Town\u200c of Middleborough. \u200dThe student, Liam\u200d Morrison, found himself at the center of controversy when his school prohibited him from wearing a T-shirt that boldly stated, &#8220;There are only \u2064two genders.&#8221;<\/p>\n<p>Morrison, a student at Nichols Middle School, \u2063wore the shirt in 2023 and\u2062 was promptly instructed by\u200c school officials to remove it or face being sent home. In response, a lawsuit\u200d was filed in May 2023 by the Alliance \u200bDefending Freedom (ADF) \u200dand the \u2064Massachusetts Family Institute on behalf\u200d of Morrison, arguing that his freedom of speech was being violated.<\/p>\n<p>The ADF attorneys are now seeking a ruling from the court that the student&#8217;s First Amendment rights were \u200dindeed violated. \u2064They are also urging the court \u200bto put an end to the\u2063 school&#8217;s unconstitutional dress code policy, which\u200b discriminates against students based on their viewpoints.<\/p>\n<blockquote>\n<p>&#8220;Students don&#8217;t lose their free speech rights the moment they walk into a school building,&#8221; emphasized \u2062ADF Senior Counsel and Vice President of U.S. Litigation, David Cortman. &#8220;This case isn&#8217;t about T-shirts; it&#8217;s about \u2062a public school telling a middle-schooler that he isn&#8217;t allowed to express a view that differs \u200dfrom their own.&#8221;<\/p>\n<\/blockquote>\n<p>Cortman further\u2062 highlighted the school&#8217;s hypocrisy, stating, &#8220;The school actively promotes its view about gender through posters and &#8216;Pride&#8217; events. And it encourages other students to wear T-shirts expressing messages \u200dabout \u200cgender. At the end of \u2062last school\u200d year, another student wore a shirt that\u200b said, &#8216;He she they,\u2064 it&#8217;s all okay.&#8217; That was allowed, even though just a few weeks before they punished L.M. for his &#8216;There \u2062are only \u2063two genders&#8217; shirt simply because it did not align with their\u2062 preferred beliefs.&#8221;<\/p>\n<p>In an act of \u2063protest, \u200dwhen school officials attempted to \u200dcensor Morrison&#8217;s shirt, he \u200bchose \u2063to wear an altered\u2063 version that read, &#8220;There\u200c are [censored] genders.&#8221; However, upon his \u2064return to school, he was immediately sent to the principal&#8217;s office.<\/p>\n<p>In June 2023, a judge in the U.S.\u2063 District Court for the District of\u2064 Massachusetts \u2064denied Morrison&#8217;s attorneys&#8217; \u200crequest for a temporary injunction, which would have suspended\u2064 the school&#8217;s ability to\u2064 prohibit Morrison\u2062 from expressing his views on gender.
