However, it wasn&#8217;t just \u200chim who had the power to enact policies. Bureaucrats in federal agencies also had\u2064 their own phones and pens, leading to repeated \u200creinterpretations \u2063of Title IX, a \u200ccrucial federal civil \u200drights \u2064statute.<\/p>\n<p>Title IX, enacted in 1972, protects girls&#8217; and women&#8217;s athletics and prohibits sexual harassment and sex discrimination in schools. However, \u2062in 2015, a \u200dbureaucrat in\u200c the Department of Education (DOE) \u2063issued a sweeping new policy, stating that schools \u2062must consider a person&#8217;s gender identity when assigning them to facilities and teams.<\/p>\n<p>When President Trump took office, he aimed \u200bto\u2063 change the DOE&#8217;s habit of &#8220;regulating\u200c by letter.&#8221; Secretary\u200c of Education \u200bBetsy DeVos \u2064successfully implemented Title IX changes in 2020, striking a balance between eliminating\u200c sexual\u2064 harassment and protecting\u200d due\u2063 process.<\/p>\n<p>However, \u2063the Biden administration is now attempting \u2062to scrap \u2063DeVos&#8217; \u200crules and revive Obama&#8217;s policies. \u200bThey want to expand Title IX to cover sexual\u200b orientation and gender \u2062identity discrimination in schools nationwide, \u2063despite the statute&#8217;s language only addressing &#8220;sex&#8221; discrimination.<\/p>\n<p>The DOE has recently submitted the\u200d final touches to its\u200b new Title \u2063IX rule, which is \u2063expected to be approved by the president.\u2064 This rule \u200cwill require K-12 schools \u200cand colleges to implement policies specifically\u200d addressing \u2062sexual orientations and gender identities\u200d of all kinds, potentially\u200d including bisexuals,\u200b polyamorous individuals, and &#8220;non-binary&#8221; gender \u200didentities.<\/p>\n<p>While it&#8217;s important to enforce anti-discrimination principles\u2062 for transgender individuals, the \u200dBiden administration&#8217;s proposed rule\u2064 goes beyond that. \u2062It demands that schools accept and accommodate every student&#8217;s self-proclaimed \u200bgender identity and sexual orientation,\u200d or face accusations of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/white-house-refuses-to-say-when-joe-biden-believes-students-should-be-taught-sexual-orientation\/\" title=\"White House Refuses to Say When Joe Biden Believes Students Should Be Taught Sexual Orientation\">violating federal civil rights laws<\/a>.<\/p>\n<p>The consequences of this \u2063radical departure from past enforcement of Title IX are immense. The debates over \u200bbathrooms, pronouns, and sports teams are \u200cjust the beginning. With the proliferation of \u2063gender identities\u200c since \u200c2015,\u2064 schools may face demands for separate dormitories\u2062 for \u200deach unique gender \u2064identity and requests from students identifying as animals, autigender, or even cake.<\/p>\n<p>Complying \u200cwith the new Title IX rule will \u2064be challenging for\u200d teachers and administrators. They \u2062will struggle to understand their\u2063 obligations to provide equal access to school facilities for \u200dstudents who identify outside the traditional male or female categories. In extreme cases, individuals\u2062 could claim sexual orientation as a &#8220;minor-attracted person,&#8221;\u200d potentially creating a loophole for pedophiles.<\/p>\n<p>While these outcomes \u2062may seem outrageous \u2062or silly, \u200dtimes \u2063are \u2062changing rapidly,\u2063 and what seems ridiculous today may\u200c become the &#8220;new normal&#8221; tomorrow. That&#8217;s why \u200bthe \u2063Biden administration&#8217;s proposed Title IX changes\u200d are a \u200cdangerous\u2063 gambit.<\/p>\n<hr>\n<p>William E. Trachman \u2063is\u200c the general counsel\u200d of Mountain States Legal\u200c Foundation and the former deputy assistant secretary for\u200d civil rights in the\u2063 Trump \u200dadministration.<\/p>\n<p> <\/p>\n<h2> What are the \u200cconcerns about\u2064 <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/prosecutions-case-in-dc-is-weak-but-trump-may-still-have-a-hard-time-in-election-interference-case-legal-experts-say\/\" title=\"Legal experts say that while the prosecution's case in DC is weak, Trump may still face challenges in the election interference case.\">due process \u2062rights<\/a> for individuals accused of\u200c sexual misconduct\u200d under \u200dthe Obama-era policies,\u2062 and how could reviving these policies potentially lead to unjust outcomes<\/h2>\n<p><span>  This gambit by the Biden\u200c administration is dangerous for\u200c several reasons.\u200d First and foremost, it undermines\u2063 the rule of law. Title IX was enacted by Congress and its language\u2063 clearly addresses &#8220;sex&#8221; discrimination,\u2062 not sexual\u2062 orientation \u2062or gender identity\u2064 discrimination. By attempting to reinterpret the \u2063law to fit their own agenda, the Biden administration is essentially legislating from the executive\u2062 branch,\u2062 bypassing the proper legislative process.<\/p>\n<p>Not only\u2064 does this set a dangerous precedent for future administrations, but\u2062 it \u200balso undermines the separation of \u2064powers\u200d and the checks \u2062and balances that are fundamental to our democracy. \u2062It \u2064allows unelected bureaucrats in federal agencies to \u2064unilaterally change \u2062the meaning of a \u200cstatute without the input \u2062or oversight of Congress.<\/p>\n<p>Furthermore, expanding Title IX to cover sexual orientation and gender identity discrimination in schools raises significant concerns about the infringement\u200c of religious freedom and freedom of speech. Religious schools, for example, may have sincerely-held \u200bbeliefs about human sexuality and may wish to maintain policies \u2062that align with their religious \u2062teachings. These \u2064policies led \u2064to numerous cases of innocent \u200dstudents being falsely accused\u200d and having their lives devastated without any recourse. DeVos&#8217; \u2063Title\u200d IX changes sought to strike a balance between protecting victims of sexual harassment and ensuring that accused students are afforded fair and equitable processes. Reviving Obama&#8217;s policies \u2063would once again tip the scales in favor of accusers, potentially leading to more unjust outcomes.<\/p>\n<p>The \u2063Biden \u200dadministration&#8217;s attempt to revive Obama&#8217;s Title IX policies is not only legally dubious, but it also threatens the fundamental principles of \u2062our democracy and the rights of individuals. It \u200bis imperative that we uphold the rule\u2062 of law \u2063and preserve the proper separation of \u2064powers. Congress should be the entity responsible for creating and amending laws, not unelected\u200d bureaucrats.
