Lewis Voting Rights Advancement Act<\/a>, on March 1, more than two years after it failed to make headway in the Senate after being passed by the House in 2021. <\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-758406113\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-7275a4ce497a7f0626f84e16e3936545 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-7275a4ce497a7f0626f84e16e3936545\"><\/div>\n<p>If the bill were to pass, it would <a href=\"https:\/\/thefederalist.com\/2022\/01\/07\/democrats-top-priority-before-fall-elections-is-rigging-u-s-voting-rules\/\" target=\"_blank\" rel=\"noreferrer noopener\">enable<\/a> the Department of Justice to \u201cintervene anywhere in the country to overrule local or state authorities whenever the left alleges that changes in the laws could theoretically disadvantage minority voters,\u201d as Jonathan Tobin explained in these pages in 2022.<\/p>\n<h2 class=\"wp-block-heading\">Shelby County v. Holder <\/h2>\n<p>The legislation is a power grab meant to circumvent the Supreme Court\u2019s 2013 decision that restrained the federal government\u2019s overreach into elections. <\/p>\n<p>In 1965, a section of the Voting Rights Act barred certain jurisdictions \u2014 \u201cstates or political subdivisions that maintained tests or devices as prerequisites to voting and had low voter registration or turnout\u201d at the time \u2014 from making changes to their voting laws without federal approval or \u201cpreclearance.\u201d Despite an initial sunset of five years, Congress continued to reauthorize the provision, but never updated the 1960s-era <a href=\"https:\/\/ballotpedia.org\/Voting_Rights_Act\">formula<\/a> by which the law determined which jurisdictions were subject to federal scrutiny.<\/p>\n<p>In <em>Shelby County v. Holder<\/em>, the Supreme Court found that the formula was outdated and <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/570\/529\/#tab-opinion-1970752\">ruled<\/a> it \u201ccan no longer be used as a basis for subjecting jurisdictions\u201d to the requirement that the federal government preclear any new voting laws.<\/p>\n<div class=\"fdrlst__b89e9-9195214dfba08d26e247d92f4b18e03d fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-9195214dfba08d26e247d92f4b18e03d\"><\/div>\n<p>Since the Voting Rights Act was passed in 1965, \u201cdisparities in voter registration and turnout due to race were erased,\u201d the court noted, \u201cand yet [Congress] ignores these developments.\u201d<\/p>\n<p>The Court ruled, as Heritage Foundation senior legal fellow Hans von Spakovsky explained, that \u201cCongress would \u2026 have to show that there were still \u2018blatantly discriminatory evasions of federal decrees,\u2019 \u2018voting discrimination on a pervasive scale,\u2019 or \u2018flagrant\u2019 or \u2018rampant\u2019 voting discrimination,\u201d something it failed to do.<\/p>\n<p>Despite hysterics from the left, the 2013 ruling did not appear to hamper minority voter turnout. <a href=\"https:\/\/www.census.gov\/library\/stories\/2021\/04\/record-high-turnout-in-2020-general-election.html\" target=\"_blank\" rel=\"noreferrer noopener\">Census Bureau<\/a> data shows the 2020 election saw the \u201chighest voter turnout in the 21st century.\u201d Black voters had a 3 percent increase in turnout compared to 60 percent in 2016. Hispanic voter turnout also increased from 48 percent in 2016 to 54 percent in 2020.<\/p>\n<p>Democrats want you to believe the court\u2019s decision left a need for recourse by the federal government to address potential voting discrimination. But <a href=\"https:\/\/www.justice.gov\/crt\/section-2-voting-rights-act\" target=\"_blank\" rel=\"noreferrer noopener\">Section 2<\/a> bans voting discrimination on the basis of things like race and color while Section 3 says a court can oversee a jurisdiction if it\u2019s determined oversight is necessary to comply with the 14th and 15th Amendments. <\/p>\n<div class=\"fdrlst__b89e9-40d9d9e94ca4e184852ed4c3acf23976 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-40d9d9e94ca4e184852ed4c3acf23976\"><\/div>\n<p>As von Spakovsky explained, HR 14 would \u201creimpose\u201d an even stricter formula that would give the DOJ final say over states\u2019 voting laws for 10 years \u201cif the attorney general determined that ten \u2018voting-rights violations\u2019 occurred during a 25-year period, even if the state was responsible for only one of them and the rest were committed by city or county governments over which the state had no authority.\u201d<\/p>\n<p>\u201cA claimed discriminatory effect based purely on a statistical disparity would count as a violation,\u201d he noted.<\/p>\n<h2 class=\"wp-block-heading\">HR 14 Would Empower the DOJ to Make War on Voter ID <\/h2>\n<p>Specifically, passing a voter ID law <a href=\"https:\/\/www.heritage.org\/election-integrity\/commentary\/against-the-john-lewis-voting-rights-advancement-act\" target=\"_blank\" rel=\"noreferrer noopener\">would<\/a> \u201cautomatically trigger preclearance requirements,\u201d subjecting a jurisdiction to DOJ scrutiny.  <\/p>\n<p>The Biden DOJ has made no secret of its views on voter ID. Attorney General Merrick Garland <a href=\"https:\/\/thefederalist.com\/2024\/03\/04\/biden-department-of-justice-declares-war-on-voter-id-and-other-election-security-laws\/\" target=\"_blank\" rel=\"noreferrer noopener\">boasted<\/a> earlier this week of the department\u2019s efforts to challenge \u201cvoter ID requirements,\u201d and the DOJ <a href=\"https:\/\/thefederalist.com\/2024\/03\/01\/court-affirms-arizonas-need-to-keep-noncitizens-off-voter-rolls-but-makes-it-harder-to-do-so\/\" target=\"_blank\" rel=\"noreferrer noopener\">sued<\/a> Arizona for requiring people prove their citizenship in order to vote by mail or in presidential elections. <\/p>\n<p>Often, the DOJ works with left-wing groups in its efforts against voter ID laws. The department was scolded in 2012 after worked alongside the <a href=\"https:\/\/www.aclusc.org\/en\/press-releases\/court-blocks-south-carolina%E2%80%99s-discriminatory-voter-id-law-for-2012-election\" target=\"_blank\" rel=\"noreferrer noopener\">ACLU<\/a> to object to a South Carolina voter ID law, as von Spakovsky <a href=\"https:\/\/www.heritage.org\/election-integrity\/report\/enabling-partisan-federal-bureaucrats-control-state-election-laws-the\" target=\"_blank\" rel=\"noreferrer noopener\">pointed out<\/a>. <\/p>\n<p>The state had a voter ID law in place since the late 1980s that permitted individuals without a photo ID to vote so long as they had a non-photo voter registration card. The new law <a href=\"https:\/\/www.aclu.org\/legal-document\/south-carolina-v-holder-decision?redirect=voting-rights\/south-carolina-v-holder-decision\" target=\"_blank\" rel=\"noreferrer noopener\">stipulated<\/a> voters with the non-photo voter registration card would have to sign a statement at the poll listing why they haven\u2019t obtained a photo ID to vote before being allowed to cast a ballot. The law expanded the types of eligible photo IDs and created new photo registration cards free of charge. <\/p>\n<p>In an opinion penned by then-Circuit Judge Brett Kavanaugh, a federal court found the law was \u201cnot enacted for a discriminatory purpose.\u201d<\/p>\n<p>Another federal court <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/515\/900\/#:~:text=The%20court%20assumed%20that%20compliance,violates%20the%20Equal%20Protection%20Clause.\" target=\"_blank\" rel=\"noreferrer noopener\">chastised<\/a> the department in a 1995 redistricting case for its \u201cuse of partisan advocates in its dealings with state officials and for its close cooperation with the ACLU\u2019s vigorous advocacy of minority district maximization.\u201d<\/p>\n<p>And let\u2019s not forget when the <a href=\"https:\/\/www.aclu.org\/press-releases\/civil-rights-groups-sue-georgia-over-new-sweeping-voter-suppression-law\" target=\"_blank\" rel=\"noreferrer noopener\">ACLU<\/a>, the Biden administration, and other groups sued Georgia over its Election Integrity Act of 2021, alleging its provisions (including voter ID requirements) would prevent black Georgians from voting. <\/p>\n<p>It did nothing of the sort, and the Peach State saw a record-breaking turnout during early voting for the 2022 midterms, as The Washington Post <a href=\"https:\/\/www.washingtonpost.com\/politics\/2022\/05\/21\/voting-is-surging-georgia-despite-controversial-new-election-law\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>. Approximately 800,000 Georgians cast an early, in-person vote, \u201cmore than three times the number in 2018, and higher even than in 2020, a presidential year.\u201d Then-70-year-old Patsy Reid told the outlet she heard it was going to be more difficult to vote because of Republicans but instead found herself \u201ctreated with the respect that I knew I deserved as an American citizen.\u201d Reid said she encountered no problems voting. <\/p>\n<h2 class=\"wp-block-heading\">This Isn\u2019t Democrats\u2019 First Attempted Elections Power Grab<\/h2>\n<p>HR 14 is the junior version of another federal elections takeover bill, HR 1, which Democrats pushed in 2021. <\/p>\n<p>Going even <a href=\"https:\/\/thefederalist.com\/2022\/01\/07\/democrats-top-priority-before-fall-elections-is-rigging-u-s-voting-rules\/\" target=\"_blank\" rel=\"noreferrer noopener\">further<\/a> than HR 14, HR 1 sought to mandate mail-in ballots and delay final results by eradicating legal deadlines for mail-in-ballots, among other things, as my colleague <a href=\"https:\/\/thefederalist.com\/2021\/03\/08\/15-insane-things-in-democrats-h-r-1-bill-to-corrupt-elections-forever\/\" target=\"_blank\" rel=\"noreferrer noopener\">Joy Pullmann<\/a> explained. Other provisions included dropping meaningful voter ID requirements and preventing the clean-up of voter rolls. <\/p>\n<p><strong>[READ: <\/strong><a href=\"https:\/\/thefederalist.com\/2021\/03\/08\/15-insane-things-in-democrats-h-r-1-bill-to-corrupt-elections-forever\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>15 Insane Things In Democrats\u2019 H.R. 1 Bill To Corrupt Elections Forever<\/strong><\/a><strong>]<\/strong><\/p>\n<p>That legislation would have defied \u201cthe Elections Clause of Article 1 of the Constitution and the Electors Clause of Article II,\u201d warned a <a href=\"https:\/\/content.govdelivery.com\/attachments\/INAG\/2021\/03\/03\/file_attachments\/1712412\/HR1%20Letter%20332021.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">letter<\/a> signed by several Republican attorneys general back in 2021. Those constitutional provisions ensure that \u201cStates have principal \u2014 and with presidential elections, <em>exclusive \u2014<\/em> responsibility to safeguard the manner of holding elections,\u201d the letter explained.<\/p>\n<div class=\"fdrlst__b89e9-271513bf90e6a47020fb4ebaeaa1558b fdrlst__b89e9-after-post-content\" id=\"fdrlst__b89e9-271513bf90e6a47020fb4ebaeaa1558b\"><\/div>\n<hr class=\"wp-block-separator\">    \t\t\t\t\t   \t\t\t\t\t\t\t\t\t<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Democrats want to strip states and local jurisdictions of their control over elections and hand power to President Joe Biden\u2019s weaponized Department of Justice and its left-wing allies to override election integrity laws.
