That means the entire prosecution could crumble with\u200b defendants having a new \u200davenue \u200cto\u2064 challenge Democrat lawfare.<\/p>\n<p><a href=\"https:\/\/www.amazon.com\/Find-Votes-Hard-Charging-Prosecutor-President\/dp\/B0CNKVQRM5\"><em>Find Me\u2063 the Votes: A Hard-Charging Georgia Prosecutor,\u2064 a Rogue President, and\u200b the\u2062 Plot \u2063to Steal an American Election<\/em><\/a>  \u2062 is a fawning \u200dpolitical biography of Willis. For context on the bias of the \u2064authors, Isikoff was an original \u2063Russia-collusion hoaxer, and his articles to that end were <a href=\"https:\/\/thefederalist.com\/2018\/07\/23\/confirmed-doj-used-materially-false-information-to-secure-wiretaps-on-trump-associate\/\" target=\"_blank\" rel=\"noreferrer noopener\">used to secure\u2064 warrants<\/a> for the FBI to spy on innocent Republican \u2063presidential\u2064 campaign advisers such as Carter Page.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1499979204\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-1158bbccbb62d0ffe4ce94dd6dcb3be1 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-1158bbccbb62d0ffe4ce94dd6dcb3be1\"><\/div>\n<p>For years, the media and other Democrats have held up Willis as a brilliant \u200cand credible prosecutor of\u2064 Republicans. The new book suffers from poor timing, \u200dwith \u2062Willis and her lover accused\u200c of \u2064perjury, subornation\u2063 of perjury, \u2064bribery, and kickbacks related to the prosecution. Willis could \u2064be removed \u200dfrom \u200dthe prosecution as \u200bearly as this week.<\/p>\n<h2 class=\"wp-block-heading\">Willis\u2019 Radical Roots<\/h2>\n<p>Nevertheless, the book shares interesting details about Willis\u2019\u200b father, John \u2062C. Floyd, and his radical past. Described as a \u201conetime radical activist\u201d who considered the police to be the \u201cenemy\u201d and an \u201coccupying army,\u201d Floyd founded the Black Panther Political\u2063 Party of Los Angeles and said of it, \u201cOur political philosophy is black nationalism.\u201d He took former \u2062Communist \u200bParty vice presidential nominee Angela Davis as\u200d a lover and lived with her prior to\u200d her\u2063 being placed on the FBI\u2019s \u200cMost \u2064Wanted \u200clist \u200dfor purchasing the gun\u200d used to murder a Marin County, California judge.<\/p>\n<p>Willis, who was \u2062raised by her father, worked for Beverly Hills\u2064 attorney Howard \u200bSchmuckler before \u200dhe was disbarred and \u2063also before\u200b he\u2063 was imprisoned for running a\u2063 fraudulent mortgage rescue company.\u200b She worked for another lawyer\u200b in Atlanta \u200bwho was disbarred for tipping off \u2064a drug dealer to an impending \u2062DEA raid. At \u200bthat firm,\u2062 she represented \u2063a\u200d crack dealer who \u201cturned out to be\u200d the male\u200c stripper at her bachelorette \u200bparty\u201d and \u2062worked with Keisha Lance Bottoms, a former Atlanta mayor and now a top domestic policy adviser to President Joe Biden.<\/p>\n<p>Isikoff provides these details to help readers \u201cunderstand how Willis \u2062became \u2062the kind of law-and-order \u200bDA who would unflinchingly take on Donald Trump.\u201d<\/p>\n<p>Willis ran on pledges to restore professionalism and sexual ethics to the Fulton County district attorney\u2019s office and to\u200d begin to deal with a backlog of 11,000 unindicted homicides, assaults, shootings, and other crimes. Instead, the\u2063 night before \u2062her official first day, word leaked of a recent phone call between Trump\u200d and Georgia Secretary of State Brad Raffensperger. The phone call had \u2063been \u200c <a href=\"https:\/\/thefederalist.com\/2021\/03\/17\/medias-entire-georgia-narrative-is-fraudulent-not-just-the-fabricated-trump-quotes\/\" target=\"_blank\" rel=\"noreferrer noopener\">dishonestly portrayed<\/a> by Trump \u2064opponents, and Willis hoped that Raffensperger had been \u2064in Fulton County for the call, \u2064so she could \u200dprosecute Trump based on\u2064 that false understanding of\u200b the call.<\/p>\n<p>When she showed up for her first day of work, according to \u2064the book, \u201c\u2018I just remember sitting down and looking \u200cat the TV and thinking\u2019 maybe he was\u200c in \u2062Fulton County, she recalled. Her county.\u201d<\/p>\n<h2 class=\"wp-block-heading\">A Political Activist in Georgia\u2019s Election Office<\/h2>\n<p>However, the\u200c person who recorded the phone call wasn\u2019t in Fulton County or even in Georgia. That\u2019s a problem. Jordan Fuchs, a political activist who \u2064serves as Raffensperger\u2019s chief of staff, was in Florida, where it is illegal to record a call without\u200c all parties to the\u200b call consenting\u200c to the recording. She neither asked for nor \u2062received consent to record.<\/p>\n<p>Fuchs was one of \u200bthe\u200c main sources for Isikoff and \u200dKlaidman\u2019s book, \u2064they admit \u2062in their acknowledgments.\u200b While they reward her with effusive praise throughout, she comes off very poorly. For example, she\u200b offers\u200c a frankly unhinged conspiracy theory that President Trump \u200bwas planning to lose the 2020 election as early as May of 2020 and was therefore floating a plan\u200d with\u2063 Washington \u2064Post reporters to\u2063 win the election in Georgia through\u2062 the\u2063 legislature. She describes how she \u201cinvented a new policy\u201d to block public view of an election audit. She indicates such little\u200d knowledge of\u200d election \u200blaws and processes\u200d that she seems to \u200dthink Georgia requires voters to\u200d use Social Security numbers\u2063 to vote.<\/p>\n<p>Fuchs is instead described as a \u201cstreet-smart deputy\u201d of\u2062 Raffensperger who is obsessed with personal slights, political \u2062payback,\u200b and her hatred \u2063of Trump, his supporters, and his team. Her previous dabbling in\u2064 the occult is contextualized, along with her shocking lack of\u2063 knowledge of election\u200b law and processes \u2014 which brings\u2062 us to the\u200d illegally taped phone call.<\/p>\n<h2 class=\"wp-block-heading\">Illegal Phone Call Recording<\/h2>\n<p>\u201cUnlike \u200dmany of her \u200dfellow Republican consultants with \u200bwhom \u200bshe had \u2062worked, Fuchs had a friendly working relationship\u200b with \u200cmembers of the Fourth \u200cEstate,\u201d Isikoff and Klaidman write before describing Fuchs\u2019 regular leaks to The Washington Post, \u200dwhich conservatives despise for its left-wing propaganda, hoaxes\u200c such as \u200dthe Russia-collusion lie, and smears \u200cof\u200c conservatives such as\u2063 Justice\u200c Brett Kavanaugh.<\/p>\n<p>Fuchs first gave The Washington Post <a href=\"https:\/\/thefdrlst.wpengine.com\/2021\/03\/16\/washington-post-accuses-trump-of-a-crime-based-on-fabricated-quotes\/\" target=\"_blank\" rel=\"noreferrer noopener\">fabricated quotes<\/a> they later had to retract about a \u2064phone call President Trump\u2064 had\u2064 with someone in the elections office. Though Fuchs \u2064was not busted \u2062for her lie\u200c until March 2021, months after the <a href=\"https:\/\/thefdrlst.wpengine.com\/2021\/03\/16\/washington-post-accuses-trump-of-a-crime-based-on-fabricated-quotes\/\" target=\"_blank\" rel=\"noreferrer noopener\">fabricated quotes \u200dwere used to\u200d impeach President Trump<\/a>, the authors of the book say the embarrassment of\u2063 being found\u200b out taught her\u200c the importance of recording phone calls such as the early January 2021 phone call that forms the\u200b basis of Willis\u2019 investigation. They\u200b do not explain how this lesson worked \u2063in terms of the space-time continuum.<\/p>\n<p>In\u200d any case, Fuchs recorded a phone call between\u200b Trump, Raffensperger, and their associates. Fuchs ended the call by saying they\u2064 should get off the phone and work to \u201cpreserve the relationship\u201d between\u200c the\u200b two \u200doffices. Instead, she immediately leaked \u2062the phone call to The Washington Post,\u200c which published it \u2062hours later.<\/p>\n<h2 class=\"wp-block-heading\">Covering \u2062up the Crime<\/h2>\n<p>This is\u2063 where the authors of the book admit that the\u2063 very recording of the\u200b call was a crime:<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>Fuchs has never talked \u200bpublicly about\u2063 her taping of \u200dthe phone call; she learned, after the fact, that Florida where she was at the\u2063 time is one\u2063 of fifteen states\u2064 that\u200c requires\u2063 two-party consent for the taping of phone calls. A\u200c lawyer for Raffensperger\u2019s \u200doffice asked the January 6 \u2064committee not to call her as a witness for reasons the committee\u2019s lawyers assumed were due to her potential\u2064 legal exposure. The committee agreed.\u2064 But when she \u2063was called\u2064 before a Fulton County special grand \u2062jury convened by Fani Willis, she was granted immunity and confirmed the taping, according\u200d to three sources with direct knowledge of her testimony.<\/p>\n<\/blockquote>\n<p>Republicans had long suspected Fuchs was the source of\u200b the audiotaped \u2062call and, further, \u2063that she had illegally recorded it in Florida. Fuchs had noted in \u200ba Facebook post that \u200cshe was in Florida visiting\u200b family around the time \u2062of the call. \u2062The book describes the close working relationship and \u201csecret collaboration\u201d of the Liz Cheney-led Jan. \u20636 committee\u200b and Fani \u2063Willis\u2019\u2064 prosecutorial team. Fuchs should\u200d have been\u2064 a major\u2062 part of the\u2064 televised show trial Cheney put \u2063on, further convincing Republicans that Fuchs had illegally taped the call and Cheney was helping cover that up.  \u2062(Incidentally, the book portrays Cheney as\u2063 the real leader of the Jan. \u200b6 \u2062committee,\u200c that she viewed\u2064 it as a \u201cplatform for her to resuscitate her\u2064 political career\u201d and would \u201cprovide \u2062a springboard for a Cheney \u200cpresidential run.\u201d)<\/p>\n<p>The authors go on to say Fuchs would\u2062 attempt to escape prosecution for the call if a\u200d Florida official brought charges by claiming she taped and immediately leaked the call to \u200bThe Washington Post for \u2063\u201claw enforcement \u200bpurposes.\u201d\u2063 The authors somewhat hilariously \u2064describe this claim as an \u201ceffective defense.\u201d<\/p>\n<h2 class=\"wp-block-heading\">Fruit of the \u2064Poisonous Tree<\/h2>\n<p>The \u200cproblem \u200bfor Fani \u2062Willis\u2019 political prosecution is\u200c that the book convincingly shows the\u2062 entire prosecution rests on a piece of evidence that everyone\u200b now knows\u200c was illegally obtained \u2014\u200c never mind that the evidence has also been <a href=\"https:\/\/thefederalist.com\/2021\/03\/17\/medias-entire-georgia-narrative-is-fraudulent-not-just-the-fabricated-trump-quotes\/\" target=\"_blank\" rel=\"noreferrer noopener\">completely misinterpreted<\/a>.<\/p>\n<p>\u201cAnd \u2063Fuchs did what was arguably \u2064the single gutsiest and most consequential act of\u200c the entire \u200cpost-election battle,\u201d the authors write. \u201cWithout telling Raffensperger or Meadows, she taped \u2063the call.\u201d<\/p>\n<p>\u201cIt\u2062 was all\u200b the evidence Fani Willis \u2063needed to get started,\u201d they write of the leaked recording, adding, \u201cThe\u200b recording was the single piece of damning \u2064evidence that had launched the \u200dinvestigation.\u201d<\/p>\n<p>With this evidence provided in the hagiography of Willis, those persecuted by her political\u2062 prosecution could argue the entire investigation is corrupted by the \u201cfruit of the poisonous tree\u201d doctrine.<\/p>\n<p>\u201cFruit of the poisonous trees\u2062 is\u2063 a doctrine that extends the exclusionary rule to\u2063 make evidence inadmissible \u200din court if it was \u200cderived from evidence that was illegally\u2064 obtained,\u201d according to <a href=\"https:\/\/www.law.cornell.edu\/wex\/fruit_of_the_poisonous_tree\" target=\"_blank\" rel=\"noreferrer noopener\">Cornell Law School\u2019s Legal Information Institute<\/a>. \u201cAs \u200cthe \u200cmetaphor suggests, if the evidential \u2018tree\u2019\u2064 is tainted,\u200b so is\u200c its \u2018fruit.\u2019 \u2063The\u2063 doctrine was established in 1920 by the decision in <em>Silverthorne Lumber Co. v. United States<\/em>, and the phrase \u2018fruit of the poisonous tree\u2019 was coined by Justice Frankfurter in his 1939 opinion\u200c in <em>Nardone v. United States<\/em>. The rule typically bars even testimonial evidence resulting from\u200d excludable evidence, \u200bsuch as a \u200dconfession.\u201d<\/p>\n<p>With Fani Willis repeatedly saying the entire investigation into \u200dRepublicans was the \u2063result of a phone call \u2062that was illegally recorded, \u2062defendants might pursue legal recourse. \u200dIt\u2019s the latest challenge\u2063 for Willis, even if the political ally judge reviewing whether she can continue prosecuting Georgia Republicans rules in her favor.<\/p>\n<div class=\"fdrlst__b89e9-6a911056b59a4ac9aafebb79d7921d97 fdrlst__b89e9-after-post-content\" id=\"fdrlst__b89e9-6a911056b59a4ac9aafebb79d7921d97\"><\/div>\n<hr class=\"wp-block-separator\">\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Of Trump was based, was actually a routine conversation between two election officials discussing ballot procedures.
