republicans statewide successfully <a href=\"https:\/\/www.facebook.com\/watch\/live\/?ref=watch_permalink&#038;v=582395383005054\">launched<\/a> a massive campaign against the measure. <\/p>\n<p>But a state Supreme Court judge ruled in February the law was constitutional, eliciting rebuke from New York Republican Party Chair Ed Cox. <\/p>\n<p>\u201cSince the Civil War, New York\u2019s state Constitution has required a constitutional amendment in order to expand absentee voting. The Legislature acknowledged this fact when in 2021 it submitted an amendment for no-excuse absentee voting,\u201d Cox said in a <a href=\"https:\/\/nygop.org\/statement-from-nygop-chair-ed-cox-on-albany-supreme-court-decision\/\">statement<\/a>. <\/p>\n<p>\u201cNow, our reckless Democrat-controlled Legislature brazenly states that because they don\u2019t call these mail-in ballots \u2018absentee\u2019 ballots, they do not require a constitutional amendment \u2014 even though the mail-in early vote ballots are identical in every respect to an absentee ballot.\u201d<\/p>\n<p>New Yorkers rejected Proposition 4 more than a year after voters requested approximately 2.5 million absentee or military ballot requests during extensive lockdowns, according to <a href=\"https:\/\/www.democratandchronicle.com\/story\/news\/politics\/albany\/2020\/11\/03\/ny-absentee-ballots-requested-by-county\/6141305002\/\">Democrat and Chronicle<\/a>. Democrats ignored the legal excuse requirement and allowed people to claim they needed to vote absentee to avoid contracting Covid-19. <\/p>\n<p>As a result, the state saw the number of <a href=\"https:\/\/thefederalist.com\/2023\/08\/07\/how-can-mail-in-voting-be-secure-when-postal-theft-is-rampant\/\">absentee ballot requests<\/a> balloon. During the 2016 race, 495,520 absentee ballots were requested and 400,660 were returned, according to Democrat and Chronicle. The number of absentee ballots requested quadrupled in 2020. <\/p>\n<p>Permitting <a href=\"https:\/\/thefederalist.com\/2020\/07\/24\/biden-accuses-trump-of-trying-to-steal-the-election-for-voicing-valid-concerns-over-mail-in-voting\/\">no-excuse mail-in ballots<\/a> is a surefire way to stain the election process. Just ask voters in Queens. Abdul Rahman was indicted by Queens District Attorney Melinda Katz in December after he allegedly submitted 118 absentee ballot applications during the 2022 Democrat primaries. <\/p>\n<p>The <a href=\"https:\/\/thefederalist.com\/2023\/12\/21\/queens-resident-indicted-for-submitting-118-absentee-ballot-applications-during-new-yorks-2022-democrat-primaries\/\">scheme was discovered<\/a> when a voter went to vote in person and was told \u201can absentee ballot had already been requested in his name.\u201d An investigation determined someone else had requested, filled out, and submitted an application in the man\u2019s name. Rahman was listed as the person authorized to transport the ballot.
