He said it \u2063is possible the court could see &#8220;fragmentation&#8221; with different opinions, but unanimity would be helpful \u200bfor clarity entering the election.<\/p>\n<p>&#8220;If you&#8217;re going \u2063to kick \u2062him off the ballot, do it \u200bnow. Do it quickly. Let&#8217;s pick another candidate,&#8221; Blackman said. &#8220;If you&#8217;re \u200bgoing \u2063to let him\u200d on the ballot, make it clear that he can stay on the ballot and he can be sworn into office. I think a half-measure\u2063 opinion or \u2062a\u2064 majority \u2062of\u200b the court that leaves\u2062 it to Congress is taking \u200da risk. The amendment\u2062 also gives \u2064Congress\u200d power\u2063 to remove this means of disqualification.<\/p>\n<p>&#8220;Those favoring the \u2064Colorado decision argue that Section 3 is self-executing, meaning \u200dit \u200cdoesn&#8217;t take an act of Congress \u2064to\u2064 implement it, \u200cand that Donald Trump \u200bwas an officer of the\u2064 United \u200cStates,&#8221; said Malcolm.<\/p>\n<p>Spakovsky said Section 3 of the\u2064 14th Amendment\u200c gives\u200c Congress the power to \u2062carry it out, \u200cand that it has\u2062 done so on multiple occasions like the <a href=\"https:\/\/heritagelib.org\/amnesty-act-of-1872\" target=\"_blank\" rel=\"noreferrer noopener\">Amnesty\u2062 Act of 1872<\/a> and the <a href=\"https:\/\/constitutioncenter.org\/blog\/the-last-insurrection-case-considered-by-congress#:~:text=The%20Arguments%20on%20the%2014th%20Amendment%20and%20the%20First%20Amendment&#038;text=Cochems%20then%20argued%20that%20the,related%20to%20the%20Civil%20War.\" target=\"_blank\" rel=\"noreferrer noopener\">Amnesty Act of 1898<\/a>. He\u2064 said state \u200bofficials do not have this power.<\/p>\n<p>Strawbridge said\u2062 Congress had historically dealt with issues of ineligibility after elections, so Colorado&#8217;s \u2064removal\u200b of\u2062 Trump from the ballot not \u200donly preempts the \u200cusual \u200cprocess, \u2063but takes congressional power and gives it \u200cto the states.<\/p>\n<p>&#8220;There&#8217;s really no\u2062 textual basis to assume that a state official can determine that the\u200d person will not even appear\u200d on \u200bthe ballot,&#8221; \u2064Strawbridge said.<\/p>\n<p>Rokita agreed, stressing that <a href=\"https:\/\/constitutioncenter.org\/the-constitution\/amendments\/amendment-xiv\/clauses\/703#:~:text=Maltz&#038;text=Section%20Five%20of%20the%20Fourteenth%20Amendment%20vests%20Congress%20with%20the,the%20provisions%20of%20Section%20One.\" target=\"_blank\" rel=\"noreferrer noopener\">Section 5<\/a> of the\u2063 amendment\u200b clearly\u2062 gives Congress the authority to \u2064enforce this law.<\/p>\n<p>&#8220;Federalism and the \u200crule of law also\u2063 mean that every player\u200b in the system must \u2062respect when the\u200c Constitution does entrust \u200dan issue to \u2062Congress, or more\u2062 importantly, the American voters,&#8221; Rokita said. &#8220;Voters \u2063will\u2064 lose all confidence\u2063 if judges decide that voters cannot even\u2063 consider one of our nation&#8217;s two <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/kenyan-ministers-rally-around-metas-facebook-after-watchdogs-ultimatum\/\" title=\"Kenyan ministers rally around Meta\u2019s Facebook after watchdog\u2019s ultimatum\">leading presidential candidates<\/a>.&#8221;<\/p>\n<p>Rokita said the Colorado\u200b Supreme\u200d Court&#8217;s definition of insurrection was overly broad, and would potentially include protesters near polling \u200blocations \u200dor those who <a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/government-drops-charges-against-all-inauguration-protesters-n889531\" target=\"_blank\" rel=\"noreferrer noopener\">rioted<\/a> during Trump&#8217;s inauguration.<\/p>\n<p>&#8220;Did that hinder \u2063the peaceful transfer of power?\u2062 Why weren&#8217;t all those \u200dpeople\u2064 arrested for insurrection?&#8221;\u200c Rokita said.<\/p>\n<p>Strawbridge made a \u2064similar point, citing \u200bDemocrat \u200dSen. \u200bChuck Schumer&#8217;s apparent <a href=\"https:\/\/www.reuters.com\/article\/idUSKBN20R2MU\/\" target=\"_blank\" rel=\"noreferrer noopener\">threats<\/a> to\u200c Supreme Court justices at an abortion rally, threatening \u200c <a href=\"https:\/\/www.nbcnews.com\/politics\/supreme-court\/protests-build-capitol-hill-ahead-brett-kavanaugh-vote-n917351\" target=\"_blank\" rel=\"noreferrer noopener\">protests<\/a> during\u200d Justice \u200cBrett Kavanaugh&#8217;s confirmation, and months of \u2063violent Black Lives Matter <a href=\"https:\/\/www.statesmanjournal.com\/story\/news\/politics\/2020\/07\/26\/portland-protesters-breach-fence-federal-courthouse-police-use-teargas-oregon-black-lives-matter\/5514417002\/\" target=\"_blank\" rel=\"noreferrer noopener\">riots<\/a> in 2020 \u2014 including attacks\u200c on\u200d federal courthouses\u200b \u2014 \u2062which \u2062President\u2062 Joe Biden\u2063 <a href=\"https:\/\/nbcmontana.com\/news\/nation-world\/biden-lauds-2020-blm-riots-as-historic-movement-for-justice-during-monday-speech-mother-emanuel-ame-church-in-charleston-sc-black-lives-matter-george-floyd-summer-of-love-politics-trump-president-white-house-2024-race\" target=\"_blank\" rel=\"noreferrer noopener\">applauded<\/a> in January.<\/p>\n<p>By Colorado&#8217;s standard of insurrection, Strawbridge \u2063asked, why wouldn&#8217;t states also be able to disqualify these figures\u200c from \u200cpublic \u200coffice?<\/p>\n<p>&#8220;Insurrection \u2063is far more serious than \u2064the Colorado court thought throughout our nation&#8217;s history,&#8221; \u200bRokita said.\u2064 &#8220;Insurrection is usually coupled with words like\u2063 &#8216;invasion&#8217; or &#8216;rebellion&#8217;.&#8221;<\/p>\n<p>Spakovsky emphasized that many of Trump&#8217;s <a href=\"https:\/\/www.cbsnews.com\/news\/trump-indictment-full-text-read-2020-election-charges\/\" target=\"_blank\" rel=\"noreferrer noopener\">charges<\/a> stemming from activities after the 2020\u200c election \u200dare simply speech, protected by the \u200dFirst Amendment and its guarantee to freedom \u2062of speech and to petition the government for a redress of \u2064grievances.
