Last summer, the Supreme Court struck down Biden&#8217;s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ocasio-cortez-fires-back-after-biden-rejects-proposal-to-cancel-50k-in-student-loan-debt\/\" title=\"Ocasio-Cortez Fires Back After Biden Rejects Proposal To Cancel K In Student Loan Debt\">student loan forgiveness program<\/a>, declaring\u200b it illegal. However, undeterred \u2064by this ruling, Biden recently announced a modified version of\u200d the program, boasting, &#8220;The Supreme Court blocked it, but that didn&#8217;t stop me.&#8221;<\/p>\n<p>The new plan, although\u200d slightly \u200bsmaller in scale, remains just as illegal as its predecessor. Last time, six states&#8217; attorneys general \u200csuccessfully sued the Biden administration, taking the case all the way \u2064to the \u2064Supreme Court. This time, Kansas will lead the charge \u2062in suing the \u200dadministration, determined to secure another victory.<\/p>\n<p>The law \u2064is clear: \u2064Biden does not have the authority to implement his desired \u200bstudent\u2063 loan forgiveness plan. The Higher Education Act of 1965, passed by Congress, specifically outlines the limited scenarios in which borrowers can have their loans forgiven. Biden&#8217;s plan, however, extends forgiveness\u200c to\u2064 the majority of\u200b borrowers who do not fall within these established categories.\u200c This sleight of hand is achieved by claiming to modify \u2062the &#8220;terms of loan repayment,&#8221; but the result remains the same: loan reductions for individuals outside of Congress&#8217;s authorized scope.<\/p>\n<p>One aspect of the Biden plan, for instance, caps undergraduate loan repayment at 5 percent of &#8220;disposable income,&#8221; as arbitrarily defined by the secretary of education. This effectively means that the \u200cmajority of borrowers will have \u2064no monthly loan payment. \u200bThe \u2063administration even \u2063acknowledges that the average undergraduate borrower will only pay $6,121 for every $10,000 borrowed.<\/p>\n<p>Aside from the legal issues, the\u2062 Biden plan is fundamentally unfair. It forces taxpayers who did\u200d not attend college or worked their way\u200b through school to shoulder the burden of paying off the student \u200cloans \u2062of those who accumulated significant debt. Furthermore, it redistributes money from lower-income Americans to higher-income Americans. As a parent struggling to save for my own children&#8217;s college \u2064education without relying on loans, I personally \u2062feel the direct impact of this unfairness.<\/p>\n<p>While\u200b Biden may attempt to persuade the public of the plan&#8217;s fairness, he will not\u200d be able to convince \u200bthe courts of its legality. By defying the Supreme Court&#8217;s ruling and encroaching\u200c on Congress&#8217;s powers, Biden is acting more like a king than a president in a constitutional republic. We, as vigilant citizens, will not \u200ballow him to get away with it.<\/p>\n<p><i>Kris W. Kobach is the attorney general of Kansas. By attempting to bypass the legislative process and take action on his own, Biden is overstepping his boundaries and undermining the principles of our democratic system.<\/p>\n<p>It is worth noting that the issue of student loan debt is a pressing one in\u200d our\u2063 society. Many Americans are burdened \u200dwith significant amounts of \u200bdebt, hindering their ability to pursue opportunities, buy homes, \u2063or\u2063 start businesses. However, addressing this issue requires thoughtful and careful consideration, not\u200b a hasty and unlawful \u2063executive action.<\/p>\n<p>By circumventing Congress, Biden is setting a\u200c dangerous precedent. If a\u200b president can simply ignore the Supreme Court and bypass the legislative branch whenever it suits\u200b him, our system of\u2064 checks and balances collapses. This not only undermines the authority of the Supreme Court\u200c but also weakens the power of Congress, the\u2063 branch of government responsible for \u200dmaking and enacting laws.<\/p>\n<p>Moreover, \u2064Biden&#8217;s actions show a disregard for the rule\u2062 of law and the importance of upholding the Constitution. \u200cThe Supreme Court, as \u2063the final arbiter of the law, has ruled on the \u2062issue \u200bof student loan \u2064forgiveness. It is not within the president&#8217;s\u200b purview to \u2064ignore or defy the court&#8217;s decisions. Doing so\u200d undermines the separation\u2064 of powers and\u2062 erodes the foundation of our democratic system.<\/p>\n<p>Instead of pursuing unlawful and unconstitutional \u200bactions, President\u2063 Biden should focus on working\u2064 with Congress to find a sustainable and legal solution \u200dto the \u2062<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/some-student-loan-borrowers-boycotting-payments-to-force-government-to-cancel-debt\/\" title=\"Student loan borrowers refuse to pay, urging government to cancel debt\">student loan debt\u2062 crisis<\/a>. This may\u2062 include exploring \u2062options such\u2062 as \u2062targeted relief for\u2064 those in\u200d need, expanding loan repayment \u2063programs, or incentivizing higher education institutions to \u2064offer more\u2064 affordable options.<\/p>\n<p>In \u2062conclusion, President Biden&#8217;s unlawful student loan forgiveness plan is a dangerous overreach of \u200cexecutive power. By attempting to ignore the Supreme Court&#8217;s ruling and bypass Congress, he undermines the \u2064foundations of our democratic system and sets a concerning precedent for future presidents.
