It applies to all children, born and unborn, without\u200d limitation,&#8221; wrote Justice Jay Mitchell in the majority decision. &#8220;It is not the role of this Court to craft a new limitation based on our own view of \u2063what is or is \u2062not <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/can-the-white-houses-battle-with-oil-companies-yield-any-results\/\" title=\"Can the White House\u2019s Battle With Oil Companies Yield Any Results?\">wise public policy<\/a>. \u2064That is especially\u2062 true where, as\u200c here, the People \u2062of\u200c this State\u2062 have adopted a Constitutional \u200camendment\u2063 directly \u2062aimed at stopping courts from\u2063 excluding\u2063 &#8216;unborn life&#8217; from legal protection.&#8221;<\/p>\n<\/blockquote>\n<p>The ruling came after three\u200b couples sued \u2063the Center for Reproductive Medicine in Mobile when five of their frozen embryos \u2063were accidentally destroyed during a transfer. They filed a wrongful death\u2063 lawsuit,\u2062 and now, due to the Supreme Court&#8217;s decision, \u200ctheir request for punitive damages will be reconsidered by\u2062 the Mobile\u200d Circuit Court.<\/p>\n<p>However, Justice Greg Cook dissented from the majority decision, expressing concerns that it could hinder in vitro fertilization\u2062 (IVF) in the state.<\/p>\n<blockquote>\n<p>&#8220;No court \u2014 anywhere in the country\u2064 \u2014 has reached the \u200bconclusion\u2063 the main opinion reaches. \u200bAnd, the main opinion&#8217;s \u2062holding almost certainly ends the creation of frozen\u2064 embryos through in vitro fertilization (&#8216;IVF&#8217;) in \u2063Alabama,&#8221; he said.<\/p>\n<\/blockquote>\n<p>In his concurrence with the majority, Chief Justice Tom Parker drew\u200c upon\u200d the works\u200d of historic\u2063 thinkers such \u2062as William Blackstone, \u2064Thomas Aquinas, John Calvin, and Petrus Van Mastricht to support his understanding of Alabama&#8217;s constitutional \u200cprovision.
