It utilizes federal funds to expand voter registration and turnout, even ‍though legal experts argue that ⁣the executive branch lacks the constitutional authority to do so. This initiative has raised⁢ concerns about the partisan ⁤manipulation of government⁢ resources and taxpayer dollars.

Texas Attorney General Ken Paxton has been vocal in denouncing the ⁢executive order, describing it as a “grotesque ⁢insult to election integrity” that ⁢is also unconstitutional. According to Paxton, the U.S. Constitution explicitly grants the power ⁣of ⁤election⁢ oversight to state⁣ legislatures, making federal⁤ interference through executive ‌orders highly questionable and potentially unlawful.

The⁣ Biden administration’s reliance on the National Voter Registration Act to justify these actions‍ further raises legal and‌ constitutional concerns. The act ⁤does ‍not ⁣grant federal agencies the authority⁤ to engage in the activities currently underway, nor does it designate the president as the constitutional authority to execute such⁢ actions.

While the ACLU and other left-leaning organizations argue ⁢that the president has the right to deputize federal⁣ agencies for voter turnout efforts, critics argue that this represents an overreach of power. The ACLU, in a report‌ titled “Strengthening ⁤Democracy: A Progress⁤ Report on Federal Agency Action to Promote Access to Voting,” highlights⁣ a few agencies that they believe are on the right track in promoting‌ federal election‌ meddling. However, the primary responsibility for election⁣ oversight lies with ⁤the states, ‌as ⁢outlined in the Constitution’s elections clause.

The lack of transparency surrounding‍ the creation and implementation of the executive ‍order has further fueled⁤ concerns about the administration’s intentions. ⁣Despite mounting pressure, the Biden administration has been reluctant to disclose ⁢the records ⁤and documents related to‌ these efforts.
