Andy \u2062Kim (D-NJ) has filed a\u200d federal\u2063 lawsuit in New \u200cJersey challenging the state&#8217;s controversial &#8220;county\u2062 line&#8221; system. \u200dKim argues that the current system unfairly benefits certain candidates, including his Senate primary opponent Tammy Murphy, who is also New Jersey&#8217;s first lady. The \u2064lawsuit claims that the system violates the First and 14th \u2062amendments,\u2063 as well as the\u2064 Constitution&#8217;s elections clause.\u200b Joining Kim in the lawsuit\u2063 are\u200c two other Democrats, Sarah Schoengood and Carolyn Rush, who are\u200d running for House seats in New Jersey.<\/p>\n<p>&#8220;The broken politics \u2062in New Jersey needs to end once and\u2062 for all,&#8221; Kim posted on X. &#8220;Today\u200d I am filing suit and seeking an injunction to stop the corrupt county\u2063 line system for this June 4 primary and to abolish it permanently going\u2064 forward. 49 states use\u200d fair ballots;\u2063 it&#8217;s time\u2064 NJ does too.&#8221;<\/p>\n<p>Nineteen out \u2062of New Jersey&#8217;s 21 counties currently employ \u200dthe county line system. This system groups party-backed candidates together in one prominent column or row on the ballot, while other candidates are listed separately or in what\u200b is\u200c often referred to as &#8220;ballot Siberia.&#8221; New Jersey is the only state that uses this type of ballot system.<\/p>\n<p>A similar \u200blawsuit was filed in 2020, using the same lawyers as Kim&#8217;s recent\u200c suit, in an attempt to abolish \u200cthe county line system. \u2062However, Democratic \u200band Republican Party leaders in New Jersey oppose eliminating the line.<\/p>\n<p>Kim \u2062argues\u2064 that a select\u2063 few &#8220;party elites&#8221; have the power to give\u2063 their preferred candidates advantageous placement on the ballot,\u200c sharing a picture of\u200b a ballot using the county line system as evidence. \u200dHe also references a Rutgers University study that shows candidates placed on the county line tend to have an advantage in elections.<\/p>\n<blockquote>\n<p>&#8220;Right now NJ allows \u200da handful of party elites\u200c to give their handpicked \u200ccandidates preferential placement on the ballot. This is a deeply unfair advantage that disenfranchises voters by applying undue influence and suppressing choice of candidates.&#8221;<\/p>\n<\/blockquote>\n<p>So far, Kim \u2063has defeated \u2064Murphy in\u2064 all three counties that have held conventions in the primary race. The Murphy campaign has\u2063 lost momentum since its successful start. Alex\u2063 Altman, a spokeswoman for the campaign, dismisses the lawsuit \u2062as a &#8220;hypocritical stunt,&#8221; according \u200cto the \u200dNew\u200d York Times.<\/p>\n<blockquote>\n<p>&#8220;Andy Kim doesn&#8217;t have a problem with the county line system,&#8221; Altman \u200csaid. &#8220;He has a problem with the idea of \u200closing county\u200b lines \u2014\u2063 as he is perfectly happy to\u2064 participate in\u200d the process \u200cwhen he wins.&#8221;<\/p>\n<\/blockquote>\n<p>Murphy argues that she is simply following\u200b the existing rules\u2064 and believes that any changes to the system should not be made during the campaign.<\/p>\n<blockquote>\n<p>&#8220;If there are improvements to be made,&#8221; Murphy said, &#8220;then let&#8217;s have the improvements. But right \u2062now, we are in the middle of a campaign, and let&#8217;s just move forward with the ground rules as we have them.&#8221;<\/p>\n<\/blockquote>\n<p>It remains uncertain whether a judge will hear Kim&#8217;s lawsuit before the state&#8217;s June 4 primary.<\/p>\n<p> <\/p>\n<h2> \u200b Why do critics argue that the county\u200c line system gives an unfair advantage to party-backed candidates?<\/h2>\n<p><span>  Sey is one of only a\u2063 few states\u200c that\u200c still use this system, with the majority \u2062of states instead using a \u2063fair ballot\u2063 system.\u2063<\/p>\n<p>Critics of\u200b the \u200dcounty line system argue that it gives an unfair advantage to party-backed candidates, while suppressing the visibility and chances of success for non-party-backed candidates. They argue that voters are more\u2064 likely to vote \u200dfor candidates listed in the prominent party-backed column, simply because of their placement on the ballot. This, they say, goes against the principles of fair and\u2064 equal representation in elections.<\/p>\n<p>Supporters of the county line system, however, argue that \u2062it helps voters \u200ceasily\u200b identify party-backed candidates, who are more\u2063 likely to \u200badhere \u2063to \u200cthe values\u2063 and policies of their respective parties. They claim \u2063that this system simplifies the voting process and helps voters make informed decisions.<\/p>\n<p>Rep. Andy Kim&#8217;s lawsuit seeks to challenge the constitutionality of the county line system in New Jersey. He argues that the system violates the First and 14th Amendments, as well as \u2062the Constitution&#8217;s elections clause. Kim and his fellow plaintiffs claim that\u2063 the \u200bcounty line system undermines the principles of equal protection under\u200c the law and restricts their ability to compete on a level playing field.<\/p>\n<p>Furthermore, Kim&#8217;s lawsuit alleges that the county line\u2062 system disproportionately benefits certain candidates, including his primary opponent Tammy Murphy, \u200dwho is \u200bNew Jersey&#8217;s first lady.
