The conservative legal group purportedly acquired \u201ca trove of responsive Clark County records covered by\u2063 the NVRA\u201d from\u2062 Washoe\u2063 County and the Nevada secretary of state\u2019s office \u201cthat were not contained within [Clark County\u2019s] purportedly complete productions.\u201d<\/p>\n<p>The records\u200b Clark County did produce \u201ccompare unfavorably to those \u2064of Washoe County on a number of dimensions, even though the jurisdictions are similarly\u200c situated \u2063with respect\u2063 to the NVRA,\u201d RITE\u2019s notice reads. \u201cFor example, entire classes of documents that are voluminous within Washoe County\u2019s productions are \u2064suspiciously sparse in those \u200cof Clark County. RITE is also confident that Clark County\u2019s productions would compare unfavorably \u200bto those of the Secretary\u2019s Office, had RITE not \u200dpermitted it to exclude\u2064 from its production\u200b records reflecting its communications with county election \u2062officials, including Clark County\u2019s.\u201d<\/p>\n<p>RITE argued\u200c the only ways such disparities can exist is if Clark County officials \u201cwithheld records [they] are \u2063obligated\u201d to produce or\u2062 \u201cfailed to\u2063 maintain these records \u2018for at least 2 \u2064years,&#8217;\u201d both of which would constitute violations\u2063 of the NVRA\u200c and various Nevada laws.<\/p>\n<p>\u201cRITE has identified a new\u200d disappearing act in Las Vegas, but this one \u200bis far less entertaining than a \u200cmagician \u200con the Strip,\u201d RITE President Derek Lyons said in a \u2063 <a href=\"https:\/\/riteusa.org\/rite-spots-irregularities-with-clark-county-election-records-retention-recommends-steps-to-reach-compliance\/\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a>.<\/p>\n<p>While RITE <a href=\"https:\/\/riteusa.org\/wp-content\/uploads\/2024\/02\/Clark-County-Notice-of-Claim-redact.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> it will \u201cwork with Clark County in good faith\u201d to obtain the requested records, the group\u2019s lawyer, Justin Riemer, warned Portillo \u200dthat RITE could\u2062 file a lawsuit if the county fails\u200c to \u200c\u201ccome into full\u200c compliance with the NVRA\u201d within 90 \u2063days.\u200c Riemer also \u2064requested Portillo disclose \u2064her \u2062office\u2019s record retention policies and \u201cacknowledge any unlawful\u200d record retention\u2063 practices that may have affected RITE\u2019s\u200c lawful entitlement to records covered by the Request and confirm [she has] removed and adequately modified [her] \u2062NVRA-violating protocols.\u201d<\/p>\n<\/blockquote>\n<hr>\n<p>Shawn \u2062Fleetwood is a staff writer for \u2063The\u200d Federalist and\u200b a graduate of the University of\u2062 Mary Washington.
