As the\u2062 Biden administration transforms federal\u2063 agencies into a\u2063 get-out-the-vote \u2063army for leftist candidates and causes ahead of November\u2019s pivotal presidential election<\/a>, the politically weaponized U.S. \u200bDepartment \u2063of Justice is doing everything in its power to keep records of the effort under \u2063lock and key. <\/p>\n

The Foundation for Government Accountability (FGA) sued<\/a> the DOJ nearly two years \u2062ago in federal court \u2063after several federal agencies refused to respond to \u200cthe organization\u2019s Freedom \u200dof Information Act\u2063 (FOIA) requests. \u200bFGA, among other\u2063 watchdog groups, wants\u200d documents and other communications tied \u2064to President\u2062 Joe Biden\u2019s Executive Order 14019<\/a> and the \u201cstrategic plans\u201d it required federal agencies to create and use to \u2062\u201cpromote voter registration \u2063and voter participation.\u201d<\/p>\n

Zuckbucks on \u200cSteroids<\/h2>\n
Biden signed the \u200bconstitutionally suspect \u200dorder in March 2021, not long after the Democrat took office. It commands federal agencies\u200b do \u200cwhat legal\u200b experts\u2064 say\u2063 the executive\u2063 branch does not have the legal\u200c authority\u2064 to do: expand voter registration<\/a> and turnout \u2014 using White House\u200c \u201capproved\u201d third-party organizations to help get the GOTV job\u200d done. The sweeping\u2064 initiative has been billed as \u201cBidenbucks,\u201d since it uses federal dollars.<\/p>\n
Think of Executive Order 14019 as Zuckbucks<\/a> on steroids, using your\u2062 money to fund the\u2063 leftist-led effort. <\/p>\n
\u201cThis is clearly weaponization of the government \u2064for a partisan purpose,\u201d \u2062Dave Craig, senior legal fellow at the \u2063 Foundation for Government Accountability<\/a> told me\u200b recently\u200b on \u201cNeed to Know with Jeff Angelo\u201d<\/a> \u2062 on WHO radio in Des Moines. \u201cThe \u200dexecutive order is not only \u200cunlawful, it\u2019s totally unconstitutional.\u201d <\/p>\n
Craig is not alone in \u200dthat assessment. <\/p>\n

Texas Attorney General Ken\u200c Paxton called<\/a> \u200c Biden\u2019s fiat a \u200b\u201cgrotesque insult to election \u2062integrity, \u200con top of being unconstitutional.\u201d\u00a0As Paxton \u200dsaid in\u2064 a\u2062 press release <\/a>in 2022, \u2063the U.S. \u2064Constitution \u200c\u201cexplicitly grants the power of election oversight to state \u200clegislatures.\u201d<\/p>\n
\u201cAllowing \u2064political appointees\u200c at federal agencies to use taxpayer dollars to influence election efforts \u2063runs afoul \u2063of our\u200d election \u2064laws, basic fairness,\u200b and the desperate need for election security,\u201d Paxton said in 2022 \u200dafter signing on to a Louisiana-led\u200c coalition\u2019s letter<\/a> warning Biden of his\u200d constitutional overreach. <\/p>\n
States are\u200d primarily in charge of \u2064determining the \u2064\u201cTimes, Places and Manner of holding Elections\u201d under the Constitution\u2019s \u2064 elections clause<\/a>. It doesn\u2019t \u2063say\u2063 anything about a president using executive branch agencies to \u201cconsider ways to expand citizens\u2019 opportunities to\u200d register to vote and to obtain information about, and participate in, the electoral process,\u201d as\u200d Biden\u2019s\u2062 order directs<\/a>. <\/p>\n
Biden \u200demploys the National Voter Registration\u2064 Act \u2062in \u2063rewriting \u2064the powers of \u200dthe executive branch, but\u200b the 1993 law gives\u2064 the president no such authority, FGA\u2019s Craig said. <\/p>\n

\u201cNot only does \u2064the National Voter Registration \u2062Act\u200b not authorize [federal] agencies\u200d to\u2063 do what they are doing,\u2063 the president is not the constitutionally mandated authority\u200c in the federal government to execute this,\u201d \u2063the attorney said. <\/p>\n
\u2018Noteworthy Progress\u2019<\/h2>\n
Biden\u2019s leftist pals over at \u2064the \u200cACLU insist not only that the president \u200chas the right\u2064 to deputize federal agencies to drive voter turnout, but that \u200bhe needs to do more to realize his \u201cvisionary executive order.\u201d <\/p>\n
\u201cBuilding on its \u2062promising start, it\u2019s time for \u200bthe Biden administration and agencies to finish the job and\u200b fulfill\u2062 the promise of the voting access executive order,\u201d \u2062 Ceridwen\u2064 Cherry<\/a>, former staff attorney for the ACLU Voting Rights Project, wrote<\/a> \u2064last March.<\/p>\n
In a report<\/a> titled, \u200d\u201cStrengthening\u200c Democracy: A Progress Report on\u200d Federal Agency Action to Promote Access to Voting,\u201d the ACLU \u200band dozens\u2063 of leftists partners assert that \u201cA \u200dfew \u2063agencies have made\u200d noteworthy progress.\u201d The short \u2062list of agencies the\u200d ACLU says are \u201con the \u2063right track\u201d \u200bfor\u2062 federal election meddling includes the Department of the Interior,\u2063 the Department of Veterans Affairs, and the Volunteer Income Tax Assistance program \u200din the U.S. Department of the Treasury. <\/p>\n

In June 2022, the\u200d Internal Revenue Service released its Guidance for Promoting \u200cVoter Registration at Volunteer Income Tax \u2062Assistance and\u200d Tax Counseling \u200dfor the Elderly Sites<\/a> as part of\u2064 Biden\u2019s order. The IRS directive includes instructions to \u201cencourage\u201d agency partners to \u201cprovide \u2026 information to taxpayers\u201d about \u201chow to\u2064 engage \u2064in other non-partisan efforts (such as outreach campaigns)\u200b that promote voter participation.\u201d<\/p>\n
What could possibly go wrong? <\/p>\n
Shrouded\u200c in Secrecy <\/h2>\n
While some agencies have boasted of\u2064 their Bidenbucks efforts, the Biden\u200b administration has mostly kept the public in the\u200b dark. Its feverish fight to block disclosure of the records connected to the creation and implementation of the executive \u200border has election\u200c integrity advocates like\u200b the Foundation for Government Accountability\u2064 asking: What is Biden \u2064 hiding<\/a>? <\/p>\n
In July 2022, the U.S. District Court for the \u200bMiddle District of \u2064Florida ordered<\/a> the Department of Justice to respond to FGA\u2019s Freedom of Information\u200c Act request and \u201c provide all\u200b documents<\/a> \u2064 required\u2064 to \u2064be disclosed\u200d under FOIA\u2064 law.\u201d The DOJ finally coughed up\u200b 135 pages of documents, a fragment of the \u20645,500-plus records the agency initially claimed to possess. The documents the department did turn over were heavily redacted, according\u2062 to the foundation. <\/p>\n
According to FGA, \u200cthe DOJ falsely \u2014 and condescendingly \u2014 claimed \u200breleasing the records, \u2063including\u2062 a \u206415-page strategic plan to \u2062carry\u200c out Biden\u2019s order, would only \u201cconfuse the public.\u201d<\/a> In\u2062 the DOJ\u2019s motion<\/a> for summary judgment, attorneys argue \u201csuch public confusion would result from disclosure of the Strategic Plan because it contains many proposed actions that the public might construe as \u2018future commitments, past actions, or provisions already in place.’\u201d<\/p>\n
The DOJ\u200b also cites presidential communications privilege, which it \u200casserts is \u2063\u201cpresumptive,\u201dand that it \u201cpreserves the President\u2019s ability to obtain candid and informed\u2064 opinions from his advisors and\u200d to make decisions confidentially.\u201d<\/p>\n
FGA President and\u200c CEO Tarren \u2064Bragdon \u2062 said<\/a> the DOJ is employing \u200c\u201cflimsy\u200b excuses to\u200d justify concealing key information<\/a> regarding their \u2064participation in government-funded \u2018get out the \u2064vote\u2019 efforts.\u201d<\/p>\n
\u201cPresident Biden is deeply unpopular. It\u2019s clear his administration \u2063has weaponized DOJ to hide records and is using the legal process \u200dto run out the clock before the midterm elections,\u201d\u2064 Bragdon said in \u2063a press release<\/a> following DOJ\u2019s filing. <\/p>\n
A mediation hearing was held more than a year ago.\u200d The FGA still is waiting for a \u200bjudge\u2019s ruling on the \u200crelease of the records. <\/p>\n
\u201cThe president\u2064 is acting unconstitutionally,\u200d the agencies are \u2062acting unlawfully, and \u2064they\u2019re doing so with taxpayer money,\u200c with next to zero \u2062transparency for\u200d the \u2064taxpayers,\u201d Craig said. \u201cThat\u2019s something that has to be fixed.\u201d<\/p>\n
